DECREE

APPROVING THE MODEL CONTRACT OF CONTRACTS OF OIL AND GAS PRODUCT DIVISION

Pursuant to the Law on Government organization, of December 25, 2001;

Pursuant to the 1993 Law on oil and gas; the 2000 Law amending and supplementing a number of articles of the Law on oil and gas and the 2008 Law amending and supplementing a number of articles of the Law on oil and gas;

At the proposal of the Minister of Industry and Trade;

The Government promulgates the Decree on the model contract of contracts of oil and gas product division,

Article 1. To promulgate together with this Decree the model contract of contracts of oil and gas product division.

Article 2. All contracts of oil and gas product division must comply with the model contract promulgated together with this Decree.

The Vietnam Oil and Gas Group and contractors shall negotiate for only contents epitomized "depending on the biding result or negotiation" similar to provision in Article 20.7 of the model contract. In case of having consent of the Prime Minister, the contract parties may agree to not apply the model contract.

Article 3. This Decree does not apply to the oil and gas contracts which have been concluded before the effective day of this Decree.  For the oil and gas consignment of which basic economic, technical and commercial conditions have been approved by the Prime Minister before the effective day of this Decree, the negotiation and conclusion in contract shall continue performing under the model contract of the contracts of  oil and gas product division promulgated together with the Government's Decree No. 139/2005/ND-CP of November 11, 2005.  

Article 4. This Decree takes effect on June 08, 2013 and replaces the  Government's Decree No. 139/2005/ND-CP of November 11, 2005 on promulgating the model contract of the contracts of  oil and gas product division.

Article 5. The Ministers, Heads of ministerial-level agencies, Heads of Governmental agencies, the Presidents of the People’s Committee of central-affiliated cities and provinces and relevant organizations and individuals shall implement this Decree
