DECISION
REGARDING LIST OF CHEMICALS AND ANTIBIOTICS PROHIBITED TO BE USED IN PRODUCTION AND TRADE OF FISH AND FISHERY PRODUCTS
THE MINISTER OF FISHERIES
Pursuant to Ordinance on veterinary service 2004
Pursuant to Decree 43/2003/ND-CP dated May 2nd 2003 of the Government regulating the mandate, authorities and organizational mechanism of the Ministry of Fisheries
Pursuant to Decision 3/2002/QD-BTS dated Jan. 22nd of the Minister of Fisheries regulating the promulgation of regulations on management of fish veterinary drugs
Upon request made by the Director of NAFIQAVED and the Director of Science and Technology Department
HAS DECIDED
Article 1. The list on the chemicals and anti-biotic that are prohibited to be used in production and trade of fish and fishery products (see Annex 1) and the list on the chemicals and anti-biotic that are restricted to be used in the production and trade of fish and fishery products in order to control the residues in the fishery products that are lower than allowable limits as stated in Annex 2 shall be issued in line with this Decision.
Article 2. It is prohibited to mix more than 2 types of anti-biotic active elements in one drug or chemical product. It is prohibited to mix the fluoroquinnolone-group elements together. Where one product contains 2 anti-biotic active elements, the producing unit shall have full scientific evidence and practice to ensure that such mixture does not lead to the reduction of the effectiveness of each and will not produce negative affect to the farmed fish and environment.
The feed, cleansers, veterinary drugs and fish preservation medicals shall be marked with labels according to Decision 178/1999/QD-TTg of 30/8/1999 of the Prime Minister and the Circular 3/2000/TT-BTS of 22/9/2000 of the Minister of Fisheries and a reference to “not contained the chemicals prohibited to be used according to Decision 7/2005/QD-BTS dated Feb. 24th 2005 of the Minister of Fisheries” shall be included.
Article 3. This Decision shall come into force 15 days after being posted on the Gazette and shall replace Decision 01/2002/QD-BTS dated Jan.22nd 2002 of the Ministry of Fisheries in relation to the prohibition on the use of chemicals and anti-biotic used in production and trading of fish and fishery products as well as the list on the fish veterinary drugs prohibited to be used in the aquaculture issued in line with Decision 17/2002/QD-BTS dated May 24th 2002 of the Ministry of Fisheries. The drugs listed in order from number 12 to 17 on the list shall come into force since 1/7/2005.
Article 4. The Director of NAFIQAVED shall be responsible for implementation and examination of the implementation of this Decision.
The head of Ministry’s cabinet, directors of Ministry’s Inspection, Departments and Units, director of national fisheries extension center and heads of administrative units under the Ministry, directors of Fisheries Department and Department of Agriculture and Rural Development in charge of fisheries field; individuals and organization producing, trading, importing, using of feed, veterinary drugs, chemicals, bioproducts and microorganisms used in fisheries activities shall be responsible for implementation of this Decision.
