PLAN
FOR COLLECTION AND TRANSFER TO THE NATURAL DISASTER PREVENTION AND CONTROL FUND OF THE HCM CITY APPLICABLE TO SUBJECTS AS ECONOMIC ORGANIZATIONS WITH INDEPENDENT ACCOUNTING AND CITIZENS IN THE AREAS OF THE HCM CITY IN 2015
Pursuant to the Law on natural disaster prevention and control dated 19/6/2013;
Pursuant to Decree No. 94/2014/ND-CP dated 17/10/2014 of the Government issuing the Regulation on establishment and management of natural disaster prevention and control Fund;
Pursuant to the Decision No. 2525/QD-UBND dated 28/5/2015 of the HCM City People’s Committee on establishing the natural disaster prevention and control Fund of the HCM City;
Pursuant to the Decision No. 36/2015/QD-UBND dated 24/7/2015 of the HCM City People’s Committee issuing the Regulation on management, collection-transfer, use and finalization of natural disaster prevention and control Fund of the HCM City;
Considering the recommendation of the Standing Body of Steering Committee for natural Disaster Prevention and Control, Search and Rescue of the HCM City (Department of Agriculture and Rural Development) at the Report No. 127/TTr-PCTT dated 31/7/2015 and the Official Letter No. 8076/STC-HCSN dated 22/10/2015 of the Department of Finance, the HCM City People’s Committee issues the Plan for collection and transfer to the natural disaster prevention and control fund of the HCM city applicable to subjects as economic organizations with independent accounting and citizens in the areas of the HCM city in 2015 as follows:
I. SUBJECTS AND COLLECTION RATE OF NATURAL DISASTER PREVENTION AND CONTROL FUND OF THE HCM CITY
1. Economic organizations with independent accounting (enterprises):
a) Required contribution rate:
In 2015, each enterprise must contribute two thousandths (2/10,000) over the total capital of business and production but a minimum of 500,000 dong (Five hundred thousand) and a maximum of 100,000,000 dong (one hundred million dong) and record it in the costs of production and business activities.
b) Form of collection:
- The body managing the natural disaster prevention and control Fund of the HCM city (Standing Body of Steering Committee for natural Disaster Prevention and Control, Search and Rescue of the HCM City) shall collect the money for the natural disaster prevention and control Fund of the HCM city from the joint stock companies, state enterprises, limited liability companies under the management of Department of Taxation (including the limited liability companies and one-member limited liability companies) and enterprises with foreign investment capital by the bank transfer to the account of the natural disaster prevention and control fund of the HCM city.
- The People’s Committee of districts shall collect the money for the natural disaster prevention and control Fund of the HCM city from the organizations, business households, cooperatives and types of business not subject to be collected by the body managing the natural disaster prevention and control fund of the HCM city mentioned above by bank transfer to the account of district by the authorization of the HCM city People’s Committee.
c) The number of enterprises must make contribution to the natural disaster prevention and control Fund of the HCM city in 2015 is 140,545 enterprises.
(Attached list of enterprises making contribution to the natural disaster prevention and control Fund of the HCM city in 2015 allocating to districts and Standing Body of Steering Committee for natural Disaster Prevention and Control, Search and Rescue of the HCM City for collection).
2. Citizen subjects:
Being Vietnamese citizens, males aged from 18 to 60 years and females aged 18 to 55 years who shall make contribution to the natural disaster prevention and control Fund of the HCM city in 2015 as follows:
a) Required contribution rate:
- Cadres, public servants and officers in bodies, organizations and armed forces entitled to salary and managers in state enterprises shall contribute 01 salary day/person/year based on the basic salary after deduction of all taxes and insurance payable.
- The employees in enterprises shall contribute 01 salary day/person/year based on the regional minimum salary. The area applying the regional minimum salary is specified in Decree No. 103/2014/ND-CP dated 11/11/2014 of the Government providing for the regional minimum salary for the laborers working at enterprises, cooperatives, cooperative groups, farms, households, individuals and bodies and organizations hiring employees under labor contracts (the rate of 3,100,000 dong/month applicable to enterprises operating in the areas of 19 districts and districts of Cu Chi, Hoc Mon, Binh Chanh and Nha Be; the rate of 2,750,000 dong applied to the enterprises operating in the areas of Can Gio district).
- Other employees, except for the above-mentioned subjects, shall contribute 15,000 dong/person/year.
b) Form of collection:
- The Departments, branches, sectors and units in HCM city, armed forces, Central units located in HCM city and economic organizations with independent accounting (including: Joint-stock companies, state enterprises, one-member limited liability companies) and enterprises with foreign investment capital) must collect the money contributed to the natural disaster prevention and control Fund of the HCM city from the cadres, public servants, officers and employees under their management at the prescribed rate and make transfer to the natural disaster prevention and control Fund of the HCM city.
- The People’s Committee of districts and economic organizations with independent accounting (including: organizations, business households, cooperatives and other types of enterprises not subject to being collected from the Body managing the natural disaster prevention and control Fund) must collect the money contributed to the natural disaster prevention and control Fund from the cadres, public servants, officers and employees under their management at the prescribed rate and make transfer to the account of districts by the authorization of the HCM City People’s Committee.
- The People’s Committee of wards, communes and towns must collect the money contributed to the Fund from other employees in their areas (may deduct 05% of total amount collected to pay to the persons as remuneration who go to collect the money at the wards, communes and towns and other arising administrative fees related to the collection for the Fund at the wards, communes and towns but not exceeding 05% of the annual actual revenue) and aggregate the remaining amount contributed to the Fund (95%) and transfer it to the account of district by the authorization of the HCM city People’s Committee. The collection of cash must have documents under the form of the Ministry of Finance.
c) The other organizations and individuals (including foreign organizations and individuals and international organizations operating, living or participating in natural disaster prevention and control in HCM city) are encouraged to make voluntary contribution to this Fund.
3. Cases of exemption, reduction, suspension of contribution to Fund and authority to decide the exemption, reduction, suspension of contribution to the Fund
The subjects being exempted, reduced or suspended for contribution to the Fund and the authority to decide the exemption, reduction or suspension of contribution to the Fund shall comply with the provisions in Article 3 and 4 of Decision No. 36/2015/QD-UBND dated 24/7/2015 of the HCM City People’s Committee providing for the management, collection – transfer, use and finalization of Fund.
II. TIME LIMIT FOR CONTRIBUTION TO THE NATURAL DISASTER PREVENTION AND CONTROL FUND OF THE HCM CITY IN 2015; REGULATION ON REPORT AND PUBLICITY OF COLLECTION AND TRANSFER TO THE FUND
1. Time limit for contribution to the natural disaster prevention and control fund of the HCM city in 2015
- For individuals: Make contribution to the Fund one time prior to 15/12/2015,
- For economic organizations with independent accounting: Make contribution to the Fund one time prior to 15/12/2015,
- The People’s Committee of wards, communes and towns must aggregate the total amount of money contributed to the Fund of their localities and transfer to the account of district by the authorization of the HCM City People’s Committee at the end of each month.
- The People’s Committee of districts shall aggregate the total amount of money contributed to the Fund of their localities and transfer to the account of the Fund at the end of quarter IV in 2015.
2. Regulation on report and publicity of source of collection and transfer to the Fund
Comply with the provisions in Article 9 and 11 of Decision No. 36/2015/QD-UBND dated24/7/2015 of the HCM City People’s Committee providing for the management, collection – transfer, use and finalization of Fund.
III. IMPLEMENTATION ORGANIZATION
1. The body managing the natural disaster prevention and control Fund of the HCM city (Standing Body of Steering Committee for natural Disaster Prevention and Control, Search and Rescue of the HCM City), the People’s Committee of districts, wards – communes and towns must make the collection for the Fund from the right subjects as assigned in accordance with the provisions in Section I of this Plan, absolutely avoid overlapping collection and identical subjects between the bodies collecting money for the Fund. The expenses related to the issue of notice of collection for the Fund are allocated as specified in the Official Letter No. 3406/UBND-CNN dated 18/6/2015 of the HCM City People’s Committee on approving the policy on financing the Plan for improvement of community awareness and management of natural disaster risks leaning on community in 2015 and the operating funds of the Standing Body of Steering Committee for natural Disaster Prevention and Control, Search and Rescue of the HCM City from the source of the natural disaster prevention and control Fund of the HCM City.
The People’s Committee of districts shall contact the Standing Body of Steering Committee for natural Disaster Prevention and Control, Search and Rescue of the HCM City to receive the funds related to the costs of issue of Notice of contribution to the natural disaster prevention and control Fund of the HCM City in 2015 collected by the districts.
2. Standing Body of Steering Committee for natural Disaster Prevention and Control, Search and Rescue of the HCM City (Department of Agriculture and Rural Development) shall coordinate with the HCM City Department of Finance to inspect and monitor the activities of the natural disaster prevention and control Fund of the HCM City; urge the bodies, organizations and individuals to strictly fulfill the obligation of contribution to the natural disaster prevention and control Fund of the HCM City as prescribed by law.
The Standing Body of Steering Committee for natural Disaster Prevention and Control, Search and Rescue of the HCM City shall guide the bodies, organizations and People’s Committee of districts, wards, communes and towns in collection for the Fund.
3. The People’s Committee of districts shall count the enterprises which cannot collect the contribution to the Fund (due to dissolution, change of address, not exist in reality) including the list of enterprises under operation but not yet fulfilled their obligation of contribution to the Fund; report in writing to the Standing Body of Steering Committee for natural Disaster Prevention and Control, Search and Rescue of the HCM City before 31/12/2015,
4. The Heads of Departments, branches, sectors, armed forces and Central units located in HCM city, the organizations, political-social organizations, People’s Committee of districts, wards, communes and towns, enterprises and citizens are responsible for collection and transfer to the natural disaster prevention and control Fund and publicize the implementation result in accordance with regulations./.
