Implementing Official Telegrams No. 540/CD-TTg and No. 541/CD-TTg dated 23/4/2021 by the Prime Minister, National Steering Committee for COVID-19 Prevention and Control (hereinafter referred to as “National Steering Committee”), Ministry of Health and relevant ministries have promulgated multiple guiding documents to enable entry to Vietnam while ensuring COVID-19 prevention. Based on current COVID-19 situation in other countries, to enhance COVID-19 prevention and control and grant entry to eligible persons according to regulations, the Ministry of Health (standing body of National Steering Committee) promulgates guidelines for management of applicants for entry to Vietnam for COVID-19 prevention and control (enclosed therewith).

The Ministry of Health (standing body of National Steering Committee) requests you to direct proper performance of the following tasks:

1. Strictly consider and approve entry applications (pay attention to verifying applicants invited by enterprises), ensuring that only prioritized persons are granted entry according to directions of the Prime Minister and National Steering Committee.

2. Regularly carry out inspection and supervision; take actions against granting entry to ineligible persons and illegal entry. Report any difficulty arising to the Ministry of Health (General Department of Preventive Medicine), which will submit a consolidated report to National Steering Committee and Prime Minister.

GUIDELINES

MANAGEMENT OF APPLICANTS FOR ENTRY TO VIETNAM FOR COVID-19 PREVENTION AND CONTROL

(Promulgated together with Official Dispatch No. 3440/CV-BCD dated 27/4/2021 by National Steering Committee for COVID-19 Prevention and Control)

I. Grounds for implementation:

- Law on Tourism No. 09/2017/QH14 dated 19/6/2017 by the National Assembly and the Government’s Decree No. 38/2020/ND-CP dated 03/4/2020 elaborating Law on Vietnamese Guest Workers;

- Directive No. 01/CT-TTg dated 05/01/2021 by the Prime Minister on enhancement of COVID-19 prevention and control;

- Official Telegram No. 540/CD-TTg dated 23/4/2021 by the Prime Minister on strengthening management of inbound flights to Vietnam;

- Official Telegram No. 541/CD-TTg dated 23/4/2021 by the Prime Minister on enhancement of COVID-19 prevention and control;

- Notifications No. 122/TB-VPCP dated 24/3/2020, No. 146/TB VPCP dated 07/4/2020, No. 170/TB-VPCP dated 28/4/2020, No. 182/TB-VPCP dated 15/5/2020, No. 203/TB-VPCP dated 10/6/2020, No. 238/TB-VPCP dated 12/7/2020 and No. 330/TB-VPCP dated 15/9/2020 by the Office of the Government on the Prime Minister’s conclusions in meetings of standing Government members on COVID-19 prevention and control;

- Official Dispatch No. 1113/CV-BCD dated 23/02/2021 by National Steering Committee on enhancing control of entry to Vietnam for COVID-19 prevention and control

II. Objectives and requirements

Ensure proper entry application consideration and approval per regulations and COVID-19 prevention and control.

III. Persons eligible for entry application

1. Foreign experts, investors, business managers and high-skilled workers (hereinafter referred to as “experts”) and family thereof (father, mother, husband, wife, children).

2. Foreigners entering Vietnam for diplomatic or official business purpose and family thereof (father, mother, husband, wife, children).

3. Foreign students studying in Vietnam.

4. Vietnamese businesspersons; intellectuals; students; senior citizens; persons who have finished visiting family or traveling overseas; workers whose contracts have expired; persons whose study has ended and/or are stranded abroad; persons visiting other countries for medical care; and persons whose visa has expired.

5. Humanitarian entry applicants and other special cases.

IV. Requirements for entry applicant management

1. Bringing Vietnamese citizens back to Vietnam and entry application by foreigners must adhere to approved roadmaps and plans, be within the capacity for medical quarantine and COVID-19 prevention and control; be carried out in a strict, safe and transparent manner and without personal gain.

2. Only those eligible for entry application according to directions from the Prime Minister and National Steering Committee may be considered; humanitarian entry applications and other special cases require written approval of the Prime Minister or National Steering Committee.

3. Organizations and units applying for entry on behalf of individuals must have a business registration certificate and/or operating license whose scope of operations is appropriate to the entry purpose of Vietnamese citizens and sufficient registered seals and signatures.

4. Vietnamese citizen transport businesses which apply to provide full-service commercial flights to transport Vietnamese citizens wishing to return to Vietnam shall meet the requirements provided for in Section 3 of this Official Dispatch, obtain written approval of 5 Ministries (Ministry of Health, Ministry of Foreign Affairs, Ministry of Transport, Ministry of National Defense and Ministry of Public Security) and written agreement to receive entrants for medical quarantine of the provincial People’s Committee and propose such flight provision to the Prime Minister for consideration and approval, and may provide the flights with the Prime Minister's approval.

5. Organizations and units applying for entry on behalf of individuals shall submit the applications in writing together with contact information (address, phone number and email) and documentary proof of reason for entry; must make a commitment to take full responsibility before the law for information in the applications and shall strictly comply with COVID-19 prevention and control requirements before, during and after entry according to regulations.

6. Individuals applying for entry must provide sufficient information (address, phone number, email and passport) together with documentary proof of reason for entry; and have a family relationship confirmation (father, mother, husband, wife, children) from competent authority of the commune where the applicant stays after medical quarantine.

V. Implementation

1. The Ministry of Health (standing body of National Steering Committee) assigns General Department of Preventive Medicine to take charge of application receipt and assessment, which will take responsibility before the law for the accuracy of each application before sending it to the Ministry of Health for approval.

2. The Ministry of Foreign Affairs shall take charge and cooperate with relevant units in considering and granting entry to foreigners wishing to enter Vietnam for diplomatic or official business purpose and family thereof (father, mother, husband, wife, children); take charge of providing flights to bring stranded Vietnamese citizens back to Vietnam according to plans approved by the Prime Minister and take charge of consolidating applications for provision of full-service commercial flights to transport Vietnamese citizens wishing to return to Vietnam and proposing these applications to relevant ministries and Prime Minister for approval.

3. The Ministry of Transport, Ministry of National Defense and Ministry of Public Security shall cooperate in considering entry applications proposed by relevant ministries, granting entry and receiving and managing entrants as per regulations.

4. Provincial People’s Committees shall:

- Consider applications from foreign experts entering Vietnam for work and family thereof (father, mother, husband, wife, children) in compliance with the guidelines in Official Dispatch No. 2847/CV-BCD dated 23/5/2020 and Official Dispatch No. 3949/CV-BCD dated 24/7/2020 by National Steering Committee, according to which, provincial People’s Committees shall decide and send lists of experts eligible for entry and family thereof (father, mother, husband, wife, children) to the Ministry of Public Security (Vietnam Immigration Department) for consideration and, concurrently, ensure compliance with COVID-19 prevention and control requirements before, during and after entry.

- Decide within their competence and take responsibility before the law for receipt and quarantine of entrants, strictly supervise entrant quarantine, ensure proper compliance with COVID-19 prevention and control regulations, prevent infection in quarantine facilities or from quarantine facilities to the community. Strictly handle those making personal gain and those not following prevention and control regulations

5. Organizations and units applying for entry on behalf of individuals shall make a commitment to take full responsibility before the law for information in the applications and strictly comply with COVID-19 prevention and control requirements before, during and after entry.

6. Individuals applying for entry shall make a commitment to take full responsibility before the law for information in the applications and strictly comply with COVID-19 prevention and control requirements before, during and after entry.

7. Any sign of forgery of a document related to the matters mentioned herein should be promptly reported to the Ministry of Health (General Department of Preventive Medicine), which will refer the case to competent authority for handling as per the law./.
