DECREE

AMENDING, SUPPLEMENTING ARTICLE 11 OF THE DECREE NO.173/2007/ND-CP DATED NOVEMBER 28, 2007 OF THE GOVERNMENT ON ORGANIZATION AND OPERATION OF MARITIME PILOTAGE

THE GOVERNMENT

Pursuant to the December 25, 2001 Law on Organization of the Government;

Pursuant to the June 14, 2005 Vietnam Maritime Code;

Pursuant to the November 29, 2005 Enterprise Law;

At the proposal of the Minister of Transport,

DECREES

Article 1. Amending, supplementing Article 11 of the Decree No.173/2007/ND-CP dated November 28, 2007 of the Government on organization and operation of maritime pilotage as follows:

“Article 11. Financial mechanisms for operation of maritime pilotage

1. Maritime pilotage fees constitute state budget revenue. Pilotage companies shall collect directly maritime pilotage fees.

2. Funds to pay for services of maritime pilotage are taken from the collection of marine pilotage fees and supplemented from the state budget.

3. The Ministry of Transport is responsible for compilation and promulgation of technical and economic norms of maritime pilotage services and the implementation of the order providing services of maritime pilotage in the country.

4. The Ministry of Finance shall preside over and coordinate with the Ministry of Transport to guide the mechanism for ordering provision of services of maritime pilotage, the management regime of collection, remittance and use of maritime pilotage fees as prescribed by law on fees and charges suit to the practical situation of the organization and operation of maritime pilotage”.

Article 2. Effect

This Decree takes effect from September 01, 2011.

Article 3. Responsibility of implementation

Ministers, heads of ministerial-level agencies, heads of government-attached agencies, presidents of provincial/municipal Peoples Committees, the General Director of the Vietnam Maritime Administration, and concerned agencies, organizations and individuals are responsible for the implementation of this Decree.
