CIRCULAR

PRESCRIBING PROVISION OF CAREER AND JOB CONSULTING AND START-UP SUPPORT FOR STUDENTS AT VOCATIONAL EDUCATION AND TRAINING INSTITUTIONS

Pursuant to the Law on Vocational Education and Training dated November 27, 2014;

Pursuant to the Government’s Decree No. 14/2017/ND-CP dated February 17, 2017 defining the functions, tasks, powers and organizational structure of the Ministry of Labor, War Invalids and Social Affairs;

Pursuant to the Government’s Decree No. 15/2019/ND-CP dated February 01, 2019 providing guidelines for some articles and implementation of the Law on Vocational Education and Training;

At the request of the Director General of the Directorate of Vocational Education and Training;

The Minister of Labor, War Invalids and Social Affairs hereby promulgates a Circular prescribing provision of career and job consulting and start-up support for students at vocational education and training institutions.

Article 1. Scope

This Circular deals with the provision of career and job consulting and start-up support for learners and students (hereinafter referred to as “learners”) at vocational education and training institutions.

Article 2. Regulated entities

1. This Circular applies to colleges, secondary schools, centers for vocational education and training (hereinafter referred to as “vocational education and training institutions”) and related organizations and individuals.

2. This Circular does not apply to pedagogical schools under the state management of the Ministry of Education and Training.

Article 3. Definitions

For the purposes of this Circular, the terms below shall be construed as follows:

1. “career consulting in vocational education and training” refers to an activity which is aimed at raising learners’ awareness of training disciplines and majors, labor demand for training disciplines and majors; assisting learners in choosing training disciplines and majors suitable for their competence, forte and aspirations.

2. “job consulting in vocational education and training” refers to activities which assist learners in obtaining job information from the labor market, developing their competence and expanding opportunities to find jobs appropriate to their competence, expertise and aspirations. Learners are provided with free-of-charge consulting services at vocational education and training institutions.

Article 4. Principles of implementation

1. Issues and activities related to the provision of career and job consulting and start-up support must be appropriate to learners’ age, awareness, training disciplines and majors, and training levels.

2. Training in knowledge and skills for learners specified in this Circular shall not affect training programs of vocational education and training institutions.

3. Career and job consulting and start-up support shall be provided in a manner that adopts the learner-centered approach; is associated with learners' needs and for the benefit of learners; at the same time responds to demands from the labor and job market and develop learners' skills.

4. Infrastructure and equipment must be in place to facilitate the provision of career and job consulting, and start-up support for learners; co-working spaces and start-up support spaces must be built and developed.

5. It is required to ensure a sufficient number of personnel to provide career and job consulting, and start-up support for learners at vocational education and training institutions; encourage the establishment of centers or a division affiliated to functional departments without increasing the number of personnel in charge of provision of career and job consulting, and start-up support for learners at vocational education and training institutions; encourage the formation of a network of skilled, experienced, dynamic and enthusiastic consultants.

6. Programs and documents on career and job consulting, and start-up support and training courses on necessary skills must be provided to learners and the origin of the documents must be guaranteed.

1. Assist learners in becoming self-aware of their own competence, interests, forte and career aspirations; acquiring knowledge of career and jobs in the society; future career and job trends so as for them to select appropriate disciplines and majors.

2. Raise learners’ awareness of professional attitudes, professional ethics, formulate study plans and develop professional competence.

3. Contribute to a drastic change in classification of lower secondary and upper secondary graduates into vocational education and training levels in line with national and local socio-economic development requirements.

Article 6. Career consulting

1. Provide career consulting and orientations for learners wishing to enter vocational education and training in terms of: the importance of choosing disciplines and majors; ways to discover personal strengths and cherish career dreams; training disciplines and majors; information on the network of vocational education and training institutions; benefits received when choosing vocational training; demand from the labor market.

2. Provide career consulting and orientations for learners at vocational education and training institutions in terms of: methods and skills in future career planning and some necessary skills for learners with a view to shaping their professional attitudes, professional ethics, formulating study plans and developing professional competence; benefits for employees in direct relation to training disciplines and majors; employers’ job openings for the training disciplines and majors of the learners at vocational education and training institutions.

3. Provide career consulting and orientations for graduate learners wishing to join another discipline or major or continue their study at higher educational levels in terms of training disciplines and majors; information on the network of vocational education and training institutions; several skills in flexible transformation and adaptation.

4. Other issues concerning career consulting in conformity with regulations of law.

2. Organizing career consulting and orientation seminars, conferences and forums.

3. Providing training and access to knowledge and skills for learners through club, team and group activities; extracurricular activities, experiences and exchanges at vocational education and training institutions and employers.

4. Organizing competitions to learn about the world of careers and career consulting through career consulting classes and programs.

5. Providing career information and career consulting for learners through video clips and images; through documents, publications and media.

6. Organizing training, refresher training and professional training courses to develop competence of personnel in charge of providing vocational education and training consulting.

7. Cooperating with Ho Chi Minh Communist Youth Union (HCYU) and associations in providing career consulting to HCYU members, young people and students.

8. Other methods prescribed by regulations of law.

JOB CONSULTING

1. Improve learners' understanding of job trends in the labor market.

2. Assisting learners in enabling their self-employment.

3. Provide job consulting in a manner that is appropriate to physical fitness; competence; forte; aspirations; training disciplines and majors and training levels of learners.

Article 9. Job consulting

1. Provide information on jobs related to training disciplines and majors; information on recruitment and requirements imposed by employers; labor and job policies.

2. Provide consulting, training and refresher training in interview and job finding skills and other working skills to learners.

3. Provide job consulting for learners so as to choose jobs suitable to their physical fitness, competence and aspirations; connect with employers to introduce jobs to learners.

4. Other issues concerning job consulting in conformity with regulations of law.

2. Providing refresher training in interview and job finding skills and other working skills fostering and training through club activities, seminars, forums, training classes, extra-curricular activities, visits and internships at enterprises.

3. Providing job information and job consulting for learners through video clips and images; through documents, publications and media.

4. Instructing learners to exploit recruitment database of employers, information on the labor market, assessment of skills, attitudes and adaptability to the labor market.

5. Other methods prescribed by regulations of law.

Chapter IV

START-UP SUPPORT

Article 11. Purposes

1. Promote entrepreneurship and self-employment of learners at vocational education and training institutions; provide learners with access to start-up knowledge and skills so that they are confident, proactive and creative when starting a new business and proactively enable their self-employment.

2. Improve the capacity of vocational education and training institutions in terms of their training and refresher training activities, and provision of start-up and self-employment support to learners.

Article 12. Start-up support

1. Publicize and educate learners about the role and importance of entrepreneurship, innovation, creativity and self-employment; update global education trends; local, national and international start-up education programs; start-up support policies of the State; incubators, start-up spaces, domestic and foreign start-up support funds.

2. Provide learners with training, refresher training and access to start-up knowledge and skills; improve competence of personnel and teachers providing start-up support to learners.

3. Develop programs for cooperation with enterprises, investment funds, investors, organizations and individuals in providing start-up support to learners.

4. Develop enterprise incubation programs, support learners in forming and completing start-up projects and ideas; provide consulting, support and connect learners' start-up projects with enterprises, investment funds, investors, organizations and individuals.

5. Support, facilitate and organize the Startup Kite contest.

6. Other issues concerning start-up consulting in conformity with regulations of law.

Article 13. Methods for providing start-up consulting

1. Providing start-up information and start-up education for learners through educational activities; video clips, images and publications; documents and media.

3. Developing programs and documents and providing training, refresher training and access to start-up knowledge and skills for learners.

4. Developing start-up programs and documents and organizing training, refresher training and professional training to improve competence of cadres and teachers providing start-up support for learners.

5. Establishing scientific research, innovation and start-up clubs for learners at vocational education and training institutions; building a network of alumni who have participated in starting businesses.

6. Cooperating with enterprises, organizations and individuals to create a start-up support environment; organizing start-up practice, implementing start-up projects and connecting students' feasible start-up projects with enterprise incubators.

7. Other methods prescribed by regulations of law.

Chapter V

IMPLEMENTATION

Article 14. Funding, management and use thereof

1. Funding for providing career and job consulting and start-up support is derived from state budget annually allocated in accordance with applicable regulations on hierarchical management of state budget; sources of funding obtained from national target programs, other related programs and projects; revenues from provision of public services and other revenues as prescribed by law. The management and use of funding shall comply with regulations of the Law on State Budget and relevant guiding documents. For private and foreign-invested vocational education and training institutions, the funding for providing career and job consulting and start-up support is derived from revenues of such vocational education and training institutions as prescribed by law.

Article 15. Responsibilities of the Directorate of Vocational Education and Training

1. Provide directions and guidelines for provision of career and job consulting and start-up support as prescribed in this Circular.

2. Preside over and cooperate with related units in providing career and job consulting and start-up support as prescribed in this Circular

3. Preside over and cooperate with related units in inspecting and supervising the implementation of the regulations set out in this Circular.

Article 16. Responsibilities of supervisory authorities of vocational education and training institutions

1. Instruct and direct affiliated vocational education and training institutions to formulate plans and organize the implementation of the regulations prescribed in this Circular.

2. Organize the implementation of the regulations set out in this Circular within their power.

Article 17. Responsibilities of Departments of Labor, War Invalids and Social Affairs

1. Formulate plans and submit them to provincial People's Committees for approval for guidelines and funding for providing career and job consulting and start-up support.

3. Direct and instruct vocational education and training institutions to determine quantity of graduates having jobs and quantity of learners starting their own business every year.

4. On an annual or ad hoc basis, report the provision of career and job consulting and start-up support within their provinces to provincial People's Committees and Ministry of Labor, War Invalids and Social Affairs (through the Directorate of Vocational Education and Training).

5. Perform other tasks as requested.

Article 18. Responsibilities of vocational education and training institutions

1. Formulate a plan to implement the regulations specified in this Circular to ensure practicality and efficiency; provide resources and career and job consulting, and start-up support.

2. Assist and enable learners to participate in activities related to the provision of career and job consulting, and start-up support to learners at all levels. Conduct surveys and determine quantity of graduates having jobs and quantity of learners starting their own business every year.

3. Assist and enable cadres and teachers to participate in and implement activities related to the provision of career and job consulting, and start-up support.

4. Closely cooperate with relevant authorities, organizations and associations at vocational education and training institutions in encouraging learners to actively participate in career, job and start-up-related activities.

5. Organize implementation and facilitate inspection by competent authorities and report results of implementation to Departments of Labor, War Invalids and Social Affairs and supervisory authorities on an annual or ad hoc basis.

Article 19. Effect

1. This Circular comes into force from October 15, 2022.

2. Difficulties that arise during the implementation of this Circular should be reported to the Ministry of Labor, War Invalids and Social Affairs (through the Directorate of Vocational Education and Training) for consideration and resolution./.
