DECREE
ON THE LAND PRICE BRACKET
Pursuant to the December 25, 2001 Law on Organization of Government;
Pursuant to the November 29, 2013 Land Law;
At the proposal of the Minister of Natural Resources and Environment,
The Government promulgates the Decree on the land price bracket.
Article 1. Scope of regulation
This Decree provides the price bracket for each type of land in each region as prescribed in Article 113 of the Land Law.
Article 2. Subjects of application
1. Agencies performing the state management of land; agencies with functions to set, adjust and appraise the land price bracket and land price tables.
2. Organizations licensed to provide land pricing consultancy, persons licensed to practice land pricing consultancy.
3. Other related organizations and persons.
Article 3. Land price bracket
1. Agricultural land:
a/ Price bracket of land for cultivation of annual crops including land for cultivation of rice and other annual crops-Appendix I;
b/ Price bracket of land for cultivation of perennial trees-Appendix II;
c/ Price bracket of land for production forests-Appendix III;
d/ Price bracket of land for aquaculture-Appendix IV;
dd/ Price bracket of land for salt production-Appendix V.
2. Non-agricultural land:
a/ Price bracket of residential land in rural areas-Appendix VI;
b/ Price bracket of commercial and service land in rural areas-Appendix VII;
c/ Price bracket of land for non-agricultural production and business other than commercial and service land in rural areas-Appendix VIII;
d/ Price bracket of residential land in urban areas-Appendix IX;
dd/ Price bracket of commercial and service land in urban areas- Appendix X;
e/ Price bracket of land for non-agricultural production and business other than commercial and service land in urban areas-Appendix XI.
Article 4. Economic regions for setting the land price bracket
Economic regions for setting land price bracket include:
1. The northern midlands and mountainous region, comprising Dien Bien, Lai Chau, Son La, Hoa Binh, Ha Giang, Tuyen Quang, Cao Bang, Bac Kan, Lao Cai, Yen Bai, Phu Tho, Lang Son, Thai Nguyen, Bac Giang and Quang Ninh provinces.
2. The Red River delta region, comprising provinces and centrally run cities of Vinh Phuc, Bac Ninh, Hanoi, Hai Phong, Hai Duong, Hung Yen, Ha Nam, Nam Dinh, Thai Binh and Ninh Binh.
3. The north central region, comprising Thanh Hoa, Nghe An, Ha Tinh, Quang Binh, Quang Tri and Thua Thien-Hue provinces.
4. The south central coast region, comprising provinces and centrally run cities of Da Nang, Quang Nam, Quang Ngai, Binh Dinh, Phu Yen, Khanh Hoa, Ninh Thuan and Binh Thuan.
5. The Central Highlands region, comprising Kon Tum, Gia Lai, Dak Nong, Dak Lak and Lam Dong provinces.
6. The southeastern region, comprising Dong Nai, Binh Duong, Binh Phuoc, Ba Ria-Vung Tau and Tay Ninh provinces and Ho Chi Minh City.
7. The Mekong River delta region, comprising provinces and centrally run cities of Long An, Tien Giang, Ben Tre, Dong Thap, Vinh Long, Tra Vinh, Can Tho, Hau Giang, Soc Trang, An Giang, Kien Giang, Bac Lieu and Ca Mau.
Article 5. Application of the land price bracket
The land price bracket is used as a basis for provincial-level People’s Committees to set and adjust local land price tables. Land prices in land price tables and adjusted land price tables must comply with Point a, Clause 3, Article 11 of the Government’s Decree No. 44/2014/ND-CP of May 15, 2014, detailing land prices (below referred to as Decree No. 44/2014/ND-CP).
Article 6. Implementation responsibility
1. The Ministry of Natural Resources and Environment shall:
a/ Direct, guide and examine the application of the land price bracket provided in this Decree when provincial-level People’s Committees set and adjust local land price tables;
b/ Organize the adjustment of the land price bracket in accordance with the Land Law and Decree No. 44/2014/ND-CP.
2. The Ministry of Finance shall appraise the elaboration and adjustment of the land price bracket in accordance with law.
3. Other ministries and sectors shall, within their assigned functions and tasks, cooperate with the Ministry of Natural Resources and Environment in guiding and examining the application of the land price bracket.
4. Provincial-level People’s Committees shall organize the elaboration and promulgation of local land price tables and adjusted land price tables, based on the land price bracket provided in this Decree.
Article 7. Effect
1. This Decree takes effect on December 29, 2014.
2. Ministers, heads of ministerial-level agencies and government- attached agencies, chairpersons of provincial-level People’s Committees, and related organizations and persons shall implement this Decree.-
