DECISION
ON FEES AND CHARGES FROM RADIATION SAFETY AND CONTROL MANAGEMENT ACTIVITIES AND THEIR USAGE
THE MINISTER OF FINANCE
Pursuant to the Decree No. 57/2002/ND-CP issued by the Government, dated 03 June 2002, detailing the implementation of the Ordinance on Fees and Charges;
Pursuant to the Decree No. 24/2006/ND-CP issued by the Government, dated 6 March 2006, amending and supplementing the Decree No. 57/2002/ND-CP issued by the Government, dated 03 June 2002, on detailing the implementation of the Ordinance on Fees and Charges;
Pursuant to the Decree No. 50/1998/ND-CP issued by the Government, dated 16 July 1998, detailing the implementation of the Ordinance on Radiation Safety and Control;
Pursuant to the Decree No. 77/2003/ND-CP issued by the Government, dated 01 July 2003, specifying the Ministry of Finance’s functions, responsibilities, authorities and organization structure;
Receiving consultation from the Ministry of Science and Technology in the Note No. 3373/BKHCN-PC dated 8 December 2005, and Note No. 991/BKHCN-PC dated 26 April 2006;
Considering the proposal by the Director of the Department of Tax Policy,
DECIDES:
Article 1. Issuing the Fees and Charges Obtained from Radiation Safety and Control Management Activities and Their Usage in accompany with this Decision;
Article 2. Vietnamese and foreign organisations and individuals who apply for Registration or License for conducting radiation work regulated in Decree No. 50/1998/ND-CP issued by the Government, dated 16 July 1998, detailing the implementation of the Ordinance on Radiation Safety and Control shall pay fees and charges in radiation safety and control as specified in this Decision.
Article 3. The fund from fees and charges in radiation safety and control management activities shall be paid to the national treasury and managed and used as follows:
1. The State Regulatory Authority in radiation safety and control as stipulated in Decree No. 50/1998/ND-CP (hereinafter called as the fee and charge collecting agency) shall have 85% (eighty-five percents) of the fund from the collected charges to cover the cost in radiation verification activities. The charges shall be collected as pre-cribed in Article 8 of the Circular 45/2006/TT-BTC dated 25/5/2006 issued by the Ministry of Finance, which amend and supplement the Circular No. 63/2002/TT-BTC issued by the Ministry of Finance, dated 24 July 2002, detailing the implementation of the Ordinance on Fees and Charges;
2. The collecting agency has the responsibility to pay 100% (one-hundred percents) of the fund collected from the fee to the national treasury and 15% (fifteen percents) of the fund collected from the charge in accordance with the Government Budget Index.
Article 4. This Decision shall enter into force in fifteen days after the date the Decision is announced in the Official Gazette.
Article 5. Other issues relating to payment, collection, management and usage of the fee and charge that are not covered in this Decision shall be complied with the Guidelines of Circular No 63/2002/TT-BTC issued by the Minister of Finance, dated 24 July 2002.
Article 6. Any issues arising from the implementation of this Decision shall be promptly reported to the Ministry of Finance for consideration.

Note:
1. Category 1 is radiation sources and equipment with low radiation hazardous level, including:
a) Sealed sources used for calibration or test with activity not higher than 40Mbq;
b) Sealed sources in a compact analysing instrument;
c) Sealed sources with activity not higher than 400Mbq in a fixed nuclear-measuring instrument;
d) Sealed sources in a bone density measuring instrument;
dd) Mammography equipment;
e) Dental diagnostic radiology equipment;
g) Bone density radiology equipment;
h) Veterinary diagnostic radiology equipment;
i) Completely-sealed analyzing radiology equipment;
k) Luggage-checking radiology equipment;
l) Mobile medicine radiology equipment;
m) Other sealed sources with activity not higher than 40Mbq not specified in this annex.
2. Category 2 is radiation sources and equipment with medium radiation hazardous level, including:
a) Sealed sources used for calibration or test with activity higher than 40Mbq;
b) Sealed sources in blood irradiator;
c) Sealed sources in a partly-closed analysing instrument;
d) Sealed sources with activity higher than 400Mbq in a fixed measuring instrument;
dd) Sealed sources in a mobile gauging equipment;
e) Sealed sources used in nuclear medicine for diagnosis and veterinary diagnosis;
g) Industrial radiography equipment;
h) Fixed radiology equipment used in medicine including: flouroscopy, tomography and chiopratic;
i) Partly-closed gauging radiology equipment;
k) Simulators in radiotherapy;
l) CT scanners;
m) Sources used in industrial radiography equipment;
n) Sources used in radiotherapy and veterinary radiotherapy;
o) Sources used in well-logging and geology;
p) Other sealed sources with activity higher than 40 Mbq not specified in this annex;
q) Other radioactive sources not specified in this annex;
r) Ionising radiation equipment not specified in this annex.
3. Category 3 is radiation sources and equipment with high radiation hazardous level, including:
a) Radiotherapy equipment used in medicine and veterinary;
b) Radioactive sources and industrial radiography equipment.
4. In case that a facility requests safety verification for licensing for conducting radiation work using more than one source or licensing for conducting radiation work with more than one radiation work, the cost shall be calculated as follows:
a) For an application that involves 2 to 3 radiation sources or radiation related works, for each of the sources the rate shall be 95% of that in the above table;
b) For an application that involves 4 to 5 radiation sources or radiation related works, for each of the sources the rate would be 90% of that in the above table;
c) For an application that involves 6 radiation sources or works related to radiation or more, for each of the sources the rate would be 85% of that in the table;
d) The total fees for safety verification for licensing for conducting radiation work shall not be more than 30 million dongs.
Example: A facility applies for a license for upgrading radiation equipment and radiation waste transportation, the fee shall be: 95% x (1.000.000 + 3.000.000) = 3.800.000 d.
5. Charge for safety verification for renewal or extention of licenses, shall be 25% of the charge for safety verification for licensing as prescribed in the above table.

Note: Renewal or amendment of a licence or a registration shall be charged with 100% of the fee charged for authorisation of a new licence or a new registration.
