DECISION

ON AMENDMENT OF CIRCULAR No. 03/TT-NH5 ISSUED ON FEBRUARY 9,1996

GOVERNOR OF THE STATE BANK OF VIETNAM

Pursuant to the Ordinance of State Bank of Vietnam, Ordinance on Banks, Credit Cooperatives and Finance Companies issued on 24 May ,1990;
Pursuant to the Government Decree No.15/CP issued on 2 March ,1993 on a Duties, Powers and Responsibilities on State Management by Ministries and Ministerial-level Organization;
Pursuant to the Government Decree No.64/CP promulgated on October 9,1995 for issuing "Temporary Regulation on Organization and Operation of Finance Leasing Companies in Vietnam".
Upon a proposal by Director of Foreign Exchange Department and Director of Financial Institutions Department.

DECIDES

Article 1.

To amend the paragraph in Circular No.03/TT-NH5 issued on February 9,1996 as follows:

"a finance leasing company is permitted to buy foreign currencies at the commercial bank nominated by the State Bank of Vietnam as provided by the current regulation on foreign exchange management" as stated in item 1.5 of Section V, Circular No. 03/TT-NH5 issued on February 9,1996 shall be replaced by the following paragraph" a finance leasing company shall buy foreign currencies at commercial banks that are permitted to conduct foreign exchange transactions".

Article 2.

This Decision shall become effective 15 days after the date of signing.

Article 3.

The Director of the Governor's Office, Director of Foreign Exchange Department, Director of Financial Institutions Department, heads of related departments in the State Bank of Vietnam, General Director (director) of commercial banks, Bank of Investment and Development, Joint-venture banks, foreign bank branches operating in Vietnam that are permitted to conduct foreign exchange transactions, General Director (director) of finance leasing companies shall be responsible to implement this Decision.
