In furtherance of Prime Minister’s conclusion in the Announcement No. 207/TB-VPCP dated May 20, 2014 of the Government Office and the the Prime Minister’s instruction at the Official dispatch No. 949/VPCP-KTTH dated May 30, 2014 of the Government Office and the Ministry of Finance guiding the settlement of insurance claim for companies suffering losses (within the time from May 13, 2014 to May 15, 2014) for uniform application for all non-life insurance companies/reinsurance companies (insurance companies) as follows:

1. Cause of loss:

Based on Point a, Clause 3 of Official Dispatch No. 949/VPCP-KTTH dated May 30, 2014 of the Government Office, the cause of loss is the illegal acts of rioters who have destroyed, burned and stolen property,  not due to political issues, civil commotion.

2. Claim documents include:

- Notice of loss and compensation claim;

- List of losses and evidencing documents. Where these documents are lost, the identification of loss shall be referred to the documents kept by the competent authorities concerned. The provision of documents related to the loss of property is done by the one-stop division appointed by the People’s Committee of province and city as provided for at Point a, Clause 2 of the Announcement No. 207/TB-VPCP dated May 20, 2014 of the Government Office;

- Record of damage inspection (loss)

3. Ex-gratia compensation:

In case of uncovered loss, the insurance company may consider giving an ex-gratia payment to the companies suffering loss and this expenditure shall be deducted upon calculation of corporate income tax;

4. Use of large fluctuation reserve:

The insurance companies may use their large fluctuation reserve of loss to pay compensation to the companies suffering losses in recent times;

5. Implementation:

All insurance companies are requested to follow the above instructions to pay or advance the insurance compensation for losses quickly, completely and in a timely manner;

Any problem or difficulty arising should be promptly reported to the Ministry of Finance for consideration and settlement under its authority or report to the Prime Minister;

6. AVI is requested to closely coordinate with the Ministry of Finance in urging and instructing the insurance companies to make insurance compensation
