Pursuant to Resolution No. 128/NQ-CP dated October 11, 2021 of the Government on promulgation of Interim regulations on “Safe and flexible adaption to and effective control of COVID-19”;
Pursuant to Decision No. 4800/QD-BYT dated October 12, 2021 of the Ministry of Health on health sector in implementation of the Resolution No. 128/NQ-CP dated October 11, 2021 on promulgation of Interim regulations on “Safe and flexible adaption to and effective control of COVID-19”;
Directive No. 18/CT-UBND dated September 30, 2021 on continuation of Covid-19 control, revisions to anti-Covid measures and step-by-step economic recovery and development in Ho Chi Minh City;
Pursuant to Resolution No. 3900/QD-UBND dated November 16, 2021 of the People’s Committee of City on promulgation of Interim regulations on “Safe and flexible adaption to and effective control of COVID-19” in Ho Chi Minh City;
Pursuant to the Report No. 5204/BC-SCT dated November 15, 2021 of the Department of Industry and Trade on food and drink services in the city and the opinion of the Standing HCMC Steering Committee for Covid-19 Prevention and Control at the handover meeting of the HCMC Steering Committee for Covid-19 Prevention and Control with other provinces and cities on pandemic prevention and control on November 13, 2021; report on the results of the pilot permission of food and beverage business with the sale and consumption of alcoholic beverages in District 7 and Thu Duc City; and the proposal of the Department of Industry and Trade in Official Dispatch No. 5249/SCT-VP dated November 16, 2021 on food and beverage business;
The People's Committee of Ho Chi Minh City directs as follows:
1. Allow food and beverage establishments to resume operations on a pilot basis from November 16, 2021 to the end of November 30, 2021 provided they meet the following requirements:
a) Meet the requirements in the set of criteria for evaluation of safety and prevention against Covid-19 in food and beverage business in HCMC (promulgated together with Decision No. 3677/QD-BCD dated October 27, 2021 of HCMC Steering Committee for Covid-19 Prevention and Control).
b) Operating hours: close before 22:00 every day.
c) Specific activities corresponding to each pandemic-risk level:
+ For level-1 and level-2 risk areas: food and beverage establishments may operate in new normalcy.
+ For level-3 risk areas: food and beverage establishments may serve food and drinks on site but not exceeding 50 percent of their capacity at a time; do not sell or allow customers to use alcoholic beverages.
+ For level-4 risk areas: food and beverage establishments may only provide takeaway servives, not serve customers on premise.
2. After the pilot period, the People's Committee of Thu Duc City and the People's Committee of the districts shall review, evaluate, draw on experience and send them to the Department of Industry and Trade for filing a final report and proposal to the HCMC People’s Committee.
3. Departments, authorities and People's Committee of Thu Duc City, People's Committees of districts shall, based on the assigned tasks in Document No. 3569/UBND-KT dated October 27, 2021 of the People's Committee of HCMC to guide food and beverage businesses to implement this direction in accordance with safety requirements in the prevention and control of Covid-19 pandemic./.
