RESOLUTION
ADJUSTING THE 2014 LAW-AND ORDINANCE-MAKING PROGRAM OF THE XIIIth NATIONAL ASSEMBLY AND APPROVING THE 2015 LAW-AND ORDINANCE-MAKING PROGRAM
THE NATIONAL ASSEMBLY OF THE SOCIALIST REPUBLIC OF VIETNAM
Pursuant to the Constitution of the Socialist Republic of Vietnam;
Pursuant to Law No. 30/2001/QH10 on Organization of the National Assembly, which was amended and supplemented under Law No. 83/2007/QH11;
Pursuant to Law No. 17/2008/QH12 on Promulgation of Legal Documents;
Considering the National Assembly Standing Committee’s Official Letter No. 652/TTr-UBTVQH13 of May 15, 2014, on tentative adjustments to the 2014 law-and ordinance-making program of the XIIIth National Assembly and its 2015 law-and ordinance-making program, and Report No. 667/BC-UBTVQH13 of May 29, 2014, explaining and assimilating National Assembly deputies’ opinions on tentative adjustments to the 2014 law-and ordinance-making program of the XIIIth National Assembly and its 2015 law-and ordinance-making program,
RESOLVES:
Article 1
To add the following drafts to the law-and ordinance-making program of the XIIIth National Assembly:
1. The Law on Beliefs and Religions.
2. The Law Amending and Supplementing a Number of Articles of the Law on Vietnamese Nationality.
3. The Ordinance on Professional Soldiers and National Defense Workers and Personnel.
4. The National Assembly’s Resolution on preferential mechanisms for special scientific and technological research institutions.
Article 2
To adjust the 2014 law-and ordinance-making program as follows:
1. To add the following drafts to the list of drafts to be passed at the 7th session:
a/ The Law Amending and Supplementing a Number of Articles of the Law on Vietnamese Nationality (to be discussed and passed at the same session);
b/ The amended National Assembly’s Resolution on votes of confidence for holders of positions elected or approved by the National Assembly or People’s Councils (to be discussed and passed at the same session).
2. To add the draft Law on Civil Status to the list of drafts to be discussed at the 7th session and passed at the 8th session.
3. To add the draft National Assembly’s Resolution on joining international peacekeeping forces to the list of drafts to be passed at the 8th session.
4. To add the following drafts to the list of drafts to be discussed at the 8th session:
a/ The amended Law on State Audit;
b/ The Law on Special Administrative-Economic Units;
c/ The Law on Animal Health;
d/ The National Assembly’s Resolution on preferential mechanisms for special scientific and technological research institutions.
5. To transfer the following drafts from the list of drafts to be discussed at the 7th session to the list of drafts to be discussed at the 8th session:
a/ The amended Law on Organization of the Government;
b/ The amended Law on the State Budget.
6/ To withdraw the following drafts from the list of drafts to be discussed at the 8th session:
a/ The Law on Organization of Criminal Investigation Agencies;
b/ The Law Amending and Supplementing a Number of Articles of the Law on Accounting;
c/ The amended Law on Statistics.
7. To suspend from adding the following drafts to the 2014 law-and ordinance-making program:
a/ The Law Amending and Supplementing a Number of Articles of the Law on Pharmacy;
b/ The Ordinance Amending and Supplementing a Number of Articles of the Ordinance on Beliefs and Religions (for the purpose of formulating the Law on Beliefs and Religions).
Article 3
To approve the 2015 law-and ordinance-making program as follows:
I. DRAFT LAWS
1. At the 9th session
a/ The National Assembly shall pass 13 drafts, including:
1. The amended Law on Organization of the Government.
2. The Law on Organization of Local Administrations.
3. The Law on Special Administrative-Economic Units.
4. The amended Law on the Vietnam Fatherland Front.
5. The Law on Election of Deputies to the National Assembly and Deputies to People’s Councils.
6. The amended Law on the State Budget.
7. The amended Law on State Audit.
8. The Law on Promulgation of Legal Documents.
9. The amended Law on Military Obligation.
10. The Law on Marine and Island Resources and Environment.
11. The Law on Animal Health.
12. The Law on Labor Safety and Hygiene.
13. The National Assembly’s Resolution on the 2016 law-and ordinance-making program.
b/ The National Assembly shall discuss 15 drafts, including:
1. The amended Civil Code (for the second time).
2. The amended Criminal Code.
3. The amended Civil Procedure Code.
4. The amended Criminal Procedure Code.
5. The amended Administrative Procedure Law.
6. The Law on Organization of Criminal Investigation Agencies.
7. The Law on Custody and Temporary Detention.
8. The Law on Supervisory Activities of the National Assembly and People’s Councils.
9. The Law on Referendum.
10. The Law on Demonstration.
11. The Law Amending and Supplementing a Number of Articles of the Accounting Law.
12. The amended Statistics Law.
13. The Law on Information Safety.
14. The Law on Charges and Fees.
15. The Law Amending and Supplementing a Number of Articles of the Vietnam Maritime Code.
2. At the 10th session
a/ The National Assembly shall pass 16 drafts, including:
1. The amended Civil Code.
2. The amended Criminal Code.
3. The amended Civil Procedure Code.
4. The amended Criminal Procedure Code.
5. The amended Administrative Procedure Law.
6. The Law on Organization of Criminal Investigation Agencies.
7. The Law on Custody and Temporary Detention.
8. The Law on Supervisory Activities of the National Assembly and People’s Councils.
9. The Law on Referendum.
10. The Law on Demonstration.
11. The Law Amending and Supplementing a Number of Articles of the Accounting Law.
12. The amended Statistics Law.
13. The Law on Information Safety.
14. The Law on Charges and Fees.
15. The Law Amending and Supplementing a Number of Articles of the Vietnam Maritime Code.
16. The Law Amending and Supplementing a Number of Articles of the Law on Technology Transfer (to be discussed and passed at the same session).
b/ The National Assembly shall discuss 11 drafts, including:
1. The Law on Promulgation of Administrative Decisions.
2. The Law on Association.
3. The Law on Meteorology and Hydrography.
4. The amended Law on Conclusion of, Accession to, and Implementation of Treaties.
5. The Planning Law.
6. The amended Press Law.
7. The Law on Information Accession.
8. The amended Law on Child Protection, Care and Education.
9. The Law on Beliefs and Religions.
10. The Law on Asset Auction.
11. The Population Law.
II. DRAFT ORDINANCES
The National Assembly Standing Committee shall pass 2 draft ordinances, including:
1. The Ordinance on Professional Soldiers and National Defense Workers and Personnel.
2. The Ordinance on Training of a Number of Judicial Titles.
Article 4
1. Related agencies, organizations and individuals shall observe the Law on Promulgation of Legal Documents; properly implement solutions set out in the XIIIth National Assembly’s Resolutions on law-and ordinance-making program; further improve coordination among agencies and organizations in the elaboration, verification and submission of drafts to the National Assembly Standing Committee and the National Assembly so as to ensure the quality of, and schedule for preparing, drafts; and create favorable conditions for National Assembly deputies and other subjects to exercise the right to legal initiative.
2. The Government and related agencies shall promulgate documents detailing the implementation of laws, the National Assembly’s resolutions and ordinances, and the National Assembly Standing Committee’s resolutions so that such documents will take effect at the same time with relevant laws, ordinances, and resolutions; increase funds for legislative activities and ensure funds for elaboration of drafts already included in the law-and ordinance-making programs of the whole tenure and each year..
3. The National Assembly Office shall create conditions with regard to funds and other necessary material conditions; the National Assembly Standing Committee’s Institute for Legislative Studies shall assist National Assembly deputies in making and completing dossiers in accordance with the Law on Promulgation of Legal Documents for submission to the National Assembly Standing Committee and the National Assembly.
This Resolution was adopted on May 30, 2014, by the XIIIth National Assembly of the Socialist Republic of Vietnam at its 7th session.-
