CIRCULAR

ISSUING THE LIST OF PROTECTED PLANT SPECIES

Pursuant to the Government's Decree No. 01/2008/ND-CP dated January 03^rd 2008, defining the functions, tasks, powers and organizational structure of the Ministry of Agriculture and Rural development ; the Government's Decree No. 75/2009/ND-CP dated September 10^th 2009, amending Article 3 of the Government's Decree No. 01/2008/ND-CP dated January 03^rd 2008, defining the functions, tasks, powers and organizational structure of the Ministry of Agriculture and Rural development;

Pursuant to the Law on Intellectual property No. 50/2005/QH11 dated November 29^th 2005; the Law No. 36/2009/QH12, on the amendment and supplementation of the Law on Intellectual property, dated June 19^th 2009;

Pursuant to the Government's Decree No. 88/2010/ND-CP dated August 16^th 2010, specifying and guiding the implementation of the Law on Intellectual property and the Law on the amendment and supplementation of the Law on Intellectual property, applicable to the rights to varieties of plants and the Government's Decree No. 98/2011/ND-CP dated October 26^th 2011, amending and supplementing a number of articles of the Decrees on agriculture;

At the proposal of the Director of Department of Crop production;

The Minister of Agriculture and Rural development issues the list of protected plant species/

Article 1. issuing the list of protected plant species, including the following 21 species:

Article 2. This Circular takes effect on March 22^nd 2013.

Article 3. The Chief of the Ministry Office, the Director of Department of Crop production, heads of Ministerial units, Directors of Services of Agriculture and Rural development of central-affiliated cities and provinces, relevant organizations and individuals are responsible for the implementation of this Circular./.
