CIRCULAR
ON PROMULGATION OF AMENDMENT 1:2016 TO QCVN 4:2009/BKHCN - NATIONAL TECHNICAL REGULATIONS ON SAFETY FOR ELECTRICAL AND ELECTRONIC APPLIANCES
Pursuant to the Law on Standards and Technical Regulations dated June 29, 2006;
Pursuant to Decree No. 127/2007/ND-CP dated August, 01, 2007 of the Government on detailed regulations of certain articles of the Law on Standards and Technical Regulations;
Pursuant to Decree No. 20/2013/ND-CP dated February 26, 2013 of the Government on the functions, duties, powers, and organizational structure of the Ministry of Science and Technology;
At the request of the Director of the Directorate of Standards, Metrology, and Quality and the Director of the Department of Legal Affairs;
The Minister of Science and Technology promulgates a Circular on "Promulgation of Amendment 1:2016 to QCVN 4:2009/BKHCN - National Technical Regulations on Safety for Electrical and Electronic Appliances;
Article 1. Enclosed with this Circular is Amendment 1:2016 to QCVN 4:2009/BKHCN - National Technical Regulations on Safety for Electrical and Electronic Appliances.
Article 2. This Circular does not apply to:
1. Electrical wires and cables which have already been installed in electrical and electronic equipment or are parts of complete pieces of electrical and electronic equipment.
2. Electrical wires and cables that are imported to be installed in electrical and electronic equipment and then exported (export processing, temporary imported goods for re-export).
Article 3. This Circular will come into force from February 01, 2017.
Article 4. From August 01, 2008, electrical wires and cables which are manufactured, imported and sold on the market shall comply with regulations of Amendment 1:2016 to QCVN 4:2009/BKHCN.
Article 5. Implementation
1. The Directorate of Standards, Metrology, and Quality is responsible for providing guidance and implementation of this Circular
2. At the request of the Director of the Directorate of Standards, Metrology, and Quality and the Director of the Department of Legal Affairs, and relevant entities which are responsible for compliance with this Circular;
3. Any issues that arise during the implementation should be promptly reported in writing to the Ministry of Science and Technology.

National technical regulations on safety for electrical and electronic appliances
Introduction
Amendment 1:2016 to QCVN 4:2009/BKHCN amends certain provisions of the National Technical Regulations
Amendment 1:2016 to QCVN 4:2009/BKHCN is drafted by the Drafting Board of the National Technical Regulations on low-voltage wires and cables, submitted by the Directorate of Standards, Metrology, and Quality, and promulgated together with Circular No. 21/TT-BKHCN dated December 15, 2016 of the Minister of Science and Technology.

2. SAFETY REQUIREMENTS
1. Clause 2.10 is amended as follows:
“2.10. Electrical wires and cables running at voltages of not less than 50 volts are specified at Clause 2.10 as follows:
a. Manufacturers and importers of electrical wires and cables shall announce standards applied to their products. The announced standards shall be the Vietnam’s Standards (TCVN) or national standards of other countries, international standards, or regional standards. At least the announced standards shall include the following basic criteria:
- The direct current resistance of the conductor
- Sheath and insulation thickness
- Insulation resistance
- Voltage endurance
- Tensile strength test of the insulation and sheath before and after aging.
Criteria for sheath and/or insulation do not apply to electrical wires without any sheath and/or insulation.
b. Labeling of electrical wires and cables shall meet the following minimum requirements:
- Origins and other information about the wires and cables which include voltage classification, conductive and insulation materials, diameter, and code/types shall be specified;
- The label contents shall not be easily erased shall be clear, and easily distinguished;
- The distance between the starting point and the next starting point of labels on a wire/cable shall comply with the announced standards. If such distance is not defined by any applied standards, it shall not exceed 1,000 mm or the ending point of a label and the starting point of the next one shall not exceed 550 mm.
Besides that, labeling shall conform to regulations on goods labeling.
Manufacturers and importers of electrical wires and cables with a voltage classification of under 50V shall announce standards applying to them.
Labeling electrical wires and cables shall specify corresponding voltage classification.
3. MANAGEMENT REQUIREMENTS
2. Clause 3.1 is amended as follows:
“3.1 Launching
Domestic and imported electrical and electronic appliances which exclude electrical wires and cables running at voltages of less than 50 volts and more than 100 volts shall be granted certificates of conformity with relevant requirements on safety defined in Section 2, bear the conformity mark (CR), and managed in adherence to current regulations before being launched.
3. Clause 3.2 is amended as follows:
“3.2.3. recognition of certification results of foreign certification bodies shall comply with regulations in Circular No. 27/2007/BKHCN dated October 31, 2007 of the Minister of Science and Technology which provides guidance for signing and compliance with agreements on mutual recognition of technical regulation conformity certification results.
Before recognizing a technical regulation conformity certification result or testing for technical regulation conformity certification, the certifying body shall ensure that its capacity meets requirements and submit a report to the Directorate of Standards, Metrology, and Quality.
4. Clause 3.3 is amended as follows:
“The appointment of a foreign organization to assess conformity of electrical and electronic appliances shall abide by regulations in Circular No. 26/2013/TT-BKHCN dated November 15, 2013 of the Minister of Science and Technology which specifies the requirements, order, and procedure to appoint a suitable foreign body for technical regulation conformity evaluation for goods and products according to the National Technical Regulations promulgated by the Ministry of Science and Technology".
5. Clause 3.5 is amended as follows:
“3.5 Registration
3.5.1 After getting the certificate of conformity, the manufacturer of electrical and electronic appliances shall get its declaration of conformity registered at the Department of Standards, Metrology, and Quality of the province where it is registered before launching their products according to regulations in Circular No. 28/2012/TT-BKHCN dated December 12, 2012 of the Minister of Science and Technology which regulates announcement of technical regulation conformity and evaluation methods.
The application for registration of the declaration of conformity is specified in Article 14 of Circular No. 28/2012/TT-BKHCN dated December 12, 2012 of the Minister of Science and Technology that regulates announcement of technical regulation conformity and evaluation methods.
3.5.2. After getting the certificate of conformity, the importer of electrical and electronic appliances shall apply for quality inspection at the Department of Standards, Metrology, and Quality according to regulations in Circular No. 27/2012/TT-BKHCN dated December 12, 2012 of the Minister of Science and Technology which regulates State inspection of imported goods quality that the Ministry of Science and Technology is in charge of.

6. Clauses 3.5.3, 3.5.4, and 3.5.5 are abolished
4. Article 15. Responsibilities of enterprises
7. Clause 4.3 is amended as follows:
“Every manufacturer and importer of electrical wires and cables shall retain copies of the standards applied to their electrical wires and cables and provide them for competent authorities if requested.
The language of the standards can be Vietnamese or English. If it is in English, it shall be enclosed with an official Vietnamese translation. The enterprise shall take responsibility for the accuracy of this Vietnamese translation.
Enterprises shall retain documents about their applied standards”.
