DECISION
AMENDING AND SUPPLEMENTING THE FINANCE MINISTER’S DECISION No. 10/2003/QD-BTC OF JANUARY 24, 2003, PROMULGATING THE TARIFF OF CHARGES FOR TECHNICAL SAFETY AND QUALITY INSPECTION OF MOTOR VEHICLES AND SPECIAL-USE EQUIPMENT AND MACHINERY
THE MINISTER OF FINANCE
Pursuant to the Government’s
Decree No. 57/2002/ND-CP of June 3, 2002, detailing the implementation of the
Ordinance on Charges and Fees;
Pursuant to the Government’s Decree No. 24/2006/ND-CP of March 6, 2006,
amending and supplementing a number of articles of the Government’s Decree No.
57/2002/ND-CP of June 3, 2002, detailing the implementation of the Ordinance on
Charges and Fees;
Pursuant to the Government’s Decree No. 77/2003/ND-CP of July 1, 2003, defining
the functions, tasks, powers and organizational structure of the Ministry of
Finance;
After obtaining opinions of the Ministry of Transport in Official Letter No.
7104/BGTVT of September 26, 2008;
At the proposal of the Director of the Tax Policy Department,
DECIDES:
Article 1.- To amend and supplement the Minister of Finance’s Decision No. 10/2003/QD-BTC of January 24, 2003, promulgating the Tariff of charges for technical safety and quality inspection of motor vehicles and special-use equipment and machinery (below referred to as Decision No. 10/2003/QD-BTC) as follows:
1. To amend and supplement Clause 1, Article 5 of Decision No. 10/2003/QD-BTC as follows:
“1. Motor vehicles include automobiles, tractors, trailers and semi-trailers, motorized two-wheelers, motorized three-wheelers, mopeds, electric motorbikes and the like, including also motor vehicles for people with disabilities.”
2. To amend and supplement the provisions of the charge tariff section in Decision No. 10/2003/QD-BTC as follows:
2.1. To amend and supplement Tariff 1, Section I on charges for technical safety inspection of motor vehicles currently in circulation as follows:

2.2. To amend and supplement Clause 3, Section I on charges for technical safety inspection of motor vehicles currently in circulation as follows:
“3. The charge for inspection of motor vehicles for the grant of provisional technical safety and environmental protection certificates (valid for no more than 15 days) is equal to that specified in Tariff 1.”
2.3. To amend and supplement Tariff 3, Section III on charges for technical safety and quality inspection of motor vehicles and special-use vehicular machinery in transformation as follows:

2.4. To amend and supplement Section IV on charges for quality inspection of parts and motor vehicles tested for manufacture and assembly as follows:

2. The charge specified at Point 8 of Tariff 4 for testing of many models of the same type or kind must not exceed VND 2,000,000/type or kind.
3. The charges specified in Tariff 4 also apply to the quality inspection in testing the following items for import:
- Testing overall safety requirements for motorcycles and mopeds,
- Testing frames or engines used for motorcycles and mopeds,
- Testing other parts of motorcycles and mopeds.”
2.5. To amend Clause 3, Section V as follows: “For motor vehicles and special-use equipment and vehicular machinery subject to design approval, the design approval charge is equal to 8% of the design cost, but must be at least VND 1,000,000/design.”
2.6. To amend and supplement Section VII on charges for quality inspection of motor vehicle-inspecting equipment as follows:
“1. Basic charge:

2. If, through inspection, equipment fails to satisfy manufacturer standard and must be repaired, adjusted and re-inspected, the re-inspection charge is equal to 50% of that specified in Tariff 7.
3. In case inspecting equipment suddenly break down and must be repaired and re-inspected ahead of schedule, the inspection charge specified in Tariff 7 will apply.
4. The charge for inspection and checking for notification of the quality of motor vehicles and special-use equipment and vehicular machinery is equal to that specified in Tariff 7.”
Article 2.- This Decision takes effect 15 days after its publication in the Gazette.
Article 3.- Organizations and individuals liable to pay charges, inspecting agencies and concerned agencies shall implement this Decision.
