ANNOUNCEMENT
GUIDELINES ON EXPORTS OF TROUSERS (CAT. 6) TO THE EU MARKET IN 2004
On October 28th, 2003 the Ministry of Trade in conjunction with the Ministry of Industry have issued an Inter-Ministerial Circular No. 08/2003/TTLT/BTM/BCN providing guidelines on allocating and implementing of exports quotas to the EU, Canadian and Turkish markets in 2004. The export activities thereby shall be performed in accordance with automatic Export Licenses issued by export import management bodies under the Ministry of Trade.
However, pursuant to the Agreement on trade in Textiles with the EU, the quota of trousers (cat.6) granted for Vietnam is limited (only for 8.000.000 units) despite large demand for production and export of enterprises. In accordance with statistics given by export import management bodies under the Ministry of Trade, during last months of 2003 enterprises have exported more than 1.5 millions pairs of trousers per month. Some of them exported shorts and trousers in huge volume but at very low export (F.O.B.) price. If in 2004 the export of products in cat. 6 keeps performing at the same manner shown in the past last months of 2003, quota for the whole year of 2004 will be sufficient for 5-6 months only. This factor may have negative effects on production and export of Vietnamese textile products, quality of products, especially in terms of maintaining long-term clients, and reduce export volume.
To overcome aforesaid difficulties, the Ministry of Trade in conjunction with the Ministry of Industry provide respective guidelines on exports of trousers (cat.6) to the EU markets as follows:
1. Reserve 30% of export quotas in Cat.6 to the EU markets for enterprises having contracts concluded with the EU traders, clients originated from the EU; and those having orders with further use of domestic fabric materials. The enterprises with demands shall send a letter (form is attached) to the Ministry of Trade for consideration and making respective decisions.
2.As to the remaining portion of quotas (i.e 70%), the automatic Exports License pursuant to para. 1, Art.II of the Inter-Ministerial Circular No. 08/2003/TTLT/BTM/BCN dated October 28th 2003 will be granted as normal.
3.From March 1st, 2004 do not grant automatic Exports License to lots of products with export price (F.O.B) lower than USD2.5/per pair.
The Ministry of Trade hereby inform to all enterprises for further knowledge and implementation. During the implementation if any difficulty emerges, timely inform the Ministry of Trade to settle down the issue.

Notes:
1. Attached dossier shall include documents stated in columns (4); (6) and (7) marked with “Copy from Original” and signed by the Head of enterprise.
2. As to enterprises with textile capacity and use of self-produced fabrics, the documents stated in columns (6) and (7) can be replaced by the Warehouse Notes showing dispatching of fabrics from the knitting department to the sewing department (or similar documents), marked “Copy from Original” and signed by the Head of enterprise.
3. Do not consider contracts/invoices on sale of fabrics concluded with enterprises of mere trading functions, i.e without textile production capacity.
4. Only invoices for sale of fabrics issued after September 30th, 2003 will be considered.

- Pursuant to the Inter-Ministerial No. 08/2003/TTLT/BTM-CN of the Ministry of Trade and the Ministry of Industry issued on 28th of October 2003 providing guidelines on allocation and implementation of export quotas on trousers (cat.6), domestically produced fabrics, to the EU market in 2004; and Dispatch No. 5938TM/XNK dated 25th December 2003 (enterprise’s name) would like to request Ministries for allocation of export quota of trousers (cat.6) to the EU in 2004 in order to enable enterprise to successfully perform its duties under contracts, directly concluded with the EU customers as follows:
