CIRCULAR

AMENDING AND SUPPLEMENTING THE POST AND TELEMATICS MINISTRY'S CIRCULAR NO. 01/2005/TT-BBCVT OF MAY 6, 2005, GUIDING THE LICENSING OF MAIL DELIVERY SERVICE BUSINESS AND REGISTRATION OF MAIL DELIVERY AGENCY FOR FOREIGN DELIVERY ORGANIZATIONS

THE MINISTRY OF INFORMATION AND COMMUNICATIONS

Pursuant to the May 25, 2002 Ordinance on Post and Telecommunications;
Pursuant to the Government's Decree No. 157/2004/ND-CP of August 18, 2004, detailing a number of articles of the Ordinance on Post and Telecommunications;
Pursuant to the Government's Decree No. 187/2007/ND-CP of December 25, 2007, defining the functions, tasks, powers and organizational structure of the Ministry of Information and Communications,

DECIDES:

Article 1. To amend and supplement the Post and Telematics Ministry' Circular No. 01/2005/TT-BBCVT of May 6, 2005, guiding the licensing of mail delivery service business and registration of mail delivery agency for foreign delivery organizations, as follows:

1. To replace the phrase "Ministry of Post and Telematics" with the phrase "Ministry of Information and Communications".

2. To amend and supplement Clause 1 of Section III as follows:

"1. An international mail delivery enterprise may work as a mail delivery agent for foreign delivery organizations after the Ministry of Information and Communications certifies the registration of mail delivery agency for foreign delivery organizations."

3. To amend and supplement Point 2.1, Clause 2 of Section III as follows:

"2.1. An agency registration dossier shall be made in one set, comprising the following papers:

a/ An application for registration of mail delivery agency for a foreign delivery organization, made in 2 originals according to the form provided in Appendix 5 to this Circular (not printed herein);

b/ A copy of the international mail delivery service business license (for domestic enterprises) or a notarized copy of the investment license (for foreign-invested enterprises) of the enterprise to act as an agent;

c/ Documents evidencing the legal entity status of the foreign delivery organization;

d/ A copy of the agency contract bearing the signatures and seals of the parties, certified as a true copy by the enterprise to act as an agent;

e/ The model contract on service provision and use (delivery bill or bill of lading); the service charge tariff and quality standards; regulations on compensation principles and levels applicable to services to be provided by the enterprise as an agent."

Article 2. This Circular takes effect 45 days from the date of its signing.

Article 3. The Director of the Post Department and heads of units of the Ministry of Information and Communications and domestic and foreign delivery service enterprises conducting post and mail delivery operations in Vietnam shall implement this Circular.-
