THE JOINT CIRCULAR

PROVIDING ON ESTABLISHMENT, DISSOLUTION, OPERATION ORGANIZATION AND REGIME, POLICY FOR VOLUNTARY SOCIAL WORK TEAMS IN COMMUNES, WARDS AND TOWNSHIPS

Pursuant to the Government’s Decree No. 186/2007/ND-CP of December 25, 2007, defining the functions, tasks, powers and organizational structure of the Ministry of Labor, War Invalids and Social Affairs;  

Pursuant to the Government’s Decree No. 61/2012/ND-CP of August 10, 2012, defining the functions, tasks, powers and organizational structure of Ministry of Home Affairs; 

Pursuant to the Government’s Decree No. 118/2008/ND-CP of November 27, 2008, defining the functions, tasks, powers and organizational structure of the Ministry of Finance;  

Pursuant to the Government’s Decree No. 61/2011/ND-CP of July 26, 2011, amending and supplementing a number of articles of the Government’s Decree No. 135/2004/ND-CP of June 10, 2004, providing on regime of application of the measure of consignment to disease treatment establishments, organization and operation of disease treatment establishments under the Ordinance on handling of administrative violations, and the regime applicable to minors and volunteers to come to disease treatment establishments;

The Minister of Labor, War Invalids and Social Affairs, the Minister of Home Affairs, and the Minister of Finance promulgate the Joint Circular providing on establishment, dissolution, operation organization and regime, policy for voluntary social work teams in communes, wards, townships,

SECTION 1. GENERAL PROVISIONS

Article 1. Scope of regulation

This Joint Circular provides on establishment, dissolution, operation organization and regime, policy for voluntary social work teams in communes, wards and townships (hereinafter abbreviated to Voluntary Teams).

Article 2. Interpretation of terms

In this Joint Circular, the following terms are construed as follows:

1. Voluntary team means a voluntary organization including persons participating in prevention and combat from social vices in communes, wards and townships, which is establishes, organized and operated as prescribed in this Joint Circular and relevant other legal documents. 

2. Members of Voluntary team are citizens who are residing or working in communes, wards and townships voluntarily participate in prevention and combat from social vices.

Article 3. Subjects of application

1. Voluntary teams and members of Voluntary teams.

2. Organizations, individuals related to establishment, organization and operation of Voluntary teams.

Article 4. Standards for members of Voluntary teams

1. Persons of 18 (eighteen) year old or older, with good healthy, sufficient civil act capacity as prescribed by law. Time of residence in communes, wards and towns is 06 (six) months or more or working in agencies or organizations that located offices in communal areas where voluntary teams are operating (not including civil servants).

2. Voluntarily participating in the Voluntary teams.

Article 5. Operational funds of Voluntary teams and regime, policy for members of Voluntary teams

1. Funds cover for activities of Voluntary teams and implementation of regime, policy for members of Voluntary teams are allocated in regular expenditure estimation of local budget under decentralization of Law on the State budget and documents guiding implementation.

2. Amount financed, mobilized from organizations, individuals and other sources as prescribed by law.

SECTION 2. ESTABLISHMENT, DISSOLUTION; ORGANIZATION, OPERATION OF VOLUNTARY TEAMS AND REGIME, POLICY FOR MEMBERS OF VOLUNTARY TEAMS

Article 6. Competence for establishment, dissolution of Voluntary teams

The Chairpersons of the People’s Committee of districts, towns, provincial cities (hereinafter abbreviated to provincial People’s Committee) shall decide establishment, dissolution of Voluntary team.

Article 7. Procedures for establishment of Voluntary teams

1. Based on practical situation, requirements of prevention and combat from social vices in communes, wards and townships, People’s Committees of communes, wards and townships (hereinafter abbreviated to communal People’s Committee) shall make dossier requesting for establishment of Voluntary teams as prescribed in clause 3 of this Article and directly send or by post office to the district-level Division of Labor, War Invalids and Social Affairs.

2. Within 10 (ten) working days after receiving, to the district-level Division of Labor, War Invalids and Social Affairs shall consider dossiers and submit them to the Chairperson of the district-level People’s Committee for issuance of decisions on establishment of voluntary teams. In case refusal for establishment, the district-level Division of Labor, War Invalids and Social Affairs must have a written reply clearly stating reason thereof and send it to the Chairperson of the district-level People’s Committee. 

3. Dossier (01 set) requesting for establishment of Voluntary teams includes:

a) Report on requesting for establishment of Voluntary team of the Chairperson of communal-level People’s Committee, of which content clearly state the necessity of establishment of voluntary team, quantity and structure of members of voluntary team.

b) Draft of Regulation on operation of Voluntary team.

Article 8. Procedures for dissolution of Voluntary teams:

1. A voluntary team is dissolved in the following cases:

a) At the request of the Chairperson of communal-level People’s Committee;

b) There is serious violation in management, organization and operation of the Voluntary team. There are 2/3 (two-thirds) of members of voluntary team violating law and being administratively sanctioned, examined for penal liability or activities of team are inconsistent with functions, tasks specified in Article 10 of this Joint Circular.

2. Within 05 (five) working days, after receiving report on detecting violation of member of voluntary team, chief of the division of Labor, War Invalids and Social Affairs shall consider the proposal on dissolution of the chairperson of the communal People’s Committee as prescribed in point a clause 1 of this Article, or inspect, assess extent of violation as prescribed in point b clause a of this Article and make a written report (01 set) to submit the Chairperson of the district-level People’s Committee.

3. Within 05 (five) working days, after receiving written report of chief of the division of Labor, War Invalids and Social Affairs, the chairperson of the district-level People’s Committee shall issue Decision on dissolution of Voluntary team.

Article 9. Organization of Voluntary teams

1. Each commune, ward or township establish only 01 (one) Voluntary team; minimum quantity of members is 05 (five) persons, and maximally not more than 10 (ten) persons.

2. Structure of a Voluntary team includes: 01 (one) chief of team, 01 (one) or 02 (two) deputy chief of team and other members.

Article 10. Functions and tasks of Voluntary teams

1. Voluntary teams support communal People’s Committees in prevention and combat of social vices in their localities, and operate under Regulation approved by the Chairpersons of district People’s Committee.  

2. Specific tasks of Voluntary teams:

a) Organizing activities to inform, propagate, educate for the prevention of drug abuse, prostitution vices, reduction of HIV/AIDS infection and harm, support for victims trafficked in communities;    

b) Participating in management, advisory, education, convert, mobilization and support for drug addicts in order to perform the detoxification, prostitutes in order to reform their life, victims of human trafficking in order to integrate into the community;c) Detecting violations of law on prevention and combat of drug abuse, prostitution, HIV/AIDS and human trafficking vices in order to report to functional agencies for handling and having measures to prevent and stop violations;

d) Participating in implementation of socio-economic programs in localities such as hunger elimination, poverty reduction, vocational teaching, creating jobs, gender equality, reduction of stigma and discrimination, accessing to health and social services, helping drug addicts after detoxification, prostitutes to be reformed, victims trafficked to come back and stabilize life, integrate into community;   

e) Participating in integration of social vice prevention and combat with the campaign “The entire people unify to build cultural life in residential areas”, building health communes, wards and townships without social vices and other movements in localities.

Article 11. Support policies for members of Voluntary teams

1. Based on specific situation and conditions of localities, members of Voluntary teams are enjoyed the following support policies:

a) Participating in courses of coaching, training and improving knowledge, conferences, workshops, going sightseeing and study, forums sharing experiences on HIV/AIDS prevention and combat, prevention and combat of drug abuse, prostitution vices and prevention and combat of human trafficking, which are organized by levels, sectors. 

b) Supplying documents and information related to HIV/AIDS prevention and combat, prevention and combat of drug abuse, prostitution vices and prevention and combat of human trafficking;

c) Participating programs, projects implemented in localities related to their mission.

2. Member of Voluntary team who meets with an accident when doing task and suffers health damage will be supported the health costs for treatment, recovery of health and lost or diminished functions as follows:

a) In case member of Voluntary who meets with an accident participated in health insurance, he/she will be paid by the Health insurance Fund as prescribed by Law on Health insurance and documents guiding implementation;

b) In case member of Voluntary who meets with an accident has not yet participated in health insurance: Funds to support for health costs used in health treatment and recovery of lost or diminished functions for the member of voluntary team, who meets with an accident, shall be paid by the State budget in regular expenditure estimation of communal budget.

3. Member of voluntary in case of being injured or die which is one of cases specified in the Ordinance on preferential treatment for people with meritorious services to the revolution, he/she will be recognized as war invalids of fallen heroes.

4. Member of Voluntary team who has participated in team continuously for 03 (three) years or longer, in which at least has 01 (one) year to be granted certificate of merit of sectors, mass or authorities, he/she will be prioritized to participate in vocational training courses, to borrow money for business and production from programs, schemes, projects on vocational teaching or socio-economic development in communal localities. 

Article 12. Funds supporting for activities of Voluntary team and the remuneration regime for member of Voluntary team

1. Voluntary team is supported funds to assure for regular activities, in order to spend on information, propagation, advisory for subjects, stationeries, preliminary and final reviews.    

2. Member of Voluntary team is enjoyed the following benefits:

a) To be enjoyed monthly remunerations. The maximum monthly remuneration for: Chief of team is 0.6 (zero point six) times of the state’s general minimum wage; deputy chief of team is 0.5 (zero point five) times; member of Voluntary team is 0.4 (zero point four) times.   The People’s Councils of provinces and centrally-run cities shall decide the specific levels in conformity with budget capacity and actual situation of each local;

b) Being supported 01 time (once) for purchase of uniform with the maximum level of 500,000 (five hundred thousand) dong.

3. Based on the operation plan and budget estimation of Voluntary team, support regime for Voluntary team, member of Voluntary team specified in clause 1, clause 2 this Article, communal People’s Committee shall make estimation together with the annual expenditure estimation of communal budget in order to submit to competent authorities for decision.

SECTION 3. ORGANIZATION OF IMPLEMENTATION

Article 13. Responsibilities of People’s Committees at all levels

1. Provincial People’s Committees shall, based on actual local situation, decide policies, plans to establish network of voluntary teams in localities.

2. District-level People’s Committees shall direct the district-level Divisions of Labor, War invalids and Social Affairs to inspect, assess activities of network of voluntary team in localities; train, improve professional skills aiming to enhance effectiveness of activities of Voluntary team; periodically 06 (six) months, 01 (one) year report operation result of Voluntary team to the provincial People’s Committees and irregularly report upon required.  

3. The communal People’s Committees shall: 

a) Direct the formulation of action plan of Voluntary team;

b) Support funds in order to assure for regular activities of Voluntary team and implement payment of regime allowances for members of Voluntary team as prescribed in Article 12 of this Joint Circular;

c) Periodically 06 (six) months, 01 (one) year, report operation result of Voluntary team to district People’s Committee.

Article 14. Responsibilities of provincial Departments of Labor, War Invalids and Social Affairs

1. To assume the prime responsibility for, and coordinate with provincial Departments of Home Affairs, the Service of Finance in formulation of planning on network of Voluntary teams in order to submit the President of the provincial People’s Committee for approval.

2. To assume the prime responsibility for, and coordinate with relevant sectors in directing the district-level agencies of Labor, War Invalids and Social Affairs in order to carry out activities: Training, improving professional skills for members of Voluntary team; periodically inspecting, assessing activities of network of Voluntary teams, proposing solutions for consolidation of organization, enhancing the effectiveness of activities of Voluntary teams.

3. Guiding, inspecting, assessing establishment, dissolution, organizing activities and implementing regimes, policies for members of Voluntary team.

4. Periodically 06 (six) months, 01 (one) year, reporting on situation and operation result of Voluntary teams to provincial People’s Committees, the Ministry of Labor, War Invalids and Social Affairs and report irregularly as required.

Article 15. Implementation provisions

1. This Joint Circular takes effect on December 07, 2012.

2. This Joint Circular replaces the Joint Circular No. /2003/TTLT-BLDTBXH-BTC-UBTUMTTQVN, of December 18, 2003 of the Ministry of Labor, War Invalids and Social Affairs, the Ministry of Finance, Central Committee of Vietnam Fatherland Front  guiding on organization and activities of Teams of voluntary social operating of communal level.   

3. To promulgate together with this joint Circular the following forms:

a) Form of report of the chairpersons of communal People’s Committee on requesting for establishment of the Voluntary social work team (Annex 1);

b) Form of Decision of the chairpersons of district People’s Committee on establishment of the Voluntary social work team (Annex 2);

c) Form of Decision of the chairpersons of district People’s Committee on dissolution of the Voluntary social work team (Annex 3);

d) Form of Regulation on organization and operation of the Voluntary social work team at communal level (Annex 4);

e). Form of periodically report on operation result of the Voluntary social work team at communal level (Annex 5);

In the course of implementation, any arising problems should be reported to the Ministry of Labor, War Invalids and Social Affairs for consideration and settlement.

FORM OF REGULATION ON ORGANIZATION AND OPERATION OF THE COMMUNAL VOLUNTARY SOCIAL WORK TEAM

SECTION 1. GENERAL PROVISIONS

Article 1. Scope of regulation

This Regulation applies to the Voluntary social work team of commune1……….. that is established under the Decision No. :  …………./QD/UBND date ……. month .... year ……… of the chairperson of People’s Committee of district2 ………………………).

Article 2. Position and function

The voluntary social work team of commune …….  (hereinafter abbreviated to the Voluntary team) is a voluntary organization including a few of members of socio-political organizations, individuals who voluntarily participate in social vice prevention and combat in locality

The Voluntary team supports for the communal People’s Committee in implementation of prevention and combat of drug abuse, prostitution vices, HIV/AIDS infection, helping victims trafficked, prostitutes, drug addicts in treatment, performing the detoxification and management after detoxification and the reintegration into community.

Article 3. Tasks of Voluntary team:

1. Operating under the Regulation on organization and operation of Team that has been approved by the Chairperson of the communal People’s Committee.

2. Participating in plans, action programs under allocation of the communal People’s Committee relating to prevention and combat of HIV/AIDS, drug abuse and prostitution vices, support for victims trafficked to come back, specifying:

a) Implementing activities of information, propagation, education on prevention and combat of drug abuse and prostitution vices, reduction of HIV/AIDS infection and harm, support for victims trafficked to come back.

b) Participating in management, approaching for advisory, education, conversion and mobilization for drug addicts to perform the detoxification, for prostitutes to be treated and re-integrate into community.

c) Detecting violations relating to drug abuse and prostitution vices causing HIV/AIDS infection, human trafficking in order to report to functional agencies for handling and having measures to prevent violations.

d) Coordinating with sectors, mass organizations to implement policies, socio-economic programs in locality such as hunger elimination, poverty reduction, vocational teaching, creating jobs, gender equality, reduction of stigma and discrimination, helping drug addicts post-detoxification, prostitutes post-treatment, victims trafficked to come back and approach with health and social services, stabilize life, integrate into community.

e) Together with sectors, mass organizations in integrating social vice prevention and combat with movement "The entire people unify to build cultural life in residential areas" which are presided over by the Fatherland Front and other movements in locality.

SECTION 2. ORGANIZATION AND PERSONNEL

Article 5. Organization of Voluntary team

Structure of Voluntary team includes: 1 (one) chief, 1-2 (one or two) deputy chief(s) and ......... members3.

Article 6. Personnel

1. Chief, deputy chief:

a) Procedures for recognition and term:

Chief, deputy chief (s) of team are recommended by communal People’s Committee and communal People’s Committee shall issue decision on recognition of them on the basis of consulting volunteers with unanimity of (2/3 (two-thirds) quantity of volunteers. 

Term of chief and deputy chief are 1 (one) year, in special case whether it have to prolong, it does not prolong exceeding 6 (six) months. The chief, deputy chief must self-assess result of their activities and be assessed on capacity of team administration by the communal People’s Committee in order to do as basis for nomination.

b) Tasks of chief:

- Being responsible for all activities of the Voluntary team before the chairperson of communal People’s Committee.

- Building, organizing the programs and plans on operation of the communal-level Voluntary team;

- Being exemplary, facilitating for members in the voluntary team in finishing tasks.

- Managing, operating activities of Voluntary team under this Regulation, implementing the monthly, quarterly, annual report regime with the communal chairperson of the People’s Committee, regarding result of activities of team under the assigned functions and tasks.

a) Power of Team chief

- Participating in formulation of programs, action plans, budget estimations for operation, regimes, policies in accordance with regulation, assigning members implementation of tasks and participating in other activities of Voluntary team.

- Proposing to the communal chairperson People’s Committee for measures to solve drug abuse and prostitution vices, HIV/AIDS infection, support victims trafficked for integration into community and other social work within scope and task of team. 

- Periodically or irregularly propose competent authorities for the rewarding members of team who well implement tasks or propose handling with members who violate Regulation on organization and operation of Team.

d) Tasks and powers of team deputy chief: Being assistant for team chief and on behalf of team chief in implementing tasks and powers above when is authorized by the team chief.

2. Members of Voluntary team:

a) Procedures for recognition:

Member of voluntary team is proposed by team chief and the communal People’s Committee shall issue decision on recognition.

- The dismissal of team chief, deputy chief and members are complied with the process and competence such as decision on recognition.

b) Tasks of volunteers:

- Operating under the Regulation of Voluntary team and assignment of task of team chief.

- Implementing activities of information, propagation, education on prevention and combat of drug abuse and prostitution vices, reduction of HIV/AIDS infection and harm, support for victims trafficked to come back.

- Managing, approaching for advisory, education, conversion, mobilization and help for drug addicts post-detoxification, for prostitutes to reform their life, persons infected with HIV/AIDS to be treated and reintegrated into community.

- Detecting acts relating to drug abuse and prostitution vices causing HIV/AIDS infection, human trafficking in order to report to functional agencies for handling and having measures to prevent violations.

Article 7. Commendation and discipline

1. Annual members of voluntary team are considered for commendation as prescribed by law.  Content of commendation, expenditure levels are complied with provisions of Law on Emulation and Commendation and documents guiding implementation.

2. Person who participating in Voluntary team and violating regulation of voluntary team, violating law, depending on nature and seriousness of violations, shall be disciplined, administratively handled or criminally prosecuted as prescribed by law.

SECTION 3. FUNDING FOR OPERATION, REGIMES, POLICIES, TASK RELATIONSHIPS AND REPORT REGIME

Article 8. Funding for activities of Voluntary team, regimes, policies for members of Voluntary team

The voluntary team is supported funding to cover regular activities, members of voluntary team are enjoyed regimes, policies as prescribed in Article 11, Article 12 of the Joint Circular No.   /2012/TTLT-BLDTBXH-BNV-BTC, of date  month year 2012 of the Minister of Labor, War Invalids and Social Affairs, Minister of Home Affairs, Minister of Finance providing on establishment, dissolution, organization of activities and policy regimes for Voluntary social work teams in communes, wards and townships.

Article 9. Task relationship

1. The voluntary team is directly managed by the communal People’s Committee.

2. The voluntary team is supervised and supported by the Committee of Father Front, social-political organizations in commune, ward or township.

3. The voluntary team coordinates in operation and is supported by sectors, mass organizations and officer specialized in charge of Labor - War Invalids and Social Affairs in commune, ward or township.

Article 10. Report regime

Monthly, quarterly, yearly, the voluntary team reports periodical activities to the communal People’s Committee.  Irregularly report to the communal People’s Committee at the request.

SECTION 4. Implementation provisions

Article 11. Organization of implementation

Chief of voluntary team shall, based on this Regulation and monthly, quarter, yearly work plans approved by the communal People’s Committee, specify tasks for each member of voluntary team.

Article 12. Effect

This Regulation takes effect on the day of its signing.  Team chief, deputy chief and members of Voluntary team, relevant units of the People’s Committee of commune4 ………. shall implement this Regulation.

3. OPERATION RESULT OF THE VOLUNTARY SOCIAL WORK TEAMS

- Propagation and education in community: Content, method of propagation, quantity of persons participating in, comments, appraisals.

- Advisory work for subjects being person of post-detoxification, prostitutes of post-treatment, victims trafficked came back:  Method, the quantity of persons receiving advisory, comments and appraisals.

- Coordinating in management of localities, subjects, detecting violations: Quantity of subjects managed, forms and measures of management. Detecting violations: Quantity, forms, preventive measures.

- Coordinating in implementation of programs on hunger elimination, poverty reduction, vocational teaching, creating jobs, reduction of stigma, helping drug addicts, prostitutes post-treatment, and victims trafficked to come back and integrate into community: Content of coordination, measures of implementation, quantity of persons who are borrowed money, quantity of persons who are created jobs.

- Integration of prevention and combat against social vices with the campaign “The entire people unify to build cultural life in residential areas” presided over by the Vietnam Fatherland Front.
