DECISION

APPROVING THE OVERALL PLANNING AND INVESTMENT PROJECT ON THE FIRST-PHASE CONSTRUCTION OF HO CHI MINH CITY HIGH-TECH PARK

THE PRIME MINISTER

Pursuant to the December 25, 2001 Law on Organization of the Government;
Pursuant to the Government’s Decree No. 36/CP of April 24, 1997 promulgating the Regulation on industrial parks, export-processing zones and hi-tech parks;
Pursuant to the Regulation on Construction and Investment Management, issued together with the Government’s Decree No. 52/1999/ND-CP of July 8, 1999 and the amendments and supplements to a number of articles of this Regulation, issued together with the Government’s Decree No. 07/2003/ND-CP of January 30, 2003;
Pursuant to the Prime Minister’s Decision No. 145/2002/QD-TTg of October 24, 2002 on the establishment of Ho Chi Minh City Hi-tech Park under the People’s Committee of Ho Chi Minh City;
Pursuant to the Prime Minister’s Decision No. 146/2002/QD-TTg of October 24, 2002 on setting up the Managing Board of Ho Chi Minh City Hi-tech Park under the People’s Committee of Ho Chi Minh City;
At the proposal of the People’s Committee of Ho Chi Minh City in Report No. 4210/TTr-UB of November 29, 2002 and appraisal opinions of the State Council for Evaluation of Investment Projects in Official Dispatch No. 20/TDNN of February 14, 2003 approving the report on overall planning and feasibility study on Ho Chi Minh City Hi-tech Park,

DECIDES:

Article 1.- To approve the overall planning on Ho Chi Minh City Hi-tech Park with a total area of 804 ha in the areas of Tan Phu, Hiep Phu, Tang Nhon Phu A, Tang Nhon Phu B, Long Thanh My and Phuoc Long B wards, District 9 of Ho Chi Minh City.

The People’s Committee of Ho Chi Minh city shall direct the finalization of the overall planning on Ho Chi Minh City Hi-tech Park according to the opinions of the State Council for Evaluation of Investment Projects in Official Dispatch No. 20/TDNN of February 14, 2003.

Article 2.- To approve the investment project on the first-phase construction of Ho Chi Minh City Hi-tech Park with following main contents:

1. The project shall be implemented on an area of 298 ha at the location stated in Article 1, which may be adjusted and/or expanded, depending on the practical situation on investment attraction.

2. The implementation duration is expected to last until 2008.

3. Major work items:

a) Organizing the work of compensation, relocation and ground clearance for the whole area of 804 ha under the overall planning with the total estimated capital of VND 2,170 billion.

b) Building essential technical infrastructure: traffic, water supply and drainage, electricity supply, waste treatment, greenery, telecommunications and Internet connection gates with an estimated capital of VND 442 billion.

c) Building and putting into operation a hi-tech industrial sub-zone on the basis of giving priority to the attraction of foreign investment and strong conglomerates.

d) Building an enterprises’ nursery and organizing the provision of accompanied services, attracting all subjects having technological ideas therein to study and finalize their technologies, conduct the experimental manufacture of their products and set up enterprises.

e) Building some works in service of the managerial work; work in service of accommodation and activities of subjects working in the hi-tech park, suitable to the demand and development tempo of the hi-tech park.

4. The source of investment capital for the project includes State budget, ODA capital, credit, mobilized capital and other capital sources, which shall be determined specifically on the basis of the component projects thereof and current regulations.

5. To study and elaborate some schemes related to the organization and operation of Ho Chi Minh City Hi-tech Park and submit them to competent authorities for consideration and decision; to carry out preparatory steps for the formulation of the project on the second-phase construction of Ho Chi Minh City Hi-tech Park according to current regulations on investment and construction.

Article 3.- Responsibilities of the concerned ministries and agencies

1. The People’s Committee of Ho Chi Minh city shall direct the realization of the above-stated contents; organize the formulation and approval of the detailed planning on the first-phase construction investment project according to the current regulations; direct the determination of component projects as well as capital and investment capital sources therefor; and decide on investors of these projects in compliance with the current regulations on investment and construction.

2. The Ministry of Planning and Investment shall assume the prime responsibility and coordinate with the People’s Committee of Ho Chi Minh city, the Finance Ministry and the Science and Technology Ministry in determining items of the first-phase construction investment project which shall be invested with the State budget capital source, the proportion of capital apportion between the central budget and Ho Chi Minh city’s budget and submit them to the Prime Minister for consideration and decision.

3. The Ministry of Science and Technology shall perform the function of State management over Ho Chi Minh City Hi-tech Park regarding high technologies.

Article 4.- This Decision takes effect 15 days after its publication in the Official Gazette.

Article 5.- The Ministers of Science and Technology; Planning and Investment; Finance; Construction; Natural Resources and Environment; Industry; Agriculture and Rural Development; and Defense, the Governor of Vietnam State Bank; the president of the People’s Committee of Ho Chi Minh city and the head of the Managing Board of Ho Chi Minh City Hi-tech Park shall have to implement this Decision.
