DECREE

ON REQUIREMENTS AND PROCEDURES FOR OPENING AND CLOSING DEDICATED AERODROMES

Pursuant to the Law on Government Organization dated June 19, 2015;

Pursuant to the Law on Vietnam civil aviation dated June 29, 2006 and the Law on Amendments to certain articles of the Law on Vietnam civil aviation dated November 21, 2014;

Pursuant to the Law on National defense dated June 14, 2005;

Pursuant to the Land Law dated November 29, 2013;

Pursuant to the Law on Construction dated June 18, 2014;

At the request of the Minister of National Defense;

The Government promulgates a Decree on requirements and procedures for opening and closing dedicated aerodromes.

Chapter I

GENERAL PROVISIONS

Article 1. Scope

This Decree deals with requirements and procedures for opening and closing dedicated aerodromes.

Article 2. Regulated entities

Vietnamese and foreign entities involving in opening and closing dedicated aerodromes in Vietnam.

Article 3. Definitions

For the purposes of this Decree, the terms below shall be construed as follows:

1. “dedicated aerodrome” is an area of flat ground, open water or construction works serving the operation of aircrafts, seaplanes and helicopters for the purposes of general aviation operation or carriage of passengers, baggage, cargo and parcels other than public carriage.

2. “dedicated aircraft” may be a helicopter, seaplane, small aircraft with flat wings or drone using the land or water runway.

3. “takeoff and landing field” is an area prepared on flat ground, water surface or construction works designated for taking off and landing of dedicated aircrafts.

4. “runway” is a defined area on a land or open water aerodrome prepared for the takeoff and landing of aircrafts.

5. “taxiway” is a hard path connecting facilities of the maneuvering area and on which the aircraft moves or is towed.

6. “apron” is a defined area of the aerodrome, flat ground, open water or construction works where aircrafts are parked to serve passenger embarkation/disembarkation, material handling, refueling, ramp services or preparation for the next flights.

7. “maneuvering area” includes airstrips and aprons prepared for the aircraft to takes off, lands and taxies.

8. “airstrip” is the main facility of the maneuvering area including material/land/water runways having coordinates and boundaries determined for takeoff and landing of aircrafts and seaplanes; and runway end safety areas.

9. “Aerodrome Reference Point (ARP)” is a centre point of the aerodrome determined according to VN2000 or WGS-84 coordinate system (longitude, latitude, minute and second).

10. “dedicated aerodrome infrastructure” may include all systems of runway, taxiway, apron, parking lot and water surface strip prepared for takeoff and landing of the aircraft; runway end safety areas and other auxiliary works of the aerodrome; fences and buoys to mark boundaries and aerodrome roads; terminals, warehouses, aerodrome control tower, stations and hangar serving flight operations; fuel supply, power supply, water supply and drainage serving fire safety at the aerodrome.

11. “adjacent area” is a land area around the dedicated aerodrome or water surface strip or construction work in which the height of airway obstacles is regulated to ensure aviation safety.

12. "obstacle clearance height (OCH)” is the lowest height above the elevation of the relevant runway threshold or the aerodrome elevation as applicable, used in establishing compliance with appropriate obstacle clearance criteria.

13. “true altitude” means the height of an aircraft above mean sea level. 

14. “elevation” is the lowest altitude that is compulsorily selected in construction suited to the altitude above mean sea level.

15. “dedicated aerodrome owner” is an entity that invests in, acquires or receives the property on land/water surface/construction work in order to build, manage and operate the dedicated aerodrome.

16. “dedicated aerodrome operator” is an entity that is entitled to open or close the dedicated aerodrome/takeoff and landing field after getting a written approval from a competent state authority.

17. “consulting unit" is an unit having necessary qualifications for carrying out design, inspections, testing and management of a project, construction supervision and other consulting tasks related to the dedicated aerodrome.

18. “written approval for opening/closing of the dedicated aerodrome” is a legal document that a competent state authority issues to the dedicated aerodrome owner to build, repair, renovate, open or close the dedicated aerodrome.

Article 4. Basic rules for opening and closing dedicated aerodromes

1. Ensure the compliance of national interests with community interests; fulfill duties related to national security, sovereignty, socio-economic development and international integration.

2. Develop the dedicated aerodrome system in line with the development planning of aviation industry, each region and province.

3. Ensure aviation safety; social orders; national security and socio-economic development; environmental safety and reduce influence on the community; ensure the synchronization and safety of architecture space, social and technical infrastructure systems.

4. Facilitate the management, use and operation of dedicated aerodromes and organization of aviation activities carried by authorities or entities.

5. Promote the close and effective cooperation in state management between law enforcement forces of the Ministry of National Defense and the Ministry of Transport, in opening and closing dedicated aerodromes, management of activities and assurance of safety and flight forecasting and flight information between local authorities and entities.

6. Satisfy technical regulations and standards applying to dedicated aerodromes issued or recognized by competent state authorities.

Article 5. Classification of dedicated aerodromes

According to characteristics of structures and locations, dedicated aerodromes shall be classified into:

1. Land dedicated aerodrome;

2. Water dedicated aerodrome;

3. Land takeoff and landing field;

4. Water takeoff and landing field;

5. Takeoff and landing field on the construction work, such as: a building, deck, rig or petroleum drilling rig.

Chapter II

MANAGEMENT OF DEDICATED AERODROMES

Article 6. Construction management of dedicated aerodromes

1. The Minister of National Defense shall make decisions on approval for locations for construction of dedicated aerodromes after getting approval from the Ministry of Construction, the Ministry of Transport and People’s Committees of provinces where such dedicated aerodromes are built.

2. The Chief of the General Staff shall make decisions on approval for detailed construction designs of dedicated aerodromes after reaching agreements with the Ministry of Transport.

3. Local authorities when setting up construction projects that affect dedicated aerodromes (if any) shall reach written agreements on effect of obstacles with the Ministry of National Defense and the Ministry of Transport.

Article 7. Approval contents of dedicated aerodrome locations

1. Determination of the foundation and operation requirements for dedicated aerodromes, assurance of national security and contribution to the socio-economic development.

2. Determination of the location of each dedicated aerodrome including type, role, position and scale; forecast of estimated flight schedules; demand for use of land and water surface; and estimate of investments.

3. The drawing scale of the location of each dedicated aerodrome shall be 1/2000.

Article 8. Approval contents of dedicated aerodrome construction designs

1. The demand for using land, water surface or premises of construction works to build dedicated aerodromes.

2. Locations and geographic coordinates of land or water dedicated aerodromes and arrangement of the system of auxiliary works for dedicated aerodromes.

3. Preparation for takeoff and landing directions of dedicated aerodromes and marshalling equipment.

4. Determination of Obstacle Limitation Surface (OLS) maps in aviation.

5. Internal road systems of and connection routes with dedicated aerodromes.

6. Water supply and drainage, power supply, emergency exit, fire safety and warning systems in aviation (if any).

7. Standard instrument departure (SID) and standard terminal arrival (STAR) for aircrafts.

8. Estimate of investments and execution schedules.

9. The detailed drawing scale of each dedicated aerodrome shall be 1/500.

Article 9. Management of boundary markers and boundaries of dedicated aerodromes

Dedicated aerodrome owners shall cooperate with relevant authorities affiliated to the Ministry of National Defense and People’s Committees of provinces in managing and protecting boundary markers and boundaries of such aerodromes; and promptly report competent authorities to take actions against problems in order to ensure aviation safety.

Chapter III

OPENING AND CLOSING DEDICATED AERODROMES

Article 10. Requirements for opening and closing dedicated aerodromes

1. Requirements for opening the dedicated aerodrome:

a) The aerodrome shall ensure the strategies for national security and socio-economic development;

b) The aerodrome shall be suitable for the development planning of transport and social and urban infrastructure;

c) The personnel shall have necessary technical qualifications to operate the dedicated aerodrome;

d) The aerodrome shall comply with regulations of law on management of OCH, land, environment, water surface, sea surface, airspace, prohibited areas and restricted areas;

dd) The aerodrome owner shall have the certificate and the registration certificate of eligibility for dedicated aerodrome operations for the aerodrome required to be open to operate regular commercial flights.

2. The dedicated aerodrome shall be permanently closed if:

a) The operation of the dedicated aerodrome affects the national security/sovereignty/interests, aviation or environmental safety or violates against other regulations of law;

b) The dedicated aerodrome expires or poses risks that may affect flight safety;

c) The dedicated aerodrome is no longer suitable for the overall urban planning, regional, aviation or local planning; affects boundaries or development orientation of space, destroy corridors to protect national security works and areas to protect other construction works;

d) The dedicated aerodrome is built not in line with the detailed construction design or fails to satisfy technical standards applying to selected construction works;

dd) There is an emergency of using land or water surface to support the national security and urban space development; construction of economic or political centers in accordance with local socio-economic development planning or the dedicated aerodrome has been replaced by another that brings higher value to the national security, economy or society; or the dedicated aerodrome is used for the wrong purposes or affects legal activities of public or common areas; or

e) The closing is requested by the dedicated aerodrome owner.

3. The dedicated aerodrome shall be temporarily closed if:

a) The national security is required to ensure, special causes affect the economy or society or incidents affect flight safety and aviation security;

b) The upgrading, expansion or repair of the dedicated aerodrome may affect the flight safety;

c) The dedicated aerodrome owner or operator violates against regulations on the national sovereignty or security that leads to the closing of flight operations for investigation;

d) Natural disasters, epidemic, environmental pollution, aircraft accidents or other abnormal circumstances threaten flight safety and aviation security;

dd) The dedicated aerodrome ceases operation for 6 consecutive months;

e) The closing is requested by the dedicated aerodrome owner.

4. The dedicated aerodrome shall be re-opened as soon as the cases mentioned in Clause 3 this Article end.

Article 11. Procedures for opening land or water dedicated aerodromes

1. An application for opening the land or water dedicated aerodrome includes:

a) A completed application form provided in the specimen No. 1 of the Appendix attached hereto;

b) The site plan of the aerodrome and the maneuvering area specifying the elevation, ARP, dimensions, basic directions of runways, taxiways, aprons and other construction works of the dedicated aerodrome infrastructure; and boundaries of the land area used for building the aerodrome;

c) The notes describing the operation airspace of the aerodrome; SID/STAR; aviation routes passing through the aerodrome within the radius of 30 km from the ARP;

d) The drawing of OLS showing clearly the longitudinal section and cross-section of the OCH; location and height of all obstacles in the adjacent area within the radius of 10 km from the ARP;

dd) The notes describing the method of management, operation and assurance of aviation security, environmental safety, organization of flight operations and codeshare agreements on flight information;

e) A certified true copy of each of the following documents: the certificate of land use rights, house ownership and other property on land; the certificate of management and use of inland/coastal/offshore water surface issued by the local authority; the investment registration certificate and the enterprise registration certificate.

2. Procedures for opening the dedicated aerodrome:

a) An applicant for opening the land/water dedicated aerodrome shall send 1 set of application mentioned in Clause 1 this Article by post to the General Staff in accordance with the address stated in Article 19 herein;

b) Within 15 working days from the day on which the application stated in Clause 1 this Article is received, the General Staff shall inspect the application and send each enquiry form to the Ministry of Transport and the People’s Committee of the province where the land/water dedicated aerodrome is located;

If the application is invalid, the General Staff shall give the applicant a written notification of additional documents within 5 working days from the day on which the application is received;

c) Within 10 working days from the date of receiving enquiry forms from the General Staff, the Ministry of Transport and the People’s Committee of province shall make responses to the General Staff;

d) Within 15 working days from the date of receiving responses from the Ministry of Transport and the People’s Committee of province, the General Staff shall grant a written approval for opening of the land/water dedicated aerodrome;

If the application is rejected, the General Staff shall provide the applicant with a written explanation.

Article 12. Procedures for permanent closing of land or water dedicated aerodromes

1. The land/water dedicated aerodrome owner (applicant) shall complete the application form provided in the specimen No. 2 of the Appendix attached hereto.

2. Procedures for permanent closing of the dedicated aerodrome:

a) The applicant shall send 1 set of application mentioned in Clause 1 this Article by post to the General Staff in accordance with the address stated in Article 19 herein;

b) If the application is invalid, the General Staff shall give the applicant a written notification of additional documents within 5 working days from the day on which the application is received;

c) Within 10 working days from the day on which the valid application is received, the General Staff shall make a decision on permanent closing of the land/water dedicated aerodrome after reaching an agreement with the Ministry of Transport and informing the applicant and relevant authorities and entities.

3. When the operation of the aerodrome violates any of the cases specified in Points a, b, c, d and dd Clause 2 Article 10, the General Staff shall make the decision on permanent closing of the dedicated aerodrome and the takeoff and landing field and make reports on such violation to the Ministry of Transport and relevant authorities and entities.

Article 13. Procedures for opening takeoff and landing fields on flat ground, open water or construction works

1. An application for opening the takeoff and landing field includes:

a) A completed application form provided in the specimen No. 3 of the Appendix attached hereto;

b) Site plans of the takeoff and landing field’s location; total space of the land area and construction work; detailed space of the takeoff and landing field specifying the elevation, ARP, basic dimensions of the field; location of the field on the construction work; basic directions of takeoff/landing; the site plan of boundaries of the land area or water surface for the land/water takeoff and landing field;

c) The notes describing the operation airspace of the takeoff and landing field; SID/STAR, organization of flight operations and codeshare agreements on flight information;

d) The drawing of OLS showing clearly the longitudinal section and cross-section of the OCH; location and height of all obstacles in the adjacent area within the radius of 3 km from the takeoff and landing field reference point;

dd) The notes describing the method of management, operation and assurance of aviation security and environmental safety;

e) A certified true copy of each of the following documents: the certificate of land use rights, house ownership and other property on land; the license for construction and establishment of the work which the takeoff and landing field is set up on granted by a competent state authority; the investment registration certificate and the enterprise registration certificate.

2. Procedures for opening the takeoff and landing field:

a) An applicant for opening the takeoff and landing field shall send 1 set of application mentioned in Clause 1 this Article by post to the General Staff in accordance with the address stated in Article 19 herein;

b) Within 15 working days from the day on which the application stated in Clause 1 this Article is received, the General Staff shall inspect the application and send each enquiry form to the Ministry of Transport and the People’s Committee of the province where the takeoff and landing field is located;

If the application is invalid, the General Staff shall give the applicant a written notification of additional documents within 5 working days from the day on which the application is received;

c) Within 10 working days from the date of receiving enquiry forms from the General Staff, the Ministry of Transport and the People’s Committee of province shall make responses to the General Staff;

d) Within 15 working days from the date of receiving responses from the Ministry of Transport and the People’s Committee of province, the General Staff shall grant a written approval for opening of the takeoff and landing field;

If the application is rejected, the General Staff shall provide the applicant with a written explanation.

Article 14. Procedures for permanent closing of takeoff and landing fields on flat ground, open water or construction works

1. The takeoff and landing field owner (applicant) shall complete the application form provided in the specimen No. 4 of the Appendix attached hereto.

2. Procedures for permanent closing of the takeoff and landing field:

a) The applicant shall send 1 set of application mentioned in Clause 1 this Article by post to the General Staff in accordance with the address stated in Article 19 herein;

b) If the application is invalid, the General Staff shall give the applicant a written notification of additional documents within 5 working days from the day on which the application is received;

c) Within 10 working days from the day on which the valid application is received, the General Staff shall make a decision on permanent closing of the takeoff and landing field after reaching an agreement with the Ministry of Transport and informing the applicant and relevant authorities and entities.

3. When the operation of the takeoff and landing field violates any of the cases specified in Points a, b, c, d and dd Clause 2 Article 10, the General Staff shall make the decision on permanent closing of the takeoff and landing field and make reports on such violation to the Ministry of Transport and relevant authorities and entities.

Article 15. Procedures for opening takeoff and landing fields on decks

1. An application for opening the takeoff and landing field on deck includes:

a) A completed application form provided in the specimen No. 5 of the Appendix attached hereto;

b) Drawings of longitudinal section and cross-section showing height of systems and equipment on deck, space and dimensions of the deck, dimensions of the takeoff and landing field on deck and adjacent components;

c) The notes describing the method of management and operation of helicopters and assurance of fire safety, organization of flight operations and codeshare agreements on flight information;

2. Procedures for opening the takeoff and landing field on deck:

a) An applicant for opening the takeoff and landing field on deck shall send 1 set of application mentioned in Clause 1 this Article by post to the General Staff in accordance with the address stated in Article 19 herein;

b) Within 15 working days from the day on which the application stated in Clause 1 this Article is received, the General Staff shall inspect the application and send an enquiry form to the Ministry of Transport.

If the application is invalid, the General Staff shall give the applicant a written notification of additional documents within 5 working days from the day on which the application is received;

c) Within 10 working days from the date of receiving enquiry forms from the General Staff, the Ministry of Transport and relevant law enforcement forces shall make responses to the General Staff;

d) Within 15 working days from the date of receiving responses from the Ministry of Transport and relevant law enforcement forces, the General Staff shall grant a written approval for opening of the takeoff and landing field;

If the application is rejected, the General Staff shall provide the applicant with a written explanation.

Article 16. Procedures for permanent closing of takeoff and landing fields on decks

1. The takeoff and landing field owner (applicant) shall complete the application form provided in the specimen No. 6 of the Appendix attached hereto.

2. Procedures for permanent closing of the takeoff and landing field on deck:

a) The applicant shall send 1 set of application mentioned in Clause 1 this Article by post to the General Staff in accordance with the address stated in Article 19 herein;

b) If the application is invalid, the General Staff shall give the applicant a written notification of additional documents within 5 working days from the day on which the application is received;

c) Within 10 working days from the day on which the valid application is received, the General Staff shall make a decision on permanent closing of the takeoff and landing field after reaching an agreement with the Ministry of Transport and informing the applicant and relevant authorities and entities.

3. When the operation of the takeoff and landing field violates any of the cases specified in Points a, b, c, d and dd Clause 2 Article 10, the General Staff shall make the decision on permanent closing of the takeoff and landing field and report such violation to the Ministry of Transport, the applicant and relevant authorities and entities.

Article 17. Procedures for temporary closing of dedicated aerodromes

1. The dedicated aerodrome owner (applicant) shall complete the application form provided in the specimen No. 7 of the Appendix attached hereto.

2. Procedures for temporary closing of the dedicated aerodrome:

a) The applicant shall send 1 set of application mentioned in Clause 1 this Article by post to the General Staff in accordance with the address stated in Article 19 herein;

b) If the application is invalid, the General Staff shall give the applicant a written notification of additional documents within 5 working days from the day on which the application is received;

c) Within 10 working days from the day on which the valid application is received, the General Staff shall make a decision on temporary closing of the dedicated aerodrome after reaching an agreement with the Ministry of Transport and informing the applicant and relevant authorities and entities.

3. When the operation of the dedicated aerodrome violates any of the cases specified in Points a, b, c, d and dd Clause 3 Article 10, the General Staff shall make the decision on temporary closing of the dedicated aerodrome.

Article 18. Procedures for reopening dedicated aerodromes

1. An application for reopening the dedicated aerodrome includes:

a) A completed application form provided in the specimen No. 8 of the Appendix attached hereto;

b) The documents licensed by a competent state authority responsible for temporary closing of the dedicated aerodrome.

2. Procedures for reopening the dedicated aerodrome:

a) An applicant for reopening the dedicated aerodrome shall send 1 set of application mentioned in Clause 1 this Article by post to the General Staff in accordance with the address stated in Article 19 herein;

b) Within 15 working days from the day on which the application stated in Clause 1 this Article is received, the General Staff shall inspect the application and send each enquiry form to the Ministry of Transport and the People’s Committee of the province where the land/water dedicated aerodrome is located;

If the application is invalid, the General Staff shall give the applicant a written notification of additional documents within 5 working days from the day on which the application is received;

c) Within 10 working days from the date of receiving enquiry forms from the General Staff, the Ministry of Transport and the People’s Committee of province shall make responses to the General Staff;

d) Within 15 working days from the date of receiving responses from the Ministry of Transport and the People’s Committee of province, the General Staff shall grant a written approval for reopening of the dedicated aerodrome;

If the application is rejected, the General Staff shall provide the applicant with a written explanation.

Article 19. Application-receiving authority

The Department of Operations affiliated to the General Staff shall receive applications and inspect the validity of such applications before transferring them to competent authorities.

Chapter IV

RESPONSIBILITIES OF MINISTRIES, LOCAL AUTHORITIES AND RELEVANT ENTITIES

Article 20. Responsibilities of the Ministry of National Defense

1. Take charge and cooperate with the Ministry of Transport, relevant ministries, authorities and People’s Committees of provinces in ensuring the consistency of the management and organization of dedicated aerodrome operations in line with the overall planning such as arranging the national security in accordance with socio-economic development and development of aviation, military, regions, local authorities and economic-defense zones.

2. Manage the information system of dedicated aerodromes, assign duties of law enforcement forces affiliated to the Ministry of National Defense, Military Commands of provinces; and manage opening, closing and reopening of dedicated aerodromes.

3. Take charge, foster and cooperate with ministries and local authorities in providing guidelines for inspection, supervision, taking preventive and remedial measures for violations against regulations of law on opening, closing and operating dedicated aerodromes.

4. Promulgate technical standards on development and management of infrastructure, technical and environmental safety; direct the inspection of ensuring technical regulations and standards of dedicated aerodromes.

5. Requisition dedicated aerodromes in accordance with regulations of law in case of emergencies for the purposes of national security or interests or preparedness to natural disasters.

Article 21. Responsibilities of the Ministry of Transport

1. Take charge and cooperate with the Ministry of National Defense in complying with regulations of law on general aviation operations; providing guidance on ensuring security of dedicated aerodromes; conforming to regulations on the cooperation in carrying out inspection and supervision of dedicated aerodrome operations.

2. Cooperate with the Ministry of National Defense and People’s Committees of provinces in managing, operating, opening, permanently/temporarily closing and reopening dedicated aerodromes.

3. Cooperate with the Ministry of National Defense and People’s Committees of provinces in managing, taking preventive and remedial measures for dedicated aerodrome operations affecting national security or socio-economic development.

4. Cooperate with the Ministry of National Defense in requisitioning dedicated aerodromes in accordance with regulations of law in case of emergencies for the purposes of national security or interests or preparedness to natural disasters.

Article 22. Responsibilities of People’s Committees of provinces/central-affiliated cities

1. Cooperate with the Ministry of National Defense in complying with regulations of law on opening, closing and reopening dedicated aerodromes; managing, detecting, taking preventive and remedial measures for dedicated aerodrome operations affecting national security, socio-economic development in their provinces/central-affiliated cities.

2. Cooperate with the Ministry of National Defense in requisitioning dedicated aerodromes in accordance with regulations of law in case of emergencies for the purposes of national security or interests or preparedness to natural disasters.

3. Cooperate with the Ministry of National Defense in managing airspace, flights and dedicated aerodromes and ensuring social security.

Article 23. Responsibilities of relevant entities

1. Develop, manage and operate dedicated aerodromes in line with technical requirements and standards of locations, operation and use off dedicated aerodromes; facilitate inspections of dedicated aerodrome operations carried out by competent state authorities; ensure requirements for aviation security, fire and environmental safety and social security.

2. Comply with regulations on management, operation and use of dedicated aerodromes in order not to violate national security, interests and sovereignty, social security or not to commit violations against regulations of law.

3. Abide by regulations of law on opening and closing dedicated aerodromes and requisition thereof.

Chapter V

IMPLEMENTATION PROVISIONS

Article 24. Funding

Funding for determination of locations and approval for detailed construction designs of dedicated aerodromes shall be provided by the state budget, domestic and foreign sponsors or other legal funds.

Article 25. Actions against violations

Entities committing violations against regulations on management or operation of dedicated aerodromes or failing to fulfill their responsibilities mentioned in this Decree and relevant legal documents shall be imposed disciplinary or administrative penalties or criminal prosecution depending on nature and extent of such violations.

Article 26. Effect

This Decree comes into force from July 01, 2016.

Article 27. Implementation

Ministers, heads of ministerial and governmental authorities, Chairpersons of People’s Committees of provinces/central-affiliated cities and relevant domestic and foreign entities shall implement this Decree.
