CIRCULAR
PROVIDING ON THE RATES, REGIME OF COLLECTION, REMITTANCE, MANAGEMENT AND USE OF PROPHYLACTIC MEDICINE AND MEDICAL QUARANTINE CHARGES
Pursuant to the Law on prevention and control of infectious diseases No. 03/2007/QH12 dated November 21, 2007;
Pursuant to Ordinance on charges and fees No. 38/2001/PL-UBTVQH10 dated August 28, 2001;
Pursuant to the Government’s Decree No. 57/2002/ND-CP dated June 03, 2002, detailing implementation of Ordinance on charges and fees;
Pursuant to the Government’s Decree No. 24/2006/ND-CP dated March 06, 2003, amending and supplementing a number of Articles of Government’s Decree No. 57/2002/ND-CP dated June 03, 2002, detailing implementation of Ordinance on charges and fees;
Pursuant to the Government's Decree No. 215/2013/ND-CP dated December 23, 2013, defining the functions, tasks, powers and organizational structure of the Ministry of Finance;
At the proposal of Director of the Tax Policy Department,
The Minister of Finance promulgates Circular providing on the rates, regime of collection, remittance, management and use of prophylactic medicine and medical quarantine charges, as follows:
Article 1. Subjects to the payment of charges
Subjects to the payment of charges include organizations, individuals that are provided with the following by prophylactic medicine bodies, medical quarantine bodies of Vietnam:
1. Prophylactic medicine activities include: Tests to detect diseases; tests on samples of drinking water, daily-life water, sewage and gas; examination of assorted vaccines, bio-products; to make samples and determinate vector kinds; vaccination.
2. Medical quarantine activities include: Killing rats, insects; disinfecting; vaccination, application of prophylactic measures and international vaccination certificate or application of prophylactic measures; medical quarantine on corpses, bone ashes, medical micro-organic samples, bio-products, tissues and parts of human bodies; medical quarantine on export, import, transit goods; medical quarantine on establishments providing food for ships, aircrafts, trains, border-gate areas; tests; medical quarantine on transport means of entry, exit and transit; medical quarantine on export, import and transit through road border gates.
Article 2. Rates of charges
The rates of prophylactic medicine and medical quarantine charges shall comply with the Table of charges promulgated together with this Circular.
The prophylactic medicine and medical quarantine charge rates stipulated in Vietnam dong shall be collected in Vietnam VND; the charge rates stipulated in US dollar shall be collected either in US dollar or in Vietnam dong based on the conversion of USD into Vietnam dong at the exchange rates announced by the Vietnam State Bank at the time of charge collection.
Article 3. Organization of collection, remittance, management and use of charges
1. Agencies collecting charges are agencies, units having function to implement prophylactic medicine and medical quarantine.
2. Charges for prophylactic medicine and medical quarantine are revenues of state budget, managed and used as follows
a) The agencies that collect charges may deduct and use 90% of the total amount of charges to cover the expenses for specialized jobs involving prophylactic medicine and medical quarantine and collection of charges under regulations.
Especially Ho Chi Minh city, the agencies that collect medical quarantine charges may deduct and use 80% (eighty percentage) of the total collected amount of charges to cover the expenses for specialized jobs involving medical quarantine and collection of charges; the agencies that collect prophylactic medicine charges may deduct and use 90% of the total collected amount of charges to cover the expenses for specialized jobs involving prophylactic medicine and collection of charges under regulations.
b) The agencies collecting charges shall remit 10% (ten percentage) of total collected amount of charges; especially agencies collecting medical quarantine charges in Ho Chi Minh city shall remit 20% (twenty percentage) of total collected amount of charges into the State budget according to the chapters, categories, sections and items respectively of the State budget contents currently in force.
3. Other contents involving the collection, remittance, management, use and disclosure of regime of charge and fee collection not guided in this Circular shall comply with guides in Circular No. 63/2002/TT-BTC dated 24/7/2002 of the Ministry of Finance guiding implementation of legislation on charges and fees, Circular No. 45/2006/TT-BTC dated 25/5/206 amending and supplementing Circular No. 63/2002/TT-BTC dated 24/7/2002, Circular No. 156/2013/TT-BTC dated 06/11/2013 of the Ministry of Finance guiding implementation of a number of Articles of Law on tax administration; Law amending and supplementing a number of Articles of Law on tax administration and Government’s Decree No. 83/2013/ND-CP dated 22/7/2013 and Circular No. 153/2012/TT-BTC dated 17/9/2012 of the Ministry of Finance guiding the printing, issuance, management and use of documents for the collection of charges and fees belonging to the state budget and the amending and supplementing documents (if any).
Article 4. Organization of implementation
1. This Circular takes effect on March 01, 2014.
2. This Circular annuls Circular No. 232/2009/TT-BTC dated 09/12/2009 of the Ministry of Finance providing on the rates, regime of collection, remittance, management and use of prophylactic medicine and border medical quarantine charges.
3. In the course of implementation, any arising problems should be reported timely to the Ministry of Finance for research and guide.
