DECISION
ON PROMULGATING THE LIST OF IMPORTED GOODS REQUIRED TO BE EXAMINED HYGIENE AND FOOD SAFETY BY HS CODES
MINISTER OF HEALTH
Pursuant to the Decree No.49/2003/ND-CP dated 15/5/2003 of the Government stipulating the function, tasks, powers and organizational structure of the Ministry of Health”;
Pursuant to the Ordinance on Hygiene and Food Safety No.12/2003/PL-UBTVQH 11 dated July 26, 2003;
Pursuant to the Decree No.163/2004/ND-CP dated September 07, 2004 of the Government “detailing the implementation of a number of Articles of the Ordinance on Hygiene and Food Safety”;
Pursuant to Clause 2, Article 8, the Decree No.12/2006/ND-CP dated January 23, 2006 of the Government detailing the implementation of the Commercial Law on international goods purchase and sale activities and activities of goods purchase and sale agency, processing and transit with foreign parties;
At the proposal of General Director of Department of Safety and Food Hygiene-Ministry of Health.
DECIDES
Article 1. Issuing together with this Decision is the “the List of imported goods required to be examined hygiene and food safety by HS codes” including:
1. Manufactured articles from meat, fish;
2. Fats and oils of animals or plants;
3. Milk and products from milk;
4. Sugar and sugar confectionery;
5. Cocoa and manufactured articles from cocoa;
6. Manufactured articles from cereals, flour, starch, or milk; cakes;
7. Coffee, tea, pepper;
8. Manufactured articles from vegetables, fruits;
9. Spices;
10. Beverages, liquors and vinegar;
11. Packaging and containers of food items;
12. Functional foods and health protection products;
13. Food Additives
Article 2. This Decision takes effect from the signing date.
Article 3. In case of having dispute related to the HS codes in the list attached to this Decision, the Department of Safety and Food Hygiene (Ministry Of Health) will preside over and coordinate with the General Department of Customs (Ministry of Finance) reconsider to unify and decide the codes.
Article 4. The Mr. (Ms.) Chief Office, Chief Inspector, General Director of Department of Legal Affairs-Ministry of Health, General Director of Department of Safety and Food Hygiene under the Ministry of Health, Directors of Departments of Health in provinces and cities centrally-run; heads of health units, heads of related units and domestic, foreign organizations and individuals that operate in the field of food import into Vietnam are responsible for the implementation of this Decision./.
