MEMORANDUM OF LEGAL AND JUDICIAL COOPERATION

BETWEEN THE MINISTRY OF JUSTICE OF THE SOCIALIST REPUBLIC OF VIETNAM AND THE MINISTRY OF JUSTICE OF THE REPUBLIC OF BULGARIA

The Ministry of Justice of the Socialist Republic of Vietnam and the Ministry of Justice of the Republic of Bulgaria (hereinafter referred to as “the Parties”),

Expressing their wish to develop and increase the cooperation in the legal and judicial field;

In the firm conviction that the partnership between all legal and judicial authorities based on equality and mutual confidence which will contribute to the improvement of the  qualification of legal and judicial officials and will raise the quality in all activities in the legal and judicial field;

Have agreed as follows:

Article 1

The Parties shall cooperate in the legal and judicial field  in particular in legislative proceedings, in the reform of the legal and judicial system, in trainings of legal and judicial officials as well as mutual legal assistance in the framework of their competences.

Article 2

To facilitate the development of partnership between the judicial authorities of the both Parties.

Article 3

To exchange regularly information about the changes in the national legislation of each of the Parties.

Article 4

To exchange experience in the use of information technologies in the field of legal, judicial and administrative practices justice agencies.

Article 5

To exchange experience in the application of European and International acts in the field of civil and criminal matters.

Article 6

To duly implement international cooperation in the execution of requests for legal aid, judicial supporting activities, judicial administrative activities and some other issues of mutual interests.

Article 7

To organize seminars, trainings, practical courses and visits for exchange of experience in view of improvement and qualification of legal and judicial officials, experts in the Ministries of Justice and staff of justice agencies at local level.

Article 8

To organize, with mutual consent, other events which would correspond to the aims and directions of the cooperation in the legal and judicial field.

Article 9

To inform on regular basis each other about the activities which have been carried out in the framework of this Memorandum including through official visits of delegations of both Ministries of Justice.

Article 10

To provide funding for common cooperation events in accordance with the provisions of the national legislation of both Parties and on the basis of the principle that expenses for stay on the territory of the receiving country are covered by the host country and international travel expenses are covered by the sending country.

Article 11

The present Memorandum shall remain in force for an indefinite period and enter into force after signing thereof.

Each Party may terminate the Memorandum. The Memorandum shall be terminated after the expiry of three months after receipt of the written notification for termination thereof.

Done at Hanoi on 31 January 2009, in duplicate, each in Vietnamese, Bulgarian and English languages, all texts being equally authentic. In case of divergence in interpretation, the English text shall prevail.
