DECREE
ON AMENDMENT AND SUPPLEMENT OF A NUMBER OF ARTICLES OF THE DECREE NO.70/2007/ND-CP DATED APRIL 20, 2007 OF THE GOVERNMENT ON REGISTRATION OF NATIONALITY OF AND RIGHTS TO CIVIL AIRCRAFTS
Pursuant to the Law on Governmental Organization dated December 25, 2001;
Pursuant to the Law on Vietnam Civil Aviation dated June 29, 2006;
At the proposal of the Minister of Transport;
The Government issues a Decree on amending and supplementing some Articles of the Decree No.70/2007/ND-CP of April 20, 2007 by the Government on nationality registration and registration of rights to civil aircrafts,
Article 1. To amend and supplement some Articles of the Decree No.70/2007/ND-CP of April 20, 2007 of the Government on nationality registration and registration of rights to civil aircrafts with the following contents:
1. To amend Clause 1 and Clause 3 of Article 3 as follows:
"1. The proposer must submit 01 sets of dossiers to the Vietnam Aviation Department submitted directly by the Civil Aviation Administration of Vietnam or through the postal system and are responsible for the accuracy of the information on file. Applicants/requesters shall send one set of dossier to the Aviation Administration of Vietnam by person or by post and bear responsibility for the information accuracy in their dossiers.
3. Within five working days after receiving a complete dossier as prescribed, the Aviation Administration of Vietnam shall effect the registration or deregistration or supply information in writing to the requesters:”
2. To amend clause 3 of Article 5 as follows:
"3. Within 05 working days after receiving complete dossiers as prescribed, the Civil Aviation Administration of Vietnam shall perform the registration, deregistration, or provide written information to the requester."
3. To amend Clause 1 of Article 7 as follows:
"1. A dossier of application for aircraft nationality registration for aircraft specified in Clauses 4 and 5, Article 13 of the Civil Aviation Law of Vietnam comprises:
a) An application for registration of aircraft nationality in the form prescribed in Appendix I of this Decree;
b) Papers evidencing the legal status of the registration applicant or the registrant;
c) Legal documents evidencing the ownership of the aircraft;
d) Certificate of non-registration issued by the manufacturer's country or certificate of deregistration issued by the country of registration;
đ) Documents on technical conditions of the aircraft, including: valid certificate of export airworthiness for aircraft manufactured overseas, type certificate issued or recognized by the Aviation Administration of Vietnam, and the manufacturer's valid written certification on compliance with design and manufacture conditions.
e) Contract on aircraft purchasing, leasing or leasing-purchasing."
4. To amend Clause 2, Article 7 as follows:
"2. Dossier of application for temporary registration of aircraft nationality to aircraft specified in clause 3 of Article 13 of the Law on Vietnam Civil Aviation includes:
a) An application for temporary registration of aircraft nationality by prescribed form in Appendix VIII of this Decree;
b) Papers evidencing the legal status of the registration applicant or the registrant;
c) Documents evidencing the legal ownership of the aircraft;
d) Lawful documents evidencing the aircraft is in the stage of manufacture, assembly or testing in Vietnam;
đ) Records of aircraft design. "
5. To amend Clause 4 of Article 9 as follows:
"4. In case of deregistration of aircraft nationality upon the request of the aircraft registrant, the deregistration applicant shall send an application for deregistration under the form prescribed in Appendix II of this Decree to the Civil Aviation Administration of Vietnam by person or through the postal system.”
6. To amend Clause 2 of Article 14 as follows:
"2. A dossier of application for deregistration of rights for aircraft sent to the Aviation Administration of Vietnam includes:
a) An application for deregistration of the rights to the aircraft under the form prescribed in Appendix VII of this Decree;
b) Certificate of registration granted;
c) Contract of purchasing aircraft or leasing aircraft or of purchasing - leasing aircraft;
d) Written consent of the chargee in case the deregistration applicant is the charger.”
7. To amend Article 15 as follows:
"Article 15. Dossier of registration for ownership
Dossier of application for registration of aircraft ownership includes:
1. An application for registration of aircraft ownership in the form prescribed in Appendix III of this Decree;
2. A certified copy of certificate of Vietnam aircraft nationality registration;
3. Papers evidencing the legal status of the registration applicant or the registrant;
4. Legal papers to prove ownership of the aircraft; in case of transfer of ownership, it must also include papers to prove ownership of the former owner. "
8. To amend Article 16 as follows:
"Article 16. Dossiers of application for registration of rights to possession of aircraft
Dossier of application for registration of rights to possession of aircraft includes:
1. An application for registration of rights to possession of aircraft under the form prescribed in Appendix IV of this Decree;
2. A certified copy of certificate of aircraft nationality registration;
3. Papers evidencing the legal status of the registration applicant or the registrant;
4. A certified copy of the aircraft leasing contract or aircraft leasing-purchasing contract."
9. To amend Clause 2 of Article 18 as follows:
"2. Dossier of application for renewal of registration includes:
a) An application for renewal of registration of rights to possession of aircraft under the form prescribed in Appendix V of this Decree;
b) Papers evidencing the leasing-purchasing and leasing of aircraft prescribed at Point b clause 1 Article 28 of Law on Vietnam Civil Aviation extended;
c) A certified copy of certificate of possession registration of aircraft issued. "
10. To add Article 18a as follows:
"Article 18a. Registration for the pledge, mortgage of the aircraft and provision of information on pledge or mortgage of aircraft
The registration for pledge or mortgage of the aircraft and provision of information on pledge or mortgage of aircraft shall comply with the provisions of Decree No.83/2010/ND-CP dated July 23, 2010 of the Government on registration of security transactions."
11. To amend Clause 2 of Article 23 as follows:
"2. Dossier of application for registration includes:
a) An application for registration of rights to make payment for rescue or preservation of aircraft, in the form prescribed in Appendix VI of this Decree;
b) Papers evidencing the legal status of the registration applicant or the registrant;
c) Confirmation of the operation of rescue or preservation of aircraft of an airline or concerned airport authority. "
12. To amend Clause 1, clause 2 of Article 27 into 01 clause as follows:
"1. Those who request for information, extracts or copies from the Vietnam Aircraft Register send application for requesting information under the form prescribed in Appendix IX of this Decree to the Civil Aviation Administration of Vietnam."
13. To amend and supplement the Appendix as follows:
"1. Appendix I: Application Form for registration of nationality of Vietnam to aircraft.
2. Appendix II: Application Form for deregistration of Vietnam nationality to aircraft.
3. Appendix III: Application Form for registration of aircraft ownership.
4. Appendix IV: Application Form for registration of the right to possession of aircraft.
5. Appendix V: Application Form for renewal of registration of rights to possession of aircraft.
6. Appendix VI: Application Form for registration of rights to make payments for aircraft rescue and preservation.
7. Appendix VII: Application Form for deregistration of the rights to aircraft.
8. Appendix VIII: Application Form for temporary registration of Vietnam nationality to aircraft.
9. Appendix IX: Application Form for information; extracts or copies from the register of Vietnam aircraft. "
Article 2. Organization of implementation
1. This Decree takes effect as from August 15, 2012.
2. The ministers, heads of ministerial-level agencies, heads of governmental agencies, presidents of People’s Committees of the provinces and cities directly under the Central Government, the concerned enterprises, individuals shall implement this Decree ./.
