REGULATION

FUNCTION, TASK, POWER, ORGANIZATION STRUCTURE AND WORK RELATIONSHIP OF THE STEERING COMMITTEES FOR NORTHWEST, CENTRAL HIGHLANDS AND SOUTHWEST REGIONS

- Pursuant to the Charter of the Communist Party of Vietnam;

- Pursuant to the Resolution of the 11th National Congress of the Communist Party of Vietnam;

- Pursuant to the working Regulation of the Central Committee, the Political Bureau and the Secretariat (eleventh tenure)

The Politburo provides for the function, task, power, organization structure and work relationship of steering committees for Northwest, Central Highlands and Southwest regions as follows:

Chapter I

FUNCTION, TASK AND POWER OF STEERING COMMITTEES

Article 1. Function and organization structure of steering committees

1- Function of steering committees:

Steering committees for Northwest, Central Highlands and Southwest regions are the affiliates of the Politburo and Secretariat which assist the Politburo, Secretariat and the Prime Minister to direct the fulfillment of tasks specified in the Article 2 of this Regulation.

2- Organization structure of Steering Committees must be defined as follows:

2.1- The Chief may be a Commissioner of the Politburo or the Deputy Prime Minister, assigned by the Politburo.

2.2- Part-time members include the provincial and municipal Committee Secretaries of the Communist Party or Presidents of People’s Committee of centrally-affiliated cities and provinces; Commanders of military regions and corps located in the area; representatives of the leadership of several ministries and Centrally-governed bodies participating in Steering Committees to work as part-time members, who may come from the Ministry of Public Security, the Ministry of National Defense, the Ministry of Foreign Affairs, Ministry of Home Affairs (Government Committee for Religious Affairs), the Ministry of Planning and Investment, the Ministry of Finance, the Ministry of Transport, the Ministry of Agriculture and Rural Development, the Ministry of Education and Training, the Ministry of Health, the Ministry of Labor, War Invalids and Social Affairs, The Ministry of Industry and Trade, the Ministry of Science and Technology, the Ministry of Natural Resources and Environment, the Office of the Government, the Central Inspection Commission, the Central Committees for organization, public relations and propagation issues, the Office of the Central Committee of the Communist Party, Vietnam Veterans Association (the northwestern Steering Committee), 2nd Military Region (the northwestern Steering Committee), 5th Military Region and 3rd Military Corps (the Steering Committee for Central Highland region), 9th Military Region (southwestern Steering Committee).

When necessary, the Secretariat shall designate additional representatives coming from the leadership of several ministries, Centrally-governed and local bodies as well as several affiliates of the Ministry of National Defence and the Ministry of Public Security, etc. that are based in the relevant regions for their participation in the Steering Committees.

2.3- The standing Committee must include:

- A commissioner of the Central Committee of the Communist Party works as the Vice Chief of the Standing Committee (if (s)he is not a commissioner of the Central Committee of the Communist Party, the Politburo and Secretariat shall make decision on this assignment) as well as full-time Vice Chiefs.

- Full-time commissioners

- The Office of the Steering Committee and special affairs such as Economy, Socio-culture, National Defence and Security, Ethnicity – Religion and Political System Construction.

3- The Central Committee for Organization Affairs shall stipulate the personnel structure of these Steering Committees.

4- Steering Committees have their own main offices and stamps.

5- Steering Committees are budget branches affiliated to the Office of the Government, who are entitled to establish the accounts in which a limit is set on how much money may be expended at the State Treasury where the Steering Committee’s full-time personnel divisions are located.

The Office of the Government shall provide favorable working conditions for the Steering Committees; estimate, allocate and balance the budget which is expended for the activities of the Steering Committees for submission to the Prime Minister to consider the approval.

6- The Communist Party subcommittee of the Standing Office of these Steering Committees is affiliated to the Communist Party Committee of Central bodies.

Article 2. Tasks and powers of the steering committees

1- Tasks

The Steering Committees shall be held accountable to the Politburo, Secretariat and the Prime Minister for their fulfillment of the following tasks:

1.1- Direct, inspect and expedite Ministries, sectors and localities to implement the resolutions, directions and decisions from the Politburo, Secretariat and the Prime Minister towards the socioeconomic development, security and national defence maintenance, ethnicity, religion and political system construction affairs in the area.

1.2- Study, advise and propose policies and regulations as well as measures that need directions from the Communist Party and Government in order to effectively carry out missions like socio-economic development, security and national defence maintenance, ethnicity, religion and political system construction affairs; regional linkage in the socio-economic development, the building and strengthening of the people's national defence and security tactics at all levels and specific regions; climate change, etc.

1.3- Direct and cooperate with functional forces and agencies at Centrally-governed and local administrative level to prevent and battle against hostile conspiracy and destruction; direct the immediate solutions to sudden situations to enhancing political security, social order and safety as well as maintaining sociopolitical stability in the area.

1.4- Organize the preliminary and final meetings and send periodic reports to the Politburo, Secretariat and the Prime Minister on the Steering Committee’s fulfillment of tasks.

2- Powers

2.1- Exercise the right to request relevant Centrally-governed ministries and bodies, the Communist Party Committee, provincial and municipal authorities in the area where the Steering Committee is managed to report the implementation of the resolutions, directions and decisions from the Central Committee of the Communist Party and the Government on the socio-economic development, security and national defence maintenance as well as the performance of ethnicity, religion and political system construction tasks in their areas.

2.2- Be entitled to attend the preliminary and final meetings over particular topics, held by the Central Committee and Government, Ministries, Centrally-governed and local bodies regarding the socio-economic development, security and national defence maintenance as well as the performance of ethnicity, religion and political system construction tasks in their areas.

2.3- Be granted access to the information and contribute their opinions on documents, issued by Ministries or Centrally-governed agencies, regarding socio-economic development, security and national defence maintenance as well as the performance of ethnicity, religion and political system construction tasks in their areas.

2.4- Entitle themselves to advise and propose particular policies to the Politburo, Secretariat and the Prime Minister, which is applied to the socio-economic, security, national defence, ethnicity, religion and political system building issues in their areas.

2.5- Have the right to get access to and contribute their opinions at important meetings or conferences held by the provincial and municipal Communist Party Committees and authorities over the master plan, socio-economic development, national defense, security, key investment projects and land-use planning, all of which are decided by the Prime Minister.

Article 3. Tasks and powers of the Chief of the Steering Committee

1- Assume the accountability to the Politburo, Secretariat and the Prime Minister for the performance of tasks; lead, organize and administrate the common tasks in the Steering Committees.

2- Direct and draw conclusions in the meetings of the Steering Committees; sum up and decide the immediate settlements on the sudden issues regarding political security, social order and safety in their areas; directly report necessary issues to the General Secretary and the Prime Minister.

Article 4. Tasks and powers of the Vice Chief of the standing Committee

1- Assist the Chief in carrying out the tasks assigned by the Steering Committee as specified in Article 3 of this Regulation; represent and assume the accountability to the Chief for their task performance; chair and give conclusions in the hand-over meetings in the Steering Committee according to their assignment decided by the Chief; advise and propose the content, program and plan for the Steering Committee’s task to the Chief; conduct periodic report and assessment on the task performance of their inferior staff; cooperate with the Office of the Government, the Office of the Central Committee of the Communist Party to provide necessary conditions for the operation of the Steering Committee; assist the Chief in giving remarks and assessments on the performance quality of members.

2- Direct the Standing Committee to cooperate with Centrally-governed ministries and agencies as well as local authorities to implement the conclusion of the Chief; report achievements to the Steering Committee in the preliminary meeting held in the first half of the year and year-end final meeting.

3- Assist the Chief and direct the operation of the Standing Committee; conduct the regular and periodic (month, quarter, half-year and year) reports to the Chief on the performance outcome of the Standing Committee and the effectiveness of directions over the task performance, which is authorized by the Chief.

4- Assist the Steering Committee in organizing the preliminary and final meetings and make periodic reports on the task performance. Direct the Standing Committee to prepare the content and organize meetings and conferences of the Steering Committee; develop the program and plan for the tasks in a quarter, half-year and year for submission to the Steering Committee to make the decision; make a timely report on the sudden and complicated situations regarding the political security, social order and safety in their areas as well as recommend any timely solution.

5- Proactively sustain the work relationship between the Steering Committee and Centrally-governed ministries, agencies and local authorities in their areas to facilitate the implementation of functions and tasks of the Steering Committee.

6- Be granted the permission to attend the meetings and conferences (whenever applicable) of the Central Committee, Politburo, Secretariat and Government.

7- Take part in the Steering Committee and Council if required.

Article 5. Tasks and powers of full-time Vice Chief

1- Assume the accountability to the Chief and Vice Chief of the Standing Committee for the following tasks:

- Get involved in developing the program and plan for task performance in a year, half of year and quarter as well as allow of the meeting contents in the Steering Committee.

- Supervise and expedite the performance of one or several sectors and special tasks in the scope of duties assumed by the Steering Committee, assigned by the Chief and Vice Chief of the Standing Committee.

- Study, advise and propose policies and measures to implement the tasks assigned by the Steering Committee; actively keep up with the actual situations and recommend the solutions to the issues that arise within the assigned sector and special task.

- Actively keep abreast of the actual situations and conduct timely reports to the Chief and Vice Chief of the standing Committee on the sudden and complicated matters regarding the political security, social order and safety in the areas; propose any measure which needs directions to perform the tasks and scope of works assigned by the Steering Committee in an effective manner.

- Keep contact with members to implement functions, tasks and powers of the Steering Committee.

2- Have access to the information and materials regarding the duties of the Steering Committee; be eligible to attend the thematic meetings, held by Centrally-governed ministries, agencies, local authorities in the areas, in accordance with the assignment given by the Chief and Vice Chief of the standing Committee.

Article 6. Tasks and powers of the full-time commissioners

1- Assume the accountability to the Vice Chief and Vice Head of the standing Committee of Specialized Divisions for the following tasks:

- Get involved in the development of the program and plan for the task performance in a month, quarter, half of year and year as well as participate in the preparation of the meeting agenda held by the Steering Committee.

- Follow up and expedite the performance of one or several sectors and special tasks in the scope of duties assigned by the Vice Chief of the standing Committee and Vice Head of sectorial and specialized divisions.

- Study, advise and propose policies and measures to implement the tasks assigned by the Steering Committee; actively keep up with the actual situations and recommend the solutions to the issues that arise within the assigned performance of sectorial and special tasks.

- Actively keep abreast of the actual situation and conduct timely reports to submit to the Vice Chief of the standing Committee and Vice Head of sectorial and specialized task divisions on the sudden and complicated matters regarding the political security, social order and safety in the areas; propose any measure which needs directions to perform the tasks and scope of works of the Steering Committee in an effective manner in the assigned areas and sectors.

2- Have the right to get access to the information and materials issued by the Steering Committee regarding the assigned duties; be eligible to attend the thematic meetings, held by Centrally-governed ministries, agencies, local authorities in the areas, which is assigned by the Vice Chief of the standing Committee or Vice Head of sectorial and specialized task divisions.

Article 7. Tasks and powers of the part-time members

Article 1. The part-time members who come from leadership of Centrally-governed ministries and agencies shall have the following tasks and powers:

- Attend the meetings held by the Steering Committee; discuss and contribute their opinions on the contents, programs and plans for the task performance of the Steering Committee.

- Study, advise and propose policies, regulations and measures that need to be directed to the Steering Committee to implement relevant missions regarding the departments and agencies in the areas in an effective manner.

- Actively implement the tasks of the Steering Committee and directions from the Chief towards the sector and special tasks within the scope of tasks and functions of their ministries and agencies; act as a key to bond ministries and agencies to the standing Committee.

- Frequently send reports to the Chief on the implementation of relevant policies, regulations and solutions to the issues that their ministries or agencies are responsible for.

- Have the right to get access to information and materials regarding their tasks and duties; receive permission to attend the conferences about socioeconomic development, security and national defense maintenance as well as ethnicity, religion and political system construction issues, held by the Steering Committee and local authorities in their areas.

2- Part-time members who are the Secretary of provincial and municipal Communist Party Committee or the People’s Committees of provinces and cities in their areas shall have the following tasks and powers:

- Participate in the meetings held by the Steering Committee; discuss and contribute their opinions about the contents, programs and plans for the task performance of the Steering Committee.

- Study, advise and propose regulations, policies and solutions that require directions to carry out missions like socioeconomic development, security, national defense maintenance as well as ethnicity, religion and political system construction task performance in their areas and throughout the region to the Steering Committee.

- Direct the local Party Committee and authorities to specify policies and measures that the Steering Committee has proposed in order to implement resolutions, directions and decisions from the Politburo, Secretariat and the Prime Minister in an effective manner.

- Send timely reports to the Steering Committee on the sudden and complicated issues about the political security, social order and safety in their areas; propose the measures that require directions to enter into the cooperation amongst different regions for handling of these issues.

- Have the right to get access to the information and materials regarding their duties and tasks; have permission to attend the meetings about relevant sectors, held by ministries and agencies in their areas.

Chapter II

WORKING RULES AND REGULATIONS OF STEERING COMMITTEES

Article 8: Rules

1- The Steering Committee shall be directly led by the Politburo, Secretariat and Prime Minster.

2- The Steering Committee shall set out the working rules of collective discussion in which all conclusions and directions are given by the Chief.

Article 9. Working regulations

1- The Steering Committee shall hold the regular meeting every 6 months and the unscheduled meeting when necessary.

2- Part-time members of the Steering Committee must spare their time to keep abreast of the actual situation as well as fulfill their assigned tasks.

3- The standing agency of the Steering Committee shall be directly led and managed by the Vice Chief of the standing Committee.

4- The standing agency of the Steering Committee shall hold a monthly meeting; every 6 months, the management of the Steering Committee shall pay a working visit to the provincial and municipal Communist Party Committee in the areas under their administration as well as hold the meeting every three months with the participation of relevant Centrally-governed agencies located in these areas with the aim of seeking the mutual consent amongst participants to the cooperation and direction over all aspects of task performance carried out by the Steering Committee.

Chapter III

WORK LOCATION AND RELATIONSHIP OF THE STEERING COMMITTEE

Article 10. Work location

1- The Northwestern Steering Committee shall take on their jobs in provinces such as Ha Giang, Lao Cao, Yen Bai, Lai Chau, Dien Bien, Son La, Hoa Binh, Cao Bang, Bac Kan, Lang Son, Phu Tho, Tuyen Quang and the districts to the west of Thanh Hoa, Nghe An

2- The Central Highland Steering Committee shall take on their jobs in provinces such as Gia Lai, Kon Tum, Dac Lac, Lam Dong, Dac Nong and mountainous districts of Quang Nam, Quang Ngai, Binh Dinh, Phu Yen, Khanh Hoa and Binh Phuoc.

3- The Southwestern Steering Committee shall take on their jobs in provinces and cities such as Can Tho, Hau Giang, Long An, Dong Thap, An Giang, Tien Giang, Ben Tre, Vinh Long, Tra Vinh, Soc Trang, Kien Giang, Bac Lieu and Ca Mau.

Article 11. Work relationship with Centrally-governed ministries and agencies

1- This relationship is signified as the mutual cooperation in order to improve the implementation of the resolutions, directions and decisions from the Politburo, Secretariat and the Prime Minister on the socioeconomic development, national defense and security maintenance as well as ethnicity, religion and political system construction task performance in the areas under their administration.

2- The Steering Committees actively exchange information with Centrally-governed ministries and agencies as well as send invitations to agencies' representatives to attend the meetings regarding the task performance of the Steering Committee.

3- All reports compiled by Centrally-governed ministries and agencies on the socioeconomic development, national defense and security maintenance as well as ethnicity, religion and political system construction task performance in provinces and cities of Northwest, Central Highlands, Southwest regions shall be submitted to the Politburo, Secretariat and Prime Minister as well as simultaneously forwarded to the Steering Committees.

Article 12. Work relationship with provinces and cities in the areas

1- Steering Committees are responsible to examine and expedite provinces and cities in the areas under their administration to implement the resolutions, directions and decisions of the Politburo, Secretariat and the Government on socioeconomic development, national defense and security maintenance as well as ethnicity, religion and political system construction task performance.

2- Direct provinces and cities in the areas to draw up specific programs and plans for the prevention and fighting against any hostile conspiracy and destructive attempts from enemies; provide immediate directions on handling sudden events regarding political security, social order and safety as well as stabilize sociopolitical conditions in the areas.

3- All reports on socioeconomic development, national defense and security maintenance together with ethnicity, religion and political system construction task performance shall be sent to the Politburo, Secretariat and the Prime Minister as well as simultaneously delivered to the Steering Committees.

Chapter IV

PERSONNEL ARRANGEMENT, ASSURANCE OF PROPER REGULATIONS AND POLICIES FOR STAFF WORKING FOR STEERING COMMITTEES

Article 13. The Central Committee for Organization Affairs shall dispatch reports to the Politburo and Secretariat on the arrangement, designation and consideration over the payroll of comrades managed by the Politburo and Secretariat; cooperate with local authorities, Centrally-governed ministries and agencies as well as work with the other Steering Committee to arrange and transfer staff to the standing agency of the Steering Committee and from the standing agency of the Steering Committee to local authorities, Centrally-governed ministries and agencies when required.

Article 14. Full-time Vice Chief, Commissioners and part-time members of the Steering Committees are eligible to receive benefits and preferences according to legal regulations.

Article 15. Other job positions shall be managed, considered and decided according to current laws and regulations.

Chapter V

IMPLEMENTATION PROVISIONS

Article 16. Steering Committees: The Steering Committees for Northwestern, Central Highlands and Southwestern regions. Centrally-governed ministries and agencies, the Communist Party Committees at all levels, provincial and municipal authorities in Northwestern, Central Highlands and Southwestern regions are responsible to implement this Regulation.

Article 17. This Regulation comes into effect from the signing date and supersedes the Regulation No.89-QD/TW dated October 3, 2007 of the Politburo (tenth tenure) and any regulation which is previously applied to Steering Committees: Northwestern, Central Highlands and Southwestern regions. In the course of implementation, should there be any amendment or modification, Steering Committees shall report and call for the decision made by the Politburo.

Article 18. Based on this Regulation, Steering Committees for Northwestern, Central Highlands and Southwestern regions shall set out and issue the work regulations for each committee in conformity with the specific condition and background of the areas under their administration.
