CIRCULAR
ON THE ISSUANCE AND USE OF INTERNATIONAL DRIVING PERMIT
Circular No. 29/2015/TT-BGTVT dated July 6, 2015 of the Minister of Transport on issuance and use of the International Driving Permit, coming into force as of October 1, 2015, amended by:
Circular No. 01/2021/TT-BGTVT dated January 27, 2021 of the Minister of Transport on amendments to Circular No. 29/2015/TT-BGTVT dated July 6, 2015 of the Minister of Transport on issuance and use of international driving permit and Circular No. 12/2017/TT-BGTVT dated April 15, 2017 of the Minister of Transport on driver training, driving tests and issuance of driving licenses for road motor vehicles, coming into force as of March 15, 2021.
Pursuant to the Convention on Road Traffic 1968;
Pursuant to the Law on Road Traffic dated November 13th 2008;
Pursuant to the Decree No. 107/2012/ND-CP dated December 20, 2012 by the Government defining the functions, tasks, entitlements and organizational structure of the Ministry of Transport;
At the request of Director of Organization and Personnel Department and Director of Directorate for Roads of Vietnam,
The Minister of Transport promulgates the Circular on issuance and use of the International Driving Permit.
Chapter I
GENERAL PROVISIONS
Article 1. Scope
This Circular set forth the issuance and use of the International Driving Permit issued by Vietnam; the use of the International Driving Permit issued by member states of Convention on Road Traffic 1968 (hereinafter referred to as Vienna Convention).
Article 2. Regulated entities
1. This Circular applies to agencies in charge of issuance and management of the International Driving Permit in Vietnam; organizations/individuals relating to the use of the International Driving Permit issued by member states of Vienna Convention.
2. This Circular does not apply to the driving permit of Police forces and Military forces.
Article 3. Interpretation of terms
For the purposes of this Circular, these terms below shall be construed as follows:
1. “International Driving Permit” is a driving permit issued by a competent agency of a member state of Vienna Convention according to a uniform form.
2. The International Driving Permit is abbreviated as IDP.
3. “National Driving Permit” is a driving permit issued by a competent agency of a country and is valid within its territory.
4. “Electronic profile of International driving permit” is a collection of electronic documents relating to the issuance of the IDP.
Article 4. Form of International Driving Permit
1. An IDP is an A6 (148 mm x 105 mm) booklet bearing secret marks with grey cover and white pages according to the form in Appendix I enclosed with this Circular.
2. Page 1 (the cover page) provides the main information of the IDP in both Vietnamese and English, page 2 provides regulations on the scope of use of the IDP in both Vietnamese and English, page 3 is the particulars concerning the driver and the IDP categories and subcategories of vehicles (in Vietnamese), page 4 is a blank page, page 5 is the particulars concerning the driver and the IDP categories and subcategories of vehicles (in English), page 5 is the particulars concerning the driver and the IDP categories and subcategories of vehicles (in Russian), page 7 is the particulars concerning the driver and the IDP categories and subcategories of vehicles (in Spanish), page 8 is the particulars concerning the driver and the IDP categories and subcategories of vehicles (in French), page 9 specified the category of the vehicle (in French).
3. The IDP consists of two letters “VN" and 12 digits of the national driving permit code.
Article 5. Validity period and the IDP categories of vehicles
1. An IDP is valid for no longer than 03 years from the day on which it is issued and shall be conformable to the validity of the national driving permit.
2. Categories of vehicles IDP holders may operate are specified in Appendix II enclosed with this Circular.
Chapter II
ISSUANCE AND MANAGEMENT OF INTERNATIONAL DRIVING PERMIT
Article 6. Entities eligible for the International Driving Permit
Any Vietnamese, foreigners having card of residence in Vietnam who has an unexpired PET national driving permit issued by Vietnam.
Article 7. Responsibility for issuance and management of the International Driving Permit
1. Directorate for Roads of Vietnam shall manage the issuance of IDP nationwide, to be specific:
a) Design the security feature of the IDP template; print, issue, guide and manage the use of the IDP template nationwide;
b) Build up the IDP management information system;
c) Annually publish and update the list of signatory to Vienna Convention every year according to the official notice of the United Nation on website of Directorate for Roads of Vietnam;
d) Formulate and issue the list of equipment serving the issuance of the IDP;
dd) Direct the Departments of Transport satisfying conditions specified in point a clause 2 of this Article to issue the IDP;
e) Publish and update the list of the Departments of Transport in charge of issuing the IDP;
g) Prepare equipment according to regulations in point d clause 1 of this Article;
h) Receive and take responsibilities for the accuracy and legitimacy of the application for the IDP and issue the IDP according to the regulations.
2. Responsibilities of the Departments of Transport in charge of issuance and management of the IDP in local area:
a) Prepare equipment according to regulations in point d clause 1 of this Article;
b) Receive and take responsibilities for the accuracy and legitimacy of the application for the IDP and issue the IDP according to the regulations;
c) (annulled)
Article 8. Procedures for issuance of the International Driving Permit
1. Individuals shall submit the application for the IDP using the form in Appendix IV enclosed with this Circular in person or via the online public service system to Directorate for Roads of Vietnam or the Department of Transport.
2. Procedures for issuance of the IDP:
a) Any individual who submits an application to Directorate for Roads of Vietnam or the Department of Transport in person shall present the original of the national driving permit issued by Vietnam, passport, permanent resident card (for foreigner) to check the accuracy and legitimacy of the application and pay a given charge upon submission of the application as required; upon online submission, the individual shall make declaration as guided and be held liable for the information given and pay a given charge via the payment function of the online system and pay charges for other services upon their need. If the application is unsatisfactory, the receiving authority shall give a notice, in person, in writing, or via the online system, of information which needs further supplementation or modification within 2 business days following the submission;
b) Within 05 business days from the day on which the satisfactory application is received, Directorate for Roads of Vietnam or the Department of Transport shall issue an IDP to the individual; if the application is rejected, a response containing the explanation shall be sent.
3. If the IDP is lost or damaged, the individual shall submit application for reissuance according to regulations in clause 1 of this Article.
4. The application for IDP shall be rejected in the following cases:
a) The National Driving Permit is erased or damaged that essential information is no longer readable, or the permit’s appearance is unconformable;
b) The National Driving Permit was not issued by a competent agency according to regulations.
5. Any individual committing fraud to enable the IDP to be issued, erasing or falsifying information on the issued IDP, apart from having the IDP revoked, shall take legal responsibilities and shall not be granted the IDP for 03 years from the day on which the violation is discovered.
Article 9. Procedures for issuance and management of the International Driving Permit
1. The Departments of Transport
a) Receive the application for the IDP and use the IDP management information system established by Directorate for Roads of Vietnam to formulate the electronic profile;
b) Make photocopies of passport, residence card (applicable to foreigners) for checking and comparison during the issuance of the IDP;
c) Check, update and verify the electronic profile to the IDP management information system;
d) Verify the digital signatures of competent persons on the IDP electronic profile;
dd) Have the IDP printed under procedures;
e) Insect the quality of the printed IDP and update data on the IDP management information system of Directorate for Roads of Vietnam according to regulations.
2. Directorate for Roads of Vietnam
a) Receive and manage data about the IDP updated by the Departments of Transport to synchronize with the IDP management information system;
b) Update and operate the IDP management information system according to regulations;
c) Process applications for IDP submitted by individuals under procedures in clause 1 of this Article.
Chapter III
USE OF INTERNATIONAL DRIVING PERMIT
Article 10. Use of the IDP issued by Vietnam
1. Any people having the IDP issued by Vietnam who operates a vehicle in a member state of Vienna Convention shall bring the IDP and the National driving permit, and shall comply with the provisions of the traffic rules of such country.
2. The IDP issued by Vietnam is not valid in Vietnam’s territory.
Article 11. Use of the IDP issued by a member state of Vienna Convention in Vietnam
1. Any people having the IDP issued by a signatory to Vienna Convention who drives a vehicle within Vietnam’s territory shall bring the IDP and the National driving permit according to the category of his/her vehicle and shall comply with the provisions of the Law on Road traffic of Vietnam.
2. In case an IDP holder who commits violations against law provisions on traffic of Vietnam and has the IDP suspended, the duration of suspension shall not exceed the time he/she stays in Vietnam.
Chapter IV
IMPLEMENTATION
Article 12. Entry in force
This Circular comes into force as of October 1, 2015.
Article 13. Implementation
1. Directorate for Roads of Vietnam, Departments of Transport of central-affiliated cities and provinces shall be responsible for the implementation of this Circular.
2. The Chief officers, Chief Inspector, Directors of Departments, General Director of Directorate for Roads of Vietnam, Directors of Departments of Transport of central-affiliated cities and provinces, Heads of relevant agencies, organizations and individuals shall be responsible for implementing this Circular./.
