DECREE
ON THE ESTABLISHMENT OF THE NATIONAL DEFENSE ACADEMY
THE GOVERNMENT
Pursuant to the Law
on Organization of the Government on the 30th of September 1992;
Pursuant to Decree No. 15-CP on the 2nd of March 1993, on the Tasks, Powers and
State Management Responsibilities of the ministries and agencies at ministerial
level;
Considering the proposals of the Minister of Defense and the Minister of
Education and Training,
DECREES:
Article 1.- To establish the National Defense Academy on the basis of the Advances Military Academy.
Article 2.- The National Defense Academy is directly under the Government and is a center for training and fostering high-level military personnel; providing knowledge on national defense for high-level cadres of the Party, State and people's organizations; and in research of military science.
The Government assigns its direct management to the Ministry of Defense. The State agencies, in compliance with their functions, have the responsibility to contribute to building the Academy.
The operation of the National Defense Academy shall be conducted according to a special statute to be decided by the Prime Minister.
Article 3.- The National Defense Academy has the duties:
1. To train and foster operational and command officers for high campaign and strategic levels; military personnel for local level; lecturers and researchers of military science; and to provide post-graduate and doctorate training in military science in accordance with the State provisions on the diploma system.
2. To provide knowledge on national defense for key cadres at provincial and equivalent levels, for leading cadres at agencies of the Party, State and people's organizations at the central level.
3. To conduct researches on military science and arts.
4. To forge international cooperation in training and fostering high-level military personnel.
Article 4.- The payroll for the National Defense Academy and the number of trainees shall be determined by the Minister of Defense.
Article 5.- The National Defense Academy shall be located in Hanoi as prescribed by the Prime Minister in Notice No. 159-TB of the 26th of November 1994.
Article 6.- This Decree takes effect as from the date of its signing. All previous provisions which are contrary to this Decree are now annulled.
Article 7.- The Ministers, the Heads of agencies at ministerial level, the Heads of agencies attached to the Government, and the Presidents of the People's Committees of provinces and cities directly under the Central Government are responsible for the implementation of this Decree.
