DECISION

ON THE AMENDMENT, SUPPLEMENT OF SEVERAL ARTICLES OF THE REGIME ON DELIVERY AND RECEIPT, PRESERVATION, TRANSPORT OF CASH, PRECIOUS ASSETS AND VALUABLE PAPERS ISSUED IN CONJUNCTION WITH THE DECISION NO. 60/2006/QD-NHNN DATED 27 DECEMBER 2006 OF THE GOVERNOR OF THE STATE BANK

THE GOVERNOR OF THE STATE BANK

- Pursuant to the Law on the State Bank of Vietnam issued in 1997 and the Law on the amendment, supplement of several articles of the Law on the State Bank of Vietnam issued in 2003;
- Pursuant to the Decree No.52/2003/ND-CP dated 19/5/2003 of the Government providing for the function, assignment, authority and organizational structure of the State Bank of Vietnam;
- Pursuant to the Decree No. 81/1998/ND-CP dated 1 October 1998 of the Government on printing, coining, preservation, transport and destroying of paper money, coins; preservation, transport of precious assets and valuable papers within the banks system;
Upon the proposal of the Director of the Issuing and Vault Department,

DECIDES:

Article 1. To amend, supplement several articles of the Regime on delivery and receipt, preservation, transport of cash, precious assets and valuable papers issued in conjunction with the Decision No. 60/2006/QD-NHNN dated 27 December 2006 of the Governor of the State Bank as follows:

1. Paragraph 1, Article 21 shall be amended, supplemented as follows:

1. Managers of the State Bank branches in provinces, cities under the central Governments management, Directors of credit institutions shall be entitled to authorize, in writing, Deputy Managers; Chiefs of the Issuing and Vault branches shall be entitled to authorize Deputy Chiefs in writing; Deputy Director of the Issuing and Vault Department (who is assigned to manage the vault) shall be entitled to authorize the Chief Treasurer of the Vault I (where one of the two persons who is Deputy Director of the Issuing and Vault Department, assigned to manage the vault or the Chief Treasurer of the Vault I is absent, the Deputy Director of the Issuing and Vault Department who is assigned to manage the vault shall be entitled to authorize the Deputy Chief Treasurer of the Vault I in writing on basis of each time) to perform the duties of managing cash, precious assets, valuable papers and vault in a specific period of time. The authorized persons shall be responsible to the Managers, Chief of the Issuing and Vault branch and Deputy Director of the Issuing and Vault Department for the management of cash, precious assets, valuable papers and vault in accordance with this Regime and related provisions of applicable laws.

2. Article 47 shall be amended, supplemented as follows:

Article 47. Transport means for special goods

1. It is required to use specialized vehicles or specialized transport means to transport special goods.

2. Where a credit institution uses another vehicle for transporting special goods, Chairman of the Board of Directors of the credit institution shall decide on, in writing, and provided for the process of transport, protection, security measures for the assets.

3. In unexpected case or where the amount of transport and value of assets are large, or in case of the long way transport that requires to hire other transport means such as: plane, train, ship, they shall be decided upon by the Governor of the State Bank (for assets of the State Bank) or by the Chairperson of the Board of Directors of the credit institution (for assets of the credit institution).

4. In unexpected case where the amount of transport is small, if the State Bank branches in provinces, cities under the central Governments management wish to directly deliver and receive special goods of the State Bank at Central Vault and are capable of arranging, by themselves, transport means for special goods (specialized vehicles), they must be approved by the Director of the Issuing and Vault Department.

Article 2. This Decision shall be effective after 15 days since its publication in Official Gazette.

Article 3. The Director of the Administrative Department, the Director of the Issuing and Vault Department, the Director of Finance - Accounting Department, Head of related units of the State Bank, General Manager of the State Bank branch in provinces, cities under the Central Governments management shall be responsible for the implementation of this Decision.
