DECISION

APPROVAL OF NATIONAL ELECTRONIC COMMERCE DEVELOPMENT MASTER PLAN DURING 2021 - 2025

PRIME MINISTER

Pursuant to Law on Government Organization dated June 19, 2015;

Pursuant to the Law on E-Transactions dated November 29, 2005;

Pursuant to Law on Information Technology dated June 29, 2006;

Pursuant to Law on Commercial dated June 14, 2005;

Pursuant to Decree No.52/2013/ND-CP dated May 16, 2013 of Government on e-commercial;

At request of Minister of Industry and Trade.

HEREBY DECIDES:

Article 1. Approval of national electronic commerce master plan during 2021 – 2025 with following basic objectives and details

A. PRINCIPLES

- E-commerce is one of the leading aspects of the digital economy where advance technologies in the fourth industrial revolution are applied on a wide scale to further increase efficiency of business cycle, modernize distribution systems, enhance competition capacity of enterprises and promote development of domestic market and import.

- National electronic commerce development master plan during 2021 – 2025 complies closely with strategies and policies on active participation in the fourth industrial revolution, digital economic development and national digital conversion orientations.

- Enterprises are the core forces to implement electronic commerce applications while the government manages, establishes infrastructure and facilitates development of electronic commerce.

- Assistance and promotion of electronic commerce shall be implemented by: weighted selection and assistance of specific aspects/provinces of electronic commerce development which will lead and create ripple effects in society.

B. DEVELOPMENT OBJECTIVES

I. GENERAL OBJECTIVES

- Assist and promote wide application of electronic commerce in enterprises and community;

- Reduce the gap between major cities and provinces in terms of development of electronic commerce;

- Develop health, competitive and sustainable electronic commerce environment;

- Expand domestic and foreign consumption markets of Vietnamese products via application of electronic commerce; promote transboundary electronic transaction and commerce;

- Become the country with electronic commerce development among the top 3 countries in South East Asia region.

II. SPECIFIC OBJECTIVES (TO BE ACHIEVED IN 2025)

1. Regarding scale of electronic commerce

a) 55% of the population participates in online shopping with combined value of online products and services reaching USD 600/person/year;

b) B2C online sales (for both online products and consumer services) increase by 25%/year, reach USD 35 billion and account for 10% of total national product retail values and consumer service revenues.

2. Regarding infrastructure of auxiliary services of electronic commerce

a) Non-cash payments in electronic commerce reaches 50% in which payments performed via organizations providing intermediate payment services account for 80%;

b) Average costs for delivery and completion of last-mile delivery account for 10% of product prime cost in electronic commerce;

c) 70% of purchases on electronic commerce website/application are issued with electronic invoices;

d) Develop and operate common database on electronic commerce.

3. Regarding correlation of electronic commercial development among economic zones

a) Provinces other than Hanoi and Ho Chi Minh City account for 50% of national B2C electronic transaction values;

b) 50% of communes and equivalent administrative divisions have traders selling or providing services online.

4. Regarding application of electronic commerce in enterprises

a) 80% of electronic commerce website is integrated with online order placement;

b) 50% of medium and small enterprises operate on electronic commercial platforms, including social networks with similar functions;

c) 40% of enterprises participate in electronic commerce on mobile applications;

d) 70% of power, water, telecommunication and media service providers enter into electronic contracts with users.

5. Regarding human resource development for electronic commerce

a) 50% of higher education institutions and vocational education institutions implement training on electronic commerce;

b) 1,000,000 enterprises, household businesses, regulatory officials and students participate in training on application of electronic commerce.

C. SOLUTIONS

1. Develop mechanisms and policies to satisfy electronic commerce development demand during the fourth industrial revolution

Review, revise, supplement and issue new policies and legislative documents to facilitate, encourage and assist application of electronic commerce and new business models on digital platforms:

a) Continue to improve legal framework, enable enterprises that operate technology platforms to develop electronic commerce models, solutions and services based on application of advance technology, treat traditional business models and technological business models equally;

b) Develop policies on permitting controlled experiments (Sandbox) of new business models, products and services in electronic commerce;

c) Establish mechanisms to promote responsibilities and roles of enterprises that operate technology platforms in electronic commerce in managing transactions made on their platforms;

d) Add business registration number for electronic commerce, develop and organize implementation of regulations on standards in electronic commerce;

dd) Develop and issue regulations on revision and policies on assisting and developing order finalizing services and last-mile delivery for electronic commerce;

e) Develop legislative documents on managing electronic commerce, supplement regulations on management of transboundary electronic commerce to create healthy competitive environment;

g) Develop legislative documents on settling disputes and taking actions against violations in electronic commerce;

h) Issue policies and solutions to encourage enterprises to use electronic invoices in sale and service provision, develop mechanism and enhance effectiveness of tax administration in electronic commerce;

i) Develop and finalize standards regarding information exchange in commercial transaction applied to QR codes, Barcodes, NFC and technologies serving user identification and verification in electronic commerce;

k) Issue policies, regulations and implement solutions to increase electronic payment and mobile payment in electronic transactions and reduce cash use and cash-on-delivery (COD) in electronic commerce;

l) Regularly review legal framework and policies on domestic electronic commerce compared to commitments under FTAs, especially the new generation FTAs. Provide detailed assessment on impacts of international agreements on electronic commerce, data displacement and post-sale consumer protection, etc.

2. Improve management capacity, organize electronic commercial activities and counter trade frauds, infringement of intellectual property rights and unhealthy competition in electronic commerce

a) Develop regulations on inspection and administrative penalties in electronic commerce satisfactory to state management demands and practical situations;

b) Conduct research to develop policies and state management mechanisms on electronic commerce affiliated to Departments of Industry and Trade of provinces;

c) Improve capacity of law enforcement regarding electronic commerce in provinces by organizing classes to enhance knowledge and abilities in electronic commerce, equip modern tools to assist monitor, supervision, settlement of disputes and actions against violations in online electronic commercial activities;

d) Develop interdisciplinary cooperation mechanism and form fast response forces to promptly deal with smuggling, trade frauds, sale of counterfeits or products violating intellectual property rights and unhealthy competition in electronic commerce;

dd) Promote technology application in fights against crime related to electronic commerce, develop information system and common database on electronic commerce among law enforcement forces;

e) Organize annual discussion between regulatory agencies and electronic commercial enterprises to promptly comprehend problems that are to be dealt with;

g) Enhance inventory capacity regarding electronic commerce in national level, product line level and provincial level;

h) Promote online provision of public services related to business and manufacturing activities and application of information technology in public administrative procedures.

3. Solutions for developing markets and raising credibility of consumers in electronic commerce

a) Publicize and provide training on electronic commerce for people and enterprises to raise participating level and utilize electronic commercial applications of enterprises, enhance ability to recognize and respond to negative behaviors in electronic commerce of consumers;

b) Organize annual electronic commerce events to promote domestic market and improve transboundary electronic commercial activities, enable organizations and enterprises to display the latest technologies and advanced electronic commercial models to let consumers experience, develop new electronic commercial habits and skills;

c) Assist enterprises to implement and encourage people and enterprises to adopt guaranteed payment methods in electronic commercial transactions;

d) Develop and implement policies to increase ratio of domestic products on online environment;

dd) Develop systems to authenticate and assess credibility of enterprises and consumers in electronic commerce on a multilateral basis consisting of regulatory agencies, communication, unions, enterprises and consumer protection organizations;

e) Develop policies to settle disputes related to effectiveness of digital technology application, encourage establishment of independent referee systems to settle disputes and participate in regional and international online dispute settlements; 

g) Research and consider application of Online Dispute Resolution (ODR) systems to protect consumer rights in online commerce, promote development of transboundary electronic commerce, especially for small and medium enterprises.

4. Enhance infrastructure systems and auxiliary services of electronic commerce;

a) Develop infrastructure and solutions to assist electronic commerce integrated with commercial payment and public services; develop payment benefits on mobile platforms, electronic purse, QR codes, NFC, POS, etc.; guarantee payment security and safety to promote electronic payment in electronic transactions, including B2C, B2B, G2C, G2B and O2O models;

b) Improve infrastructure of delivery and logistics services of electronic commerce, apply new technologies in logistics operations; encourage pilot implementation and deploy new means of transports to serve transportation and delivery in electronic commerce; encourage integrated solutions to connect logistic enterprises from the first mile to the last mile; properly research transboundary delivery solutions and urban logistic solutions;

c) Develop online management systems for delivery, receipt and order finalization services of electronic commerce in all provinces and cities on a nationwide scale while expanding to the region to promote transboundary electronic commercial activities; issue standard systems for delivery and order finalization services in electronic commerce; develop database on addresses; develop digital map of Vietnam to assist online management of postal, delivery, receipt and order finalization services of national electronic commerce;

d) Develop solutions for sharing infrastructure between electronic commercial service providers and enterprises providing retail services, smart connection and sharing services between enterprises and enterprises, enterprises and consumers, enterprises and governments on mobile platforms, smart cards and big data;

dd) Develop infrastructure for authenticating online contracts and other online certificates serving commercial transactions on information authentication platforms utilizing digital technology including public digital signatures, personal signatures on mobile devices, block-chain storage, etc.;

e) Develop goods searching, tracing and controlling systems on electronic certificate solution platforms in commerce including electronic invoices, electronic stamps, electronic storage output certificates and other commercial certificates;

g) Develop platforms for sharing of identity and authenticating electronically to serve identification and authentication of users in electronic commercial activities.

5. Promote application of electronic commerce to assist primary export business lines, expand consumption of domestic goods and promote development of electronic commerce in provinces

a) Choose some provinces to represent each key economic zone and implement schemes for electronic commercial development assistance according to business lines thereby slowly spreading to other provinces;

b) Research, develop and implement smart supply chains, utilize big data technology to predict the markets and effectively link manufacturing processes with market demands;

c) Develop and assist enterprises to apply digital technological solutions (barcode, QR code, NFC chips, blockchain technology, etc.) to trace origins of products, enable online brand building and product marketing;

d) Establish national product display on major electronic commercial platforms around the world, organize Vietnamese products display where entrusted, highly import substituted, regulatory agency-appraised and origin guaranteed brands on major electronic commercial platforms of Vietnam and around the world are concentrated;

dd) Develop, provide complete solution packs to assist online sale and implement schemes for assisting small and medium enterprises in representative business lines to participate in major domestic and international electronic commercial platforms;

e) Establish electronic supply chain for agricultural products, develop connections between manufacturing enterprises, logistics enterprises and enterprises providing electronic commercial services to minimize expenditure and time for introducing products;

g) Establish models of online centers connecting with provinces to assist distributing products of medium and small enterprises and agriculture households on cyber environment.

6. Develop and apply new technologies in electronic commerce, assist digital conversion of enterprises

a) Develop digital conversion assistance programs in medium and small enterprises, apply digital technologies to renovate business models of enterprises; research, select prioritized fields and majors to develop and apply new technologies in manufacture and business;

b) Implement chain technology applications, develop smart supply chain and logistics; develop products and solutions for applying virtual reality technologies, augmented reality technologies and assist implementation of enterprises;

c) Develop large-scale information systems for each major which are capable of analyzing and integrating on big data basis;

d) Develop and implement systems applying artificial intelligence and machine learning to enable transparency and increase effectiveness of state management;

dd) Advertise, raise awareness, assist training in digital conversion, focus on medium and small enterprises and outdated regions;

e) Perform pilot implementation and step-by-step expand the enterprise models for each sector and major depending on conditions of each province;

g) Develop digital products and solutions and assist enterprises in implementing applications in each phase of business cycles; develop integration services based on advanced technologies and implement on a large scale in medium and small enterprises;

h) Develop, bring into operation and utilize new online integrated bidding systems (following PPP models); connect national bidding network with electronic governmental systems and other electronic commercial systems; continue to develop legal framework regarding online bidding satisfactory to practical conditions and international practices.

D. NATIONAL ELECTRONIC COMMERCIAL DEVELOPMENT PROGRAM

1. National electronic commercial development programs consist of schemes approved on a yearly basis and implemented by Ministry of Industry and Trade and People’s Committees of provinces or central-affiliated cities based on regulations under Annex II attached to this Decision.

2. Participants:

a) Entities taking charge in implementing schemes of the program (hereinafter referred to as “entities in charge”) consist of:

- Central and local regulatory agencies specialized in electronic commerce;

- Vietnam E-commerce Association and industrial associations.

Entities in charge shall receive expenditure to implement schemes of the program and shall be responsible for making settlement as per the law.

b) Beneficiaries of the program are agencies, organizations and enterprises of all economic sectors.

3. Principles of managing and implementing the program:

a) Expenditure on program implementation shall be included in annual expenditure estimates of Ministry of Industry and Trade;

b) Assist beneficiaries via the entities in charge;

c) The entities in charge are responsible for mobilizing funding sources together with supporting budget to implement the schemes;

d) On a yearly basis, based on activities of the program, Ministry of Industry and Trade shall develop plans and estimate expenditure on the program, integrate in annual estimates of Ministry of Industry and Trade, submit to Ministry of Finance and Ministry of Planning and Investment for consolidation and submit to competent authorities according to Law on state budget and relevant law provisions.

DD. EXPENDITURE ON IMPLEMENTATION

1. Funding sources for implementation master plan shall be guaranteed from: state budget, enterprise capital, credit capital from credit institutions, international donation and other legal mobilized capital as per the law.

2. In case of state budget, comply with applicable decentralization of state budget, to be specific:

a) Projects and tasks within expenditure of ministries, ministerial agencies and Governmental agencies shall be funded by central budgets and allocated in annual expenditure budget estimates of agencies;

b) Projects and tasks within expenditure of People’s Committees of provinces and central-affiliated cities shall be guaranteed by local government budget and allocated in annual local budget.

Article 2. Implementation

1. National electronic commercial development master plan shall be organized for implementation in an integrated and synchronized fashion with strategies and plans for development of fields under industry and trade sectors and economic sectors, especially export, distribution and other services; strategies, plans, schemes and programs for development and application of information technology and communication; administrative reform programs and information technology application in operations of regulatory authorities.

2. Ministry of Industry and Trade:

a) Take charge and cooperate with ministries, ministerial agencies, Governmental agencies and People’s Committees of provinces and central-affiliated cities in organizing implementation of this Decision, on a yearly basis, consolidate information on implementation and propose measures to Prime Minister for implementation, conclude implementation results in the concluding year of the master plan;

b) Consolidate, approve, implement and monitor implementation of schemes under the national electronic commercial development program; take charge and cooperate with ministries and People’s Committees of provinces or central-affiliated cities in managing, guiding, examining and supervising implementation of the national electronic commercial development program.

3. Ministry of Finance and Ministry of Planning and Investment:

a) Allocate annual expenditure on implementation of activities of the national electronic commercial development program according to regulations and law on state budget;

b) Cooperate with Ministry of Industry and Trade in guiding, examining and monitoring implementation of the program.

4. Based on this master plan, ministries, ministerial agencies and Governmental agencies are responsible for:

a) developing and organizing appraisal, approval and allocation of budget based on applicable decentralization to implement activities of the master plan according to progress specified under attached Annex;

b) examining, assessing and producing reports on a yearly and irregular basis on implementation of the master plan following guidance and demands of Ministry of Industry and Trade for consolidation and report to Prime Minister.

5. People’s Committees of provinces or central-affiliated cities:

a) based on application of electronic commerce in provinces and cities, People’s Committees of provinces and central-affiliated cities shall develop electronic commercial development plan during 2021 – 2025 for their provinces or cities, approve and allocate budget for implementation;

b) developing and organizing appraisal, approval and allocation of budget based on applicable decentralization to implement activities of local electrical commercial development;

c) organizing and mobilizing counterpart funds to implement schemes for electronic commercial development from central government budget based on national electronic commercial development program;

d) on a yearly basis, reporting to Ministry of Industry and Trade on local implementation of the master plan.

6. Regulatory agencies specialized in electronic commerce in provinces, cities, Vietnam E-commerce Association and industrial associations:

a) developing and organizing implementation of annual schemes for electronic commercial development based on the national electronic commercial development program under Annex II attached to this Decision;

b) Cooperate with Ministry of Industry and Trade in popularizing, guiding, examining and monitoring beneficiaries of the program.

Article 3. This Decision comes into effect from the date of signing.

Article 4. Ministers, heads of ministerial agencies, heads of Governmental agencies, Chairpersons of People’s Committees of provinces and central-affiliated cities are responsible for implementing this Decision./.
