In response to Official Dispatch No. 2724/HQHP-GSQL dated June 17, 2011 of Customs Department of Hai Phong city regarding delivery of imports at a bonded warehouse to Vietnam under Incoterms 2010, below are opinions of General Department of Customs:
Incoterms 2010 are a series of commercial terms published by International Chamber of Commerce (ICC) regarding international and domestic trade; the application Incoterms must be agreed by the seller and the buyer and specified in the sale contract in order to identify obligations of the parties.
Regarding delivery terms applied to goods imported to Vietnam at a bonded warehouse: the delivery at the bonded warehouse under Delivered at Terminal (DAT) terms with specific name and location of the bonded warehouse in the importing country is conformable with Incoterms 2010. Under DAT, the seller will unload goods and place them at the buyer’s disposal at an agreed destination (the bonded warehouse); the buyer has to take the risks and pay for the import license or other official licenses and follow import procedures.
Customs Departments of Hai Phong city might post instructions on application of such terms under Incoterms 2010 at Information and Examination Center - Foreign Trade University of Hanoi for easy reference.
