CIRCULAR
LIST OF POTENTIALLY UNSAFE PRODUCTS AND GOODS UNDER MANAGEMENT OF THE MINISTRY OF INFORMATION AND COMMUNICATIONS
Pursuant to the Law on Product and goods quality dated November 21, 2007;
Pursuant to the Law on Product and goods quality dated November 21, 2007;
Pursuant to the Government's Decree No. 132/2008/NĐ-CP dated December 31, 2008, detailing the implementation of a number of articles of the Law on Product and goods quality;
Pursuant to the Decree No. 25/2011/NĐ-CP dated April 06, 2011 by the Government providing guidance on the implementation of a number of articles of the Law on telecommunication;
Pursuant to the Decree No. 132/2013/NĐ-CP dated October 16, 2013 by the Government defining the functions, tasks, entitlements and organizational structure of the Ministry of Information and Communications;
At the request of Head of the Science and technology affair and the Director of the Vietnam Telecommunications Authority,
The Minister of Information and Communications promulgates the list of potentially unsafe products and goods under management of the Ministry of Information and Communications.
Article 1. Scope of regulation
This Circular provides the list of potentially unsafe products and goods under management of the Ministry of Information and Communications (hereinafter referred to as the List of group 2 products and goods).
Article 2. Regulated entities
This Circular applies to any domestic and foreign organizations/individuals performing the production and/or trade of products and/or goods included in the List of group 2 products and goods in Vietnam and any organizations/individuals performing the acts relating to the quality of group 2 products and goods in Vietnam.
Article 3. List of group 2 products and goods
1. List of group 2 products and goods and the form of management are specified in the following Appendixes:
a) “List of information and communication technology products and goods subject to certification and declaration of conformity” presented in Appendix I of this Circular
a) “List of information and communication technology products and goods subject to declaration of conformity” presented in Appendix II of this Circular.
2. The Ministry of Information and Communications shall periodically inspect, examine and modify the List of group 2 products and goods according to the management policy of the State.
Article 4. Principle of quality management
1. The management of quality of products and goods included in the List of group 2 products and goods specified in this Circular shall be conformable to the National technical regulations and standards.
2. The management of quality of products and goods included in the List of group 2 products and goods specified in Appendixes I and II of this Circular shall conform with the Circular No. 30/2011/TT-BTTTT dated October 31, 2011 by the Minister of Information and Communications on the certification and declaration of conformity applicable to information and communication technology products and goods.
Article 5. Implementation
1. This Circular comes into effect from May 05, 2014.
2. This Circular replaces the Circular No. 20/2011/TT-BTTTT dated July 01, 2011 by the Minister of Information and Communications, the Circular No. 31/2011/TT-BTTTT dated October 31, 2011 by the Minister of Information and Communications and the Circular No. 32/2011/TT-BTTTT dated October 31, 2011 by the Minister of Information and Communications.
2. The Chief Officers, Head of the Science and Technology Affair, the Director of the Vietnam Telecommunications Authority, Heads of agencies and units affiliated to the Ministry of Information and Communications and relevant organizations and individuals are responsible for implementing this Circular.
3. Difficulties that arise during the implementation of this Circular should be reported to the Ministry of Information and Communications for consideration and solution./.

(*) This regulation is effective only until the Licenses for network setting and terrestrial mobile telecommunication service provision using CDMA technology are revoked or expired.
(**) Certification and declaration of conformity shall be carried out only when the equipment is conformable with the regulation on frequency band and technical and operation conditions provided in the Circular No. 03/2012/TT-BTTTT dated March 20, 2012 by the Ministry of Information and Communications.

- From April 01, 2014: applied to any television with screen bigger than 32 inch;
- From April 01, 2015: applied to any television with screen smaller than 32 inch;
