DIRECTIVE

ON THE IMPLEMENTATION OF THE LAW ON ENVIRONMENTAL PROTECTION

The Law on environmental protection was ratified at the 7^th Session of the XIII^th National Assembly and comes into effect from January 01, 2015. In order to create an effective implementation of the Law, increasing the effect and effectiveness of the state management in environmental protection in the new period and for the sustainable development of the country and the quality of life, the Prime Minister request the Ministers, Heads of ministerial level agencies, governmental agencies, Presidents of People's Committees of provinces shall punctually carry out the following activities:

1. Regarding the Ministry of Natural Resources and Environment:

a) Preside over, cooperate with relevant Ministries and regulatory bodies in submitting the Government and the Prime Minister the draft of Decrees and Decisions on guidelines for the implementation of the Law on environmental protection. The drafts shall be submitted not later than October 15, 2014;

d) Cooperate with the Ministries and the regulatory bodies in inspecting and reviewing the applicable legal documents of the National Assembly, the Government, the Prime Minister, the Ministers, Heads of People's Committees of provinces relating to environmental protection, supposing the amendment so as for ensuring the consistency and conformance to the regulations in the Law on environmental protection. The review shall be completed and reported to the Prime Minister not later than October 15, 2014;

c) Preside over, cooperate with the Ministry of Justice and People's Committees of provinces in the dissemination of the Law on environmental protection, increasing the awareness of policy and law on environmental protection of agencies, organizations, households, individuals, enterprises and the community. Apply appropriate propagating method to disseminate the Law on environmental protection among enterprises, residential areas, households and the citizens. Such activity shall be carried out regularly and constantly with appropriate contents and methods for particular subjects. In III^rd Quarter and IV^th Quarter of 2014, a wave of propagation shall be conducted to disseminate widely the Law on environmental protection;

d) Build and apply the evaluating standards, supervise the implementation of the law on environmental protection nationwide for an effective assessment of the implementation of the Law on environmental protection; grasp the actual situation, advantages and disadvantages in the implementation of the regulations on environmental protection in reality; conduct assessment of the awareness, consciousness, responsibilities and increase the quality of the officials in the implementation of the law on environmental protection; continue to apply the method for increasing the effectiveness of the implementation of the Law on environmental protection according to the actual situation, contributing to the completion of the structure, policy and remedial measures to increase the effectiveness of the implementation. The evaluation standards shall be completed in 2015;

dd) Monitor effectively the implementation of the policies, tasks, remedial measures in terms of environmental protection specified in the Resolution No. 24-NQ/TW dated June 03, 2013 by XI^th Central Executive Committee of Communist Party, the Resolution No. 35/NQ-CP dated March 18, 2013 by the Government and the Resolution No. 08/NQ-CP dated January 23, 2014 by the Government. The progress of the implementation of the Resolution No. 35/NQ-CP shall be reported to the Government in December, 2014.

2. Regarding the Ministries, ministerial level agencies, Governmental agencies, People's Committees of provinces:

a) Cooperate with the Ministry of Natural Resources and Environment in reviewing current legal documents within the management that are related to environmental protection to issue amendments according to the regulations in the Law on environmental protection 2014. The formulation, appraisal and inquiry about the legal documents relating to environmental protection shall be consistent with the Law on environmental protection;

b) People's Committees of provinces shall direct the Services, specialized regulatory bodies, People’s Committees of districts and press agencies to carry the propagation and dissemination of the legislation on environmental protection to local agencies, organizations, households and individuals; promptly issue the legal documents on environmental protection within the competence specified in the Law and the guiding documents;

c) Cooperate closely with the Ministry of Natural Resources and Environment in the dissemination of the Law on environmental protection and the increase of the awareness of the policies and laws in terms of environmental protection for the agencies, organizations, households, individuals, enterprises and the residents. The Ministry of Information and Communications shall direct the Central press agencies to formulate a plan on propagation and dissemination of the laws on environmental protection in different forms to every organizations and residents. Voice of Vietnam, Vietnam Television and press agencies are responsible for the propagation and the dissemination of the regulations in the Law on environmental protection and the guiding documents.

3. The Central Department of propaganda and training shall direct the propagation and dissemination of the laws on environmental protection Vietnamese Fatherland Front and the member organizations like Vietnam Farmer’s Union, Vietnam Women's Union, Communist Youth Union of Ho Chi Minh City and other associations shall take charge of organizing the propagation and dissemination of the laws on environmental protection to members.

Environmental protection is the responsibility and obligation of all agencies, organizations, households and individuals. The Prime Minister hereby requests the Ministries, regulatory bodies and People Committees and relevant agencies and organizations implement this Directive seriously and effectively. The Ministry of Natural Resources and Environment shall  supervise and inspect the implementation of the Directive of the Ministries, regulatory bodies and local governments then report the results to the Prime Minister./.
