DECISION

PROMULGATING THE BASIC STATISTICAL REPORTING REGIME APPLICABLE TO STATE ENTERPRISES AND ENTERPRISES AND PROJECTS WITH FOREIGN DIRECT INVESTMENT CAPITAL

THE PRIME MINISTER

Pursuant to the December 25, 2001 Law on Organization of the Government;
Pursuant to the November 19, 2005 Enterprise Law;
Pursuant to the November 29, 2005 Investment Law;
Pursuant to the June 26, 2003 Statistics Law;
Pursuant to the Government Decree No. 40/ 2004/ND-CP of February 13, 2004, detailing and guiding a number of articles of the Statistics Law;
Pursuant to the Prime Minister’s Decision No. 43/2004/QD-TTg of June 2, 2010, promulgating the system, of national statistical norms;
At the proposal of Minister of Planning and Investment,

DECIDES:

Article 1. To promulgate the basic statistical reporting regime applicable to state enterprises (including state groups and corporations) and enterprises and projects with foreign direct investment capital.

Article 2. Reporting units

1. State enterprises (enterprises in which the State holds over 50% of charter capital), including:

- Wholly state-owned enterprises;

- Offices of state groups and corporations (reporting on the operation of offices and dependent cost-accounting units of groups and corporations);

- Joint-stock companies and limited liability companies in which the state capital portion accounts for over 50% of charter capital.

2. Enterprises and projects with foreign direct investment capital, including:

- Enterprises in which foreign investors' capital accounts for 10% or more of charter capital;

- Projects in which foreign investors' capital accounts for 10% or more of investment capital.

Article 3. Reporting contents and periods

Monthly reporting: Monthly reports shall be made by state enterprises and enterprises and projects with foreign direct investment capital operating in such areas as mining, processing industries, electricity, natural gas, water supply, garbage and wastewater treatment, information and communications, real estate business, transportation and warehousing, trade and services.

To-be-reported items: Enterprises shall monthly report the following items:

- Net turnover of each production or business line;

- Quantity/output of products of each production or business line.

In addition to the above items, enterprises engaged in goods import or export shall report on the quantity and value of imported/exported goods by importing/exporting country and goods category.

Enterprises and projects with foreign direct investment capital shall report on charter capital and implemented investment capital by capital source, employment, taxes and other state budget remittances.

Quarterly reporting: Quarterly reports shall be applicable to state enterprises and enterprises and projects with foreign direct investment capital operating in such areas as agriculture, forestry and fisheries, construction; enterprise making or receiving payments to/from foreign parties for the provision of services; and enterprises acting as investors.

To-be-reported items include:

For enterprises engaged in construction activities: value of construction output by type of works;

For enterprises making or receiving payments to/from foreign parties for the provision of services: value of payments by type of services;

For enterprises acting as investors: implemented investment capital classified by capital source and investment item.

Biannual reporting: Biannual reports on employment and incomes of employees shall be made by all state enterprises and all enterprises and projects with foreign direct investment capital.

Biannual reports on agricultural, forestry and fisheries activities shall be made by state enterprises and enterprises and projects with foreign direct investment capital.

To-be-reported items include:

- For enterprises engaged in cultivation activities: land area for growing annual crops and area under perennial plants;

- For enterprises engaged in husbandry activities: quantity and output of certain major animals;

- For enterprises engaged in forestry activities: the area of planted forests and the output of exploited timber and non-limber forest products;

- For enterprises engaged in fisheries activities; output of reared and fished aquatic products.

Annual reporting: Annual reports shall be made by all state enterprises and all enterprises and projects with foreign direct investment capital.

To-be-reported items include:

Items to be reported by all enterprises:

- Their identification information;

- Items on their production and business results, including turnover of each production and business line; taxes, charges and fees paid into the state budget; and profits;

- Employment and incomes of employees; social insurance, health insurance and unemploy­ment insurance premiums and trade union dues;

- Implemented investment capital in the year classified by capital source and investment item;

- Payments for and investments in scientific research and technological development and environmental protection and treatment;

- Items on the application of information technology;

- Items on waste treatment and environmental protection.

Specialized items according to operation areas:

In addition to the general items specified in Clause a, enterprises and projects shall report specialized items according to their operation areas, including items reflecting their products/ output and production scale and capacity, specifically:

For enterprises engaged in industrial production: volumes of products manufactured. sold, and in stock; value of products ex-warehoused and sold in the year and net turnover of industrial production.

For enterprises engaged in construction activities: value of construction by type of works; area of houses of each quality grade and type built in the year.

For enterprises engaged in commercial activities: number and areas of business establishments.

For enterprises providing accommodation services: number of business establishments and the number of guests per day and their length of stay.

For enterprises engaged in transportation, warehousing and cargo handling services: number of means of transport classified by way of transport and transportation and cargo handling products classified by way of transport.

For enterprises providing catering services: number of business establishments by type of services.

For enterprises engaged in tourism activities: number of tourist service establishments and number of tourists per tour and their length of stay;

For enterprises engaged in agriculture, forestry and fisheries activities:

- Areas under, and yields of certain types of crops;

- Output and products of certain types of raised animals;

- Output of exploited forest products;

- Output of raised and fished aquatic products;

- Number of motorized fishing vessels.

For enterprises engaged in garbage collection and treatment activities: volume of garbage collected or treated.

For enterprises engaged in import and export. activities: quantity and value of imported and exported goods classified by importing/exporting country and commodity group.

For enterprises receiving or making payments for the provision of services from/to foreign parties: value of payments by type of services or country of foreign partners.

Article 4. Recipients of reports

- The General Statistics Office (via provincial- level Statistics Offices) shall receive reports from all slate enterprises and enterprises and projects with foreign direct investment capital in localities.

- Provincial-level state management agencies in charge of foreign direct investment shall receive reports from enterprises and projects with foreign direct investment capital in their localities.

Article 5. Deadlines for receiving reports Monthly reports: the 12th every month.

Quarterly reports: the 12th of the last month of each quarter.

Biannual reports: June 12 and December 12.

Biannual reports on husbandry output and products: April 14.

Annual reports: March 31 of the next year.

Annual reports on agriculture, forestry and fisheries activities: December 12, for tentative reports, and January 25 of the following year, for official reports; reports on husbandry output and products: October 12.

Article 6. The Minister of Planning and Investment shall, pursuant to this Decision, issue a system of forms and explanations for the basic statistical reporting regime and, at the same time, urge, inspect and examine the implementation of the reporting regime and report the results of implementation of this Decision to the Prime Minister.

Article 7. This Decision takes effect on January 15, 2011. The following documents are annulled:

- The Planning and investment Minister's Decision No. 62/2003/QD-BKH of January 27, 2003, promulgating the periodical reporting regime applicable to state enterprises;

- Decision No. 373/QD-TCTK of September 10, 1996, of the General Director of the Statistics Office, promulgating the statistical reporting regime applicable to corporations set up under decisions of the Prime Minister or ministers (Corporations 90 and 91) and corporations set up under decisions of provincial-level People's Committee chairpersons;

- Joint Circular No. 01/LB-TCTK-BKHDT of March 31, 1997, of the General Statistics Office and the Ministry of Planning and Investment, providing for the statistical reporting regime applicable to foreign-invested enterprises.

Article 8. Ministers, heads of ministerial-level agencies, heads of government-attached agencies, chairpersons of provincial-level People's Committees, directors general or directors of stale enterprises and enterprises and projects with foreign direct investment capital and concerned organizations and individuals shall implement this Decision.-
