JOINT CIRCULAR
PROVIDING THE IMPORT OF BRAND-NEW UNDER 16-SEAT PASSENGER CARS
Pursuant to the Government's Decree No. 189/2007/ ND-CP of December 27,
2007, defining the functions, tasks, powers and organizational structure of the
Ministry of Industry and Trade;
Pursuant to the Government's Decree No. 51/ 2008/ ND-CP of April 22, 2008,
defining the functions, tasks, powers and organizational structure of the
Ministry of Transport;
Pursuant to the Government's Decree No. 118/2008/ND-CP of November 27, 2008. defining
the functions, tasks, powers and organizational structure of the Ministry- of
Finance;
Pursuant to the Government's Decree No. 12/2006/ND-CP of January 23, 2006,
detailing the Commercial Law regarding international trading activities and
activities of goods trading agency, processing and transit with foreign
partners;
Pursuant to the Government's Decree No. 132/2008/ND-CP of December 31, 2008,
detailing a number of articles of the Law on Product arid Goods Quality;
The Ministry of Industry and Trade, the Ministry of Transport and the Ministry
of Finance jointly provide in detail border gates of importation and customs
clearance conditions for brand-new under 16- seat passenger cars, below
referred to as passenger cars:
Article 1. Border gates of importation
Passenger cars may be imported to Vietnam only through the international seaport border gates of Cai Lan - Quang Ninh, Hai Phong, Da Nang. HoChi Minh City and Ba Ria - Vung Tau. Customs procedures are carried out at border gates of importation.
Article 2. Customs clearance conditions, procedures and time for inspection of quality for imported cars
1. Customs offices may only complete customs clearance procedures when passenger cars are granted a certificate of conformity from inspection of quality, technical safety and environmental protection for imported motor vehicles or a notice of exemption from inspection of quality, technical safety and environmental protection for imported motor vehicles by Vietnam Register.
2. Procedures for inspection of quality, technical safety and environmental protection for imported motor vehicles comply with the Ministry of Transport's regulations.
3. The time limit for granting a certificate of conformity from inspection of quality, technical safety and environmental protection for imported motor vehicles or a notice of exemption from inspection of quality, technical safety and environmental protection for imported motor vehicles is 10 working days, from the date of completing inspection of imported motor vehicles at the registered inspection site specified in a written registration for inspection of quality, technical safety and environmental protection for imported motor vehicles.
Article 3. Effect
This Circular takes effect on July 29, 2010.
