AMENDING AND SUPPLEMENTING A NUMBER OF ARTICLES OF THE GOVERNMENT’S DECREE NO. 86/2009/ND-CP DATED OCTOBER 19, 2009, DETAILING AND GUIDING IMPLEMENTATION OF A NUMBER OF ARTICLES OF ORDINANCE ON THE VIETNAM COAST GUARD

Pursuant to the Law on organizations of Government dated December 25, 2001;

Pursuant to the Ordinance on the Vietnam Coast Guard dated January 26, 2006;

At the proposal of the Minister of National Defense;

The Government promulgates the Decree amending and supplementing a number of articles of the Government’s Decree No. 86/2009/ND-CP dated October 19, 2009, detailing and guiding implementation of a number of articles of ordinance on the Vietnam Coast Guard,

Article 1. To amend and supplement a number of articles of the Government’s Decree No. 86/2009/ND-CP dated October 19, 2009, detailing and guiding implementation of a number of articles of ordinance on the Vietnam Coast Guard

1. Amending and supplementing Clause 2 and Clause 3 Article 3 as follows:

"Article 3. Organization and operation of the Vietnam Coast Guard

2. The Vietnam Coast Guard is specialized force of State, operates in accordance with Vietnam's laws; respecting and complying with treaties to which the Socialist Republic of Vietnam is a contracting party.

3. The Minister of National Defense shall be responsible before the Prime Minister, National Assembly for state management over the Vietnam Coast Guard, and personally direct operations of the Vietnam Coast Guard.”

2. Amending and supplementing Article 4 as follows:

“Article 4. International transaction name

Its English name used in international relations is Vietnam Coast Guard.”

3. Amending and supplementing Article 6 as follows:

“Article 6. The Command of Coast Guard

1. The Command of Coast Guard has the legal entity status, account, and seal with national emblem, is allowed to open account at State Treasury, and has headquarter located in Hanoi; its operational fund is allocated from the state budget and recorded separately in item of total operational funds of the Ministry of National Defense.

2. The Prime Minister shall appoint the commander, political commissar, deputy political commissar, and deputy commanders of Coast Guard at the proposal of the Minister of National Defense.”

4. Amending Article 11 as follows:

" Article 11. Uniforms of the Vietnam Coast Guard

Police badges, straps, insignias, uniforms and ceremonial uniforms of the Vietnam Coast Guard comply with the Prime Minister's regulations.”

5. Amending Clause 1 Article 21 as follows:

"Article 21. Organization of implementation

1. Annually, the Ministry of National Defense shall coordinate with the Ministry of Planning and Investment and the Ministry of Finance in estimating funds to ensure regular operation of the Vietnam Coast Guard.”

Article 2. Change of terms

1. To change phrase “Marine Police Department” into “The Command of Coast Guard” at Clause 2 Article 5.

Change phrase “Vietnam Marine Police” in to "Vietnam Coast Guard" at Clause 3, and Clause 4 Article 9.

2. To change phrase “Director of Marine Police Department” into “The Commander of Coast Guard” at Article 22.

Article 3. Effect and implementation responsibility

1. This Decree takes effect on October 12, 2013.

2. Ministers, Heads of ministerial-level agencies, Heads of Governmental agencies, chairpersons of People’s Committees of provinces and central affiliated cities and the Commander of Coast Guard shall implement this Decree.
