CIRCULAR
PRICE CEILINGS FOR HEALTH QUARANTINE SERVICES AND PREVENTIVE MEDICINE SERVICES PROVIDED BY PUBLIC HEALTH FACILITIES
Pursuant to the Law on fees and charges No. 97/2015/QH13 dated November 25, 2015;
Pursuant to the Government’s Decree No. 177/2013/ND-CP dated November 14, 2013 detailing and guiding the implementation of the Law on pricing;
Pursuant to the Government’s Decree No. 149/2016/ND-CP dated November 11, 2016 on amendments to the Government’s Decree No. 177/2013/ND-CP dated November 14, 2013 detailing and guiding the implementation of the Law on pricing;
Pursuant to the Government’s Decree No. 215/2013/ND-CP dated December 23, 2013 defining functions, tasks, powers and organizational structure of Ministry of Finance;
At the request of the Director of the Department of Price Management;
Minister of Health promulgates a Circular providing for price ceilings for health quarantine services and preventive medicine services provided by public health facilities.
Article 1. Scope and regulated entities
1. Scope:
This Circular introduces the price ceilings for health quarantine services and preventive medicine services provided by public health facilities.
2. Regulated entities:
Public health facilities providing health quarantine services and preventive medicine services, service users, and relevant authorities, organizations and individuals.
Article 2. Price ceilings for health quarantine services and preventive medicine services provided by public health facilities
1. Price ceilings for health quarantine services and preventive medicine services provided by public health facilities are provided in the Appendix enclosed herewith.
If a price is prescribed in USD, the exchange rate between USD – VND shall be the USD buying rate in the form of money transfer announced by the headquarter of Vietcombank at the time of payment or at the end of the business day before a holiday or day-off.
The prices for health quarantine services and preventive medicine services specified in this Circular exclude VAT as regulated in Clause 9 Article 5 of the Law on value-added tax and its amending documents;
2. When receiving payments for health quarantine services and preventive medicine services, public health facilities issue service invoices as regulated in the Government’s Decree No. 51/2010/ND-CP dated May 14, 2010, the Government’s Decree No. 04/2014/ND-CP dated January 17, 2014, the Circular No. 39/2014/TT-BTC dated March 31, 2014 of the Ministry of Finance and their substitutes or amending documents (if any).
3. Each public health facility shall exercise financial autonomy in managing and using revenues by rendering health quarantine services and preventive medicine services and remain after fulfilling tax obligations as prescribed by law.
In case the financing source of a public health facility is not enough to cover its recurrent expenses, the part of its expenditures on provision of health quarantine and preventive medicine services which is not compensated by collected service charges shall be funded by the state budget provided that it is certified by a competent authority as a public administrative unit of which part of its recurrent expenditure is covered by itself or the one of which recurrent expenditure is funded by the state budget.
Article 3. Implementation organization
1. Based on the price ceilings specified in Clause 1 Article 2 herein, Minister of Health shall set specific prices of health quarantine and preventive medicine services provided by public health facilities funded by the state budget under regulations of Clause 7 Article 1 of the Government’s Decree No. 149/2016/ND-CP dated November 11, 2016.
2. Heads of public healthcare service providers that are not funded by the state budget are allowed to define their own service prices provided that they do not exceed the price ceilings specified in Clause 1 Article 2 herein.
3. Providers of health quarantine and preventive medicine services must list and publicly announce their service prices in accordance with regulations of the Law on pricing.
Article 4. Implementation
This Circular comes into force from January 01, 2017 and supersedes the Circular No. 08/2014/TT-BTC dated January 15, 2014 of the Ministry of Finance providing for health quarantine and preventive medicine service fees, collection, transfer, management and use thereof.
Difficulties that arise during the implementation of this Circular should be reported to the Ministry of Health and Ministry of Finance for consideration./.
