RESOLUTION

ADOPTING THE 2009 LAW- AND ORDINANCE -MAKING PROGRAM AND SUPPLEMENTING THE LAW- AND ORDINANCE-MAKING PROGRAM FOR THE XIITH NATIONAL ASSEMBLY (2007-2011) TENURE

THE NATIONAL ASSEMBLY OF THE SOCIALIST REPUBLIC OF VIETNAM

Pursuant to the 1992 Constitution of the Socialist Republic of Vietnam, which was amended and supplemented under Resolution No. 51/2001/NQ-QH10 bổ sung điều của Hiến pháp nước cộng hoà xã hội chủ nghĩa Việt Nam năm 1992">51/2001/QH10;
Pursuant to the Law on Organization of the National Assembly and the Law on Promulgation of Legal Documents;
After examining the National Assembly Standing Committees Report No. 160/TTr-UBTVQH12 of October 17, 2008, on the tentative 2009 law- and ordinance-making program and considering opinions of National Assembly deputies,

RESOLVES:

Article 1. To add to the law- and ordinance-making program of the XIIth National Assembly (2007-2011) the following bills and draft ordinances:

1. The Bill Amending and Supplementing Article 126 of the Housing Law

2. The Bill Amending and Supplementing a Number of Articles of Laws Concerning Capital Construction Investment

3. The Bill on Economical and Efficient Use of Energy

4. The Bill on Civil Servants

5. The Bill Amending and Supplementing a Number of Articles of the Education Law

6. The Bill on Trade Union (amended)

7. The Ordinance on Unification of Legal Documents

8. The Ordinance on Codification of the System of Legal Documents

9. The Ordinance Amending and Supplementing a Number of Articles of the Ordinance on Procurators of Peoples Procuracies

10. The Ordinance Amending and Supplementing a Number of Articles of the Ordinance on Judges and Jurors of Peoples Courts

11. The Ordinance Amending and Supplementing a Number of Articles of the Ordinance on Organization of Criminal Investigation

12. The Ordinance Amending and Supplementing Article 10 of the Population Ordinance.

Article 2. To adopt the 2009 law- and ordinance making program as follows:

A. OFFICIAL PROGRAM

Article 3.

1. To assign the National Assembly Standing Committee to direct the implementation of the 2009 law- and ordinance-making program.

2. The Government shall clearly identify responsibilities of agencies in charge of, and agencies participating in, the elaboration of bills and draft ordinances, spend appropriate time on discussing and commenting on bills and draft ordinances to be submitted to the National Assembly and the National Assembly Standing Committee in accordance with the Law on Promulgation of Legal Documents.

3. Law- and ordinance-drafting agencies and law- and ordinance-submitting agencies shall draw up plans, ensuring that bills or draft ordinances are of good quality and submitted on schedule; and strictly observe the law-prescribed time limits for sending bills and draft ordinances to verifying agencies, the National Assembly Standing Committee and the National Assembly.

4. The Council for Ethnic Minorities and Committees of the National Assembly shall take the initiative in closely coordinating with law- and ordinance-drafting agencies and relevant agencies and organizations in improving the quality of bills and draft ordinances and verification reports.

National Assembly delegations and deputies shall spend appropriate time on studying, discussing and commenting on bills and draft ordinances for their finalization.

This Resolution was adopted on November 15, 2008, by the XIIth National Assembly of the Socialist Republic of Vietnam at its 4th session.
