To: Management Board of Tay Ninh Economic Zone
In response to the letter no 432/BQLKKT-LD dated July 15, 2015 by the Management Board of Tay Ninh Economic Zone on the wage for shift-based workers working in regulated holidays, the Ministry of Labor - Invalids and Social affairs gives the following answer:
Pursuant to Article 105 of the Labor Code, the night work period is 10 p.m. to 6 a.m.
Article 115 of the Labor Code stipulates workers be given full paid leave in (regulated) holidays.
Therefore, a worker working in a shift from 10 p.m. of the prior day to 6 a.m. of a regulated holiday shall earn overtime pay for service from 0 to 6 o'clock of that regulated holiday pursuant to Article 97 of the Labor Code.
