Thực hiện quy định tại Điều 56 của Luật Điều ước quốc tế năm 2016, Bộ Ngoại giao trân trọng thông báo:
Nghị định thư sửa đổi Nghị định thư thực hiện Hiệp định vận tải đường bộ giữa Chính phủ nước Cộng hòa xã hội chủ nghĩa Việt Nam và Chính phủ Hoàng gia Cam-pu-chia, ký tại Phnôm-pênh, ngày 26 tháng 02 năm 2019, có hiệu lực từ ngày 26 tháng 05 năm 2019.
Bộ Ngoại giao trân trọng gửi bản sao Nghị định thư theo quy định tại Điều 59 của Luật nêu trên./.

PROTOCOL ON AMENDMENT
TO THE PROTOCOL FOR IMPLEMENTATION OF THE AGREEMENT BETWEEN THE GOVERNMENT OF THE SOCIALIST REPUBLIC OF VIET NAM AND THE ROYAL GOVERNMENT OF CAMBODIA ON ROAD TRANSPORTATION
The Government of the Socialist Republic of Viet Nam and the Government of the Kingdom of Cambodia (hereinafter to as “Contracting Parties”),
REITERATING the Agreement between the Government of the Socialist Republic of Viet Nam and the Royal Government of Cambodia on Road Transportation signed in Ha Noi on the 1st June 1998 (hereinafter to as “Agreement”);
REITERATING the Protocol for the implementation of the Agreement between the Government of the Socialist Republic of Viet Nam and the Royal Government of Cambodia on Road Transportation signed in Ha Noi on the 10th October 2005 (hereinafter to as “Protocol 2005”);
Have agreed to amend the Protocol 2005 as follows:
Article 1. The Article 8(1) and 8(2) of the Protocol 2005 shall be amended as follows:
“1. Commercial vehicles shall mean vehicles engaged in transport of goods and/or people for reward.
2. Non-commercial vehicles shall, in conformity to Article 2 of the Agreement, include those as follows:
a) Vehicles of bodies/organizations for public service;
b) Personal vehicles;
c) Vehicles of companies, cooperatives serving their own business and not engaged in transport of goods and/or people for reward.
d) Fire fighting vehicles, ambulance, rescue vehicles, and vehicles engaged in humanitarian operation.”
Article 2. The Paragraph 1 Article 12 of the Protocol 2005 shall be amended as follows:
“(1) All vehicles, engaged in cross-border transport into the territory of other Contracting Party, shall have a cross-border transport permit issued by Home Country, unless otherwise requested by an authorized body of the Contracting Party. The request shall only be made for vehicles as specified in Article 1(2)(d) of this Protocol in case of emergency.”
Article 3. The Article 83 of the Protocol 2005 shall be amended as follows:
“Article 83: Entry and Exit Points
(1) The List of International border crossing points and the other border crossing points, which subject to upgrade to International border crossing points by both Governments are appeared as Annex A1 and A2 respectively.
(2) The Contracting Parties agreed to allow the transport vehicles of the other Contracting Party to enter/exit its territory at any international border crossing points between the two countries.”
Article 4. The Article 85 of the Protocol 2005 shall be amended as follows:
“Article 85. Institutional Arrangement
1. The Contracting Parties shall authorize the following bodies/organizations to issue cross-border transport permit/registration for their respective road transport vehicles:
a) For Vietnamese side:
a.1 National Transport Facilitation Committee (NTFC);
a.2 Directorate for Roads of Viet Nam, Ministry of Transport of Viet Nam.
b) For Cambodian side:
b.1 National Transit Transport Coordinating Committee (NTTCC);
b.2 General Department of Land Transport, Ministry of Public Works and Transport.
2. NTFC of Viet Nam and NTTCC of Cambodia shall meet annually or as necessary in order to ensure the smooth implementation of the Agreement and its Protocols. The meeting shall be held alternatively in Viet Nam and Cambodia. The extraordinary meeting will be held upon request of one Contracting Party, who will be the host of the meeting.”
Article 5. This Protocol shall form an integral part of the Agreement and the Protocol 2005.
Article 6. This Protocol shall enter into force three months following its signing by both Contracting Parties, and shall be effective until the expiry of the Agreement.
In witness whereof, the undersigned, being duly authorized by their respective Governments, have signed this amended Protocol.
