DECREE

PROVIDING FOR OFFICIAL UNITS OF MEASUREMENT

THE GOVERNMENT

Pursuant to the Law on Government organization dated December 25, 2001;

Pursuant to the Ordinance on Measurement dated October 06, 1999;

At the request of the Minister of Science and Technology,

DECREES:

Chapter 1:

GENERAL PROVISIONS

Article 1. Scope of regulation

This Decree providing official measurement units regulated by the Socialist Republic of Vietnam.

Article 2. Interpretation of terms

In this Decree, these terms can be construed as follows:

1. The SI system is the international system of units (in French: Le Système International d'Unités; in English: The International System of Units).

2. Official measurement units are the units specified in Article 7 and Article 8 of this Decree.

3. Other common measurement units are the units that are not mentioned in clause 2 of this Article, including traditional units and other measurement units.

Article 3. Rules for the use of measurement units

1. Official measurement units are compulsory in these following cases:

a) In the documents promulgated by a regulatory agency, except for the application of International Agreement as prescribed in Article 5 of this Decree; 

b) On the measurement instruments used for the examination, inspection and other public services;

c) On the labels of quantitatively prepackaged products subject to examination according to the regulations in the Ordinance on Measurement;

d) In the manufacture, trade, import of measurement instruments subject to examination according to the Ordinance on Measurement.

2. Other common measurement units may be used in the activities other than the cases specified in clause 1 of this Article.

The conversion from a common measurement unit into an official measurement unit is expressed according to Article 4 of this Decree.

3. The state shall encourage organizations and individuals to use the official measurement units according to the regulations in this Decree.

Article 4. The conversion from the common units into the official measurement units

1. The conversion shall not lead to any change in the value of quantity.

2. The conversions from other common measurement units into official measurement units are regulated in Annex I enclosed herewith.

If a conversion from a common measurement unit into an official measurement unit is not specified in Annex I of this Decree, then the equivalent of the traditional measurement units shall be used in accordance with the Encyclopaedic Dictionary of Vietnam, the equivalent of other common measurement shall be in accordance with The International System of Units (SI) – 8th edition, 2006 by the Bureau International des Poids et Mesures (BIPM).

3. When expressing the values, the common quantities, values and units shall go after the official ones and shall be put in the brackets. 

Ex: One (01) tael of gold shall be expressed as follow: 37,5 g (1 tael).

Article 5. The application of the International Agreement

If the Socialist Republic of Vietnam accedes an International Agreement on measurement units whose regulation is different from this Circular, such International Agreement shall prevail.

Article 6. The expression of official measurement units

The expression of measurement results, the conversion from a common measurement unit into an official measurement unit shall be in accordance with the regulation in Annex II enclosed herewith.

Chapter 2:

c) Compound prefix names or symbols are not permitted for the formation of decimal multiples or submultiples of an official SI unit.

Ex: nanometer: 1 nm or 10-9 m, not: millimicrometre: mµm.

Where nano is name; n is its symbol and 10-9 is its multiplying factor.

Note: This rule does not apply to the kilogram.  For historical reasons, the name “kilogram” contains the prefix name “kilo” to the name “gram”. Thus, decimal multiples and submultiples of the kilogram are formed by attaching the SI prefixes for gram.

Article 8. The measurement units outside the SI (non-SI units)

The measurement units outside the SI include:

Chapter 3:

RESPONSIBILITIES OF REGULATORY AGENCIES, ORGANIZATIONS AND INDIVIDUALS

Article 9. Responsibilities of the Ministry of Science and Technology

1. The Ministry of Science and Technology has a responsibility towards the Government for the consistency of the management in the official measurement units according to the regulations in this Decree.

2. The Ministry of Science and Technology shall take lead, cooperate with relevant Ministries and regulatory bodies in:

a) Organizing the implementation of the regulations on measurement units in this Decree;

b) Conducting scientific researches, trainings, international cooperation relating to the official measurement units; informing, propagating the knowledge relating to the application of official measurement units regulated in this Decree;

c) Inspecting, examining the implementation of the regulation on the official measurement units in this Decree;

d) Taking lead, cooperating with the Ministry of Finance in the management of budget and the investment in technical ability and facilities of national measurement system.

Article 10. Responsibilities of Ministries and regulatory bodies

1. Comply with the regulation on the official measurement units prescribed in this Decree when making legislative documents.

2. Monitor, provide guidance and conduct the examination on the use of measurement instruments, the expression of measurement results that are expressed in accordance with the measurement units in the activities under the management of Ministries and regulatory bodies according to the regulation on measurement units prescribed in this Decree.

3. Take lead, cooperating with the Ministry of Finance and the Ministry of Science and Technology in the management of budget, the investment in technical ability and facilities of national measurement system.

Article 11. Responsibilities of People’s Committees of provinces

1. Comply with the regulation on the official measurement units prescribed in this Decree when making legislative and administrative documents.

2. Within their functions and competence, People’s Committees of provinces shall:

a) Provide monitor and guidance for local regulatory agencies, organizations and individuals on the implementation of the regulation on the official measurement units according to the regulations in this Decree.

b) Conduct the inspection and examination in the administrative division on the implementation of the regulations on official measurement units according to the regulations in this Decree

3. Manage the budget; invest in technical ability and facilities of national measurement system under the authority.

Article 12. Responsibilities of organizations and individuals

1. Organizations and individuals shall implement the regulations on official measurement units in this Decree in the use of measurement instruments, the expression of measurement results that are expressed in accordance with the measurement units in the manufacture, trade and import of measurement instruments subject to evaluation, in the production of the labels of quantitatively prepackaged products subject to examination according to the regulation in the Ordinance on Measurement.

2. With regard to foreign organization/individual importing goods from Vietnam, if the requirements for measurement noted in the contract are different from the regulation in this Decree and comply with the regulations of the importing countries as well as the regulations of Vietnam and such organization/individual takes responsibility for the requirements, then the contract may be carried out.

Article 4:

IMPLEMENTATION

Article 13. Effect

1. This Decree takes effect since the 16th day after the day on which it is placed on the official gazette. This Decree replaces the Decree No. 65/2001/NĐ-CP dated September 28, 2001 by the Government on the official measurement units of the Socialist Republic of Vietnam .

2. The products and measurement instruments containing other common measurement units that are written or carved exist before the day on which this Decree takes effect may be kept using for the cases prescribed in clause 1 Article 3 of this Decree.

3. If the measurement instruments prescribed in clause 2 of this Article are directly used for the cases prescribed in clause 1 Article 3 of this Decree, the measurement results must be converted according to the regulation in Article 4 and expressed according to the regulation in Article 6 of this Decree.

Article 14. Implementation

1. The Minister of Science and Technology is responsible for the organization for the implementation of this Decree.

2. The Ministers, Heads of ministerial-level agencies, Heads of Governmental agencies, the Presidents of People’s Committees of provinces are responsible for the implementation of this Decree./.

ANNEX II

WRITING OFFICIAL UNITS OF MEASUREMENT
(Enclosed with the Decree No. 134/2007/NĐ-CP dated August 15, 2007 by the Government)

The official measurement units shall be written as follows:

1. Names and symbols of a unit shall be printed in a consistent style (only name or only symbol of the unit).

Ex: Kilometre/hour or km/h, not kilometer/h or km/hour.

2. Names of units shall be printed in upright type and start with a lower-case letter, including the units derived form proper names, except for Celsius degree.

Ex: metre, second, ampere, kelvin, pascal,…

3. Names of units shall be printed in upright type and start with a lower-case letter, except for the litre (L) 

Ex: m, s…

If the name of unit is derived from a proper name,  the first character of the symbol must be an upper-case letter.

Ex: A, K, Pa…

4. The official measurement units must not be attached any affixes or other symbols.

Ex: “We” must not be used as a symbol of power instead of W.

5. Multiplication must be indicated by a dot (.).

Ex: The unit of resistance power is metre kelvin per watt: m.K/W (where m  is the symbol of metre), apart from millikelvin per watt: mK/W (where m is the SI prefix milli)

6. Division is indicated by a horizontal line, by a solidus (oblique stroke, /) or by negative exponents.

Ex:  or m/s or m.s-1 for metre per second.

When several unit symbols are combined, the symbols shall be put in brackets or negative exponents shall be used.

Ex: J/(kg.K); m.kg/(s3.A) or J.kg-1.K-1; m.kg.S-3.A-1.

7. The value of a quantity shall be expressed as the product of a number and a unit. A space is left between the

numerical value and the unit symbol.

Ex: 22 m, not 22m or 22  m.

Note 1: The symbol of Celsius degree shall not include any space between the degree symbol (o) and the Celsius symbol (C).

Ex: 15 oC, not 15oC or 15 oC.

Note 2: The symbol of plane angles that is o (degree); ¢ (minute); ² (second) shall not include any space between the quantity value and the symbol (o); (¢); (²).

Ex: 15o20¢30¢¢,not 15 o20 ¢30 ¢¢ or  15 o 20 ¢ 30 ¢¢.

Note 3: When express quantity value by operation, the unit symbols shall be preceded by the numbers or the brackets containing the numbers of the operation.

Ex: 12 m – 10 m = 2 m or (12-10) m, not 12 m – 10 = 2 m or 12 – 10 m = 2 m.

12 m x 12 m x 12 m or (12 x 12 x 12) m, not 12 x 12 x 12 m.

23 oC ± 2 oC or (23 ± 2) oC, not : 23 ± 2 oC or 23 oC ± 2

Note 4: Comma (,) shall be used as the decimal mark of the quantity value, not point (.) 

Ex: 245,12 mm, not 245.12 mm
