On September 05, 2013, Government promulgated Decree 102/2013/ND-CP detailing implementation of a number of articles of Labor Code on foreign laborers working in Vietnam. This Decree takes effect on November 01, 2013;
In furtherance of directions of the City People’s Committee on carrying out provisions of the Government’s Decree while Circular guiding implementation of this Decree has not yet been issued by Ministries, sectors assigned tasks by Government, the Service of Labor, Invalids and Social Affairs temporarily guides procedures for employing foreign laborers within localities of the city as follows:
1. Procedures for and dossier of grant of new labor permit:
Location of receiving and settling dossiers: The Service of Labor, Invalids and Social Affairs of HCM city.
1.2. Regarding time limit for doing procedures: At least 15 working days before foreigners anticipated to work for enterprises, individuals, agencies, organizations defined at Clause 2 Article 2 of Decree 102/2013/ND-CP (abbreviated to the employer), the employer shall conduct procedures for granting labor permit for foreigners at the Service of Labor, Invalids and Social Affairs.
1.3. Dossier of granting labor permit is made according to Article 10 of Decree 102/2013/ND-CP; however, please pay attention to some following contents:
a) Regarding written request for granting labor permit of the employer, please make it according to form No. 1 enclosed with this official dispatch.
b) Regarding certificate of health defined at Clause 2 Article 10 of Decree 102/2013/ND-CP please comply with guidance of the Ministry of Health. Certificate of health may be issued in foreign country or Vietnam and considered valid within 06 months, calculated to time of submitting dossier.
c) Regarding the written confirmation on not being offender or liable to criminal prosecution prescribed at Clause 3 Article 10 of Decree 102/2013/ND-CP guided for implementation as follows:
- If a foreign laborer has resided legally in Vietnam for more 6 months, he/she must have judicial record issued by competent agency of Vietnam and a written confirmation on not being offender or liable to criminal prosecution as prescribed by foreign law issued by foreign competent agency, counted until time of submitting dossier.
- If a foreign laborer has not yet resided legally in Vietnam, he/she must have a written confirmation on not being offender or liable to criminal prosecution as prescribed by foreign law issued by foreign competent agency not exceeding 6 months counted until time of submitting dossier.
d) Regarding the written confirmation on being manager, executive director, expert or technical worker prescribed at Clause 4 Article 10 of Decree 102/2013/ND-CP temporarily guided as follows:
- For foreign laborers being experts or technical workers, they must have a written confirmation on ensuring standards defined at Clause 3 and Clause 4 Article 3 of Decree 102/2013/ND-CP
- For foreign employees being managers, executive directors, they must have one of the following papers:
+ Diplomas or certificate of having graduated from university or higher or similar qualification, or;
+ A written confirmation or labor permit or labor contract in which confirms that laborers have at least 05 years of working at management and administration position.
d) Regarding the written acceptance of chairperson of the provincial People’s Committee for using foreign labor; temporarily, while Circular guiding has not yet been issued, the Service of Labor – Invalids and Social Affairs request enterprises for making a document according to form No. 2 and No. 3 enclosed this Official Dispatch, in which clearly stating reason of failing to recruit Vietnamese laborers.
e) Copy of whole passport or valid papers replaceable for passport, in which presenting fully visa upon entry in Vietnam.
1.4. Regarding time limit of labor permit:
+ For cases of foreigners being experts, technical workers, time limit of permit shall be granted at the request of enterprises but not exceeding 24 months.
+ For cases of foreigners being managers, if they ensure one of conditions on university qualification or 5-year experience in management and administration in line with professional skills of domains they are anticipated to take over, while Circular guiding has not yet been issued, they may be granted a temporary labor permit with duration of 3 months. After Circular guiding specifies standards, if they are eligible as prescribed, time limit of permit shall be granted at the request of enterprises but not exceeding 24 months.
1.5. Time limit for settling dossiers of granting labor permit: 10 working days after submitting fully dossier in accordance with regulations.
2. Procedures for re-grant of new labor permit:
2.1. Regarding time limit for doing procedures: Please comply with Clause 1 and Clause 2 Article 15 of Decree 102/2013/ND-CP
2.2. Dossier of re-granting labor permit shall comply with Article 14 of Decree 102/2013/ND-CP however, regarding certificate of health and written acceptance of chairperson of city People’s Committee on using foreign laborers, please comply with guide at point 1.2 of this official dispatch.
Regarding form of written request for re-granting labor permit, please make it according to form No. 4 enclosed with this official dispatch.
2.3. Time limit for settling dossiers of re-granting labor permit: 3 working days after submitting fully dossier in accordance with regulations (excluding day of dossier submission).
The above content is temporary guidance on implementation of Government's Decree 102/2013/ND-CP dated September 05, 2013, detailing implementation of a number of Articles of Labor Code on foreign laborers working in Vietnam for issue of labor permit at the Service of Labor-Invalids and Social Affairs of HCM city while Circular guiding implementation has not yet been issued. After Circular guiding implementation Decree 102/2013/ND-CP is issued and takes effect for application, the process of, procedures for and dossier of grant, re-grant of labor permit for foreigners shall comply with provisions in the Circular guiding.
