CIRCULAR
ON THE LIST OF POTENTIALLY UNSAFE GOODS AND PRODUCTS UNDER THE MANAGEMENT OF THE MINISTRY OF INFORMATION AND COMMUNICATIONS
Pursuant to the Law on Product and Goods Quality dated November 21, 2007;
Pursuant to the Law on Telecommunication dated November 23, 2009;
Pursuant to the Government's Decree No. 132/2008/ND-CP dated December 31, 2008, detailing the implementation of a number of articles of the Law on Product and goods quality;
Pursuant to the Government's Decree No. 25/2011/ND-CP dated April 06, 2011, detailing an guiding a number of articles of the Law on Telecommunications;
Pursuant to the Government’s Decree No.132/2013/ND-CP dated October 16, 2013 defining functions, rights, responsibilities and organizational structure of the Ministry of Information and Communications;
Upon request of the Director of the Department of Science and Technology,
The Minister of Information and Communications hereby issues this Circular stipulating the list of potentially unsafe goods and products under the management of the Ministry of Information and Communications.
Article 1. Scope of governing
This Circular stipulates the list of potentially unsafe goods and products under the management of the Ministry of Information and Communications (hereinafter referred to as “the List of group-2 goods and products”).
Article 2.Subjects of application
This Circular applies to:
1. Entities manufacturing and trading group-2 goods and products on the List in Vietnam.
2. Entities engaging in activities related to the quality of group-2 goods and products on the List in Vietnam.
Article 3. The List of group-2 products and goods
1. The Management of group-2 products and goods:
a) “The list of specialized goods and products used in information and communications industry subject to declaration and certification of conformity” is presented in Annex I attached hereto.
b) “The list of specialized goods and products used in information and communications industry subject to declaration of conformity” is presented in Annex II attached hereto.
2. The Ministry of Information and Communications shall review, modify and supplement to the List in conformity with the State management policies.
Article 4. Principles for control of group-2 goods and product quality
1. The quality of group-2 goods and products on the List shall be controlled in accordance with the Circular No.30/2011/TT-BTTTT dated October 31, 2011 by the Ministry of Information and Communications on certification and declaration of conformity of information and communications-related products and goods, and respective national technical regulations and standards.
2. in case any amendment, supplement or replacement of applicable technical regulations and standards, the new one shall prevail. The effect of technical regulations and standards shall be conformable to the new regulations and standards and the Ministry of Information and Communications’ regulations.
Article 5. Effect and implementation
1. This Circular enters into force from October 01, 2017 and replaces the Circular No.05/2014/TT-BTTTT dated March 19, 2014 by the Minister of Information and Communications on potentially unsafe products and goods under the management of the Ministry of Information and Communications.
2. From October 01, 2017 onwards, the Circular No.05/2014/TT-BTTTT dated March 19, 2014 on potentially unsafe products and goods under the management of the Ministry of Information and Communications will remain effective to goods and products already certified conformable until the expire date stipulated in the certificate of conformity.
3. The Chief of the Office, Directors of the Departments of Science and Technology, heads of affiliates of the Ministry of Information and Communications and relevant entities shall be responsible for implementing this Circular.
4. Any issue arising in connection with implementation of this Circular should be punctually reported to the Department of Science and Technology – Ministry of Information and Communications. /.

Notes:
(a) This provision shall only apply within the effective period of the License to establish communicatins network and provide terrestrial mobile services using CDMA.
(b)Certification of conformity and declaration of conformity shall be carried out only if the equipment specifications, application band range are conformable to the Circular No.03/2012/TT-BTTTT dated March 20, 2012 by the Minister of Information and Communications specifying the list of radio equipment exempted from the permission to use radio frequencies, specification and application.
(c) This provision shall not apply to radio transceivers using spread spectrum modulation techniques operating in 2.4 GHz band and radio access equipment operating in 5 GHz band.
(d) This provision herein comes into effect from October 01, 2015. Inspection and assessment of conformity shall be carried out in accordance with the Ministry of Information and Communications’s directives.
(e) Other equipment means any device in the same category but not mentioned in the List or any equipment specified in the List but not governed by the respective applicable technical regulations and standards.

Notes:
(a) Only safety features of products and goods are required to undergo conformity declaration as stipulated in Article 2.6 of QCVN 101:2016/BTTTT.
(b) Come into effect from April 01, 2018.
(c) Apply to equipment to which IPv6 is mandatory as stipulated by the Government and the Ministry of Information and Communications from October 01, 2018. Inspection and assessment of conformity shall be carried out in accordance with the Ministry of Information and Communications’s directives.
