CIRCULAR
REGULATION ON RATE OF COLLECTION, REMITTANCE, MANAGEMENT AND USE OF FEES AND CHARGES OF FOOD HYGIENE AND SAFETY
Pursuant to the Law on Food Safety No. 55/2010/QH12 dated June 17, 2010;
Pursuant to the Ordinance on Charges and Fees No. 38/2001/PL-UBTVQH10 dated August 28, 2001;
Pursuant to Decree 57/2002/ND-CP dated June 3, 2002 of the Government detailing the implementation of the Ordinance on Charges and Fees and Decree No. 24/2006/ND-CP dated March 06, 2006 of the Government amending and supplementing a number of articles of Decree No. 57/2002/ND-CP dated June 3, 2002;
Pursuant to Decree No. 38/2012/ND-CP dated April 25, 2012 of the Government detailing the implementation of a number of articles of the Law on Food Safety;
Pursuant to Decree No. 118/2008/ND-CP dated November 27, 2008 of the Government defining the functions, tasks, powers and organizational structure of the Ministry of Finance;
At the proposal of Director of the Tax Policy Department;
The Minister of Finance issues the Circular regulating the rate of collection, remittance, management and use of fees and charges of food hygiene and safety as follows:
Article 1. Subjects of fees and charges
Vietnamese or foreign organizations and individuals manufacturing, trading or importing food and issued with certificate, certification, inspection of food hygiene and safety conditions and testing of food hygiene and safety by the competent state authority must make payment of fees and charges of management of food hygiene and safety under the provisions of this Circular.
Article 2. Collection rate
1. The collection rate of fees and charges of food hygiene and safety management is specified in the Table of collection rate issued together with this Circular.
2. Fees and charges of food hygiene and safety management are collected in Vietnam dong (VND).
Article 3. Collection, remittance and use management
1. Fees and charges of food hygiene and safety management are revenues of state budget.
2. The fee collection authority may deduct 90% (ninety percent) of the total amount of fees actually collected to cover the cost of fee collection by the following contents:
a) Payment of salary (wages), allowances, and hazardous allowances, work over the time prescribed by the State; workwear and uniform expenditure for employees as prescribed, expenditure for professional training; contributions on salary and wages for employees (including outsourced labor), activities of fee collection (excluding salary costs for staff and public servants receiving salary from the state budget) under regulations;
b) Direct expenses for the collection of fees, such as office supplies, telephone, electricity, water, travel expenses and public affair expenses, printing (buying) declarations, licenses, and other printed matters under the current standard and rate;
c) Expenditure for regular repair and overhaul of assets, machinery and equipment for the collection of fees;
dd) Expenditure for procurement of supplies, materials, equipment, working tools and other expenses related to the collection of fees under estimate approved by the competent authority;
e) Expenditure for preparation of appraisal record, for activities of appraisal and approval Board under the decision of competent authority;
f) Expenditure for propagation of quality management of food hygiene and safety
The amount of expense is left by 90% (ninety percent) to cover the cost of collection of fees after proper settlement. If this amount remains after expenditure in animal quarantine authority year, it shall be carried forward to the following year for further expenditure as prescribed;
The total amount of fees actually collected, after deducting the amount deducted at the rate specified in Clause 2 of this Article, the remaining amount of 10% (ten percent) shall be remitted to the state budget by the fee collection authority according to the current Content of state budget.
3. The fee collection authority shall remit 100% (one hundred percent) of the total fees collected to the state budget according to the current Content of state budget.
4. Where the fees collected from the services not invested or invested by the State but transferred to organizations and individuals with accounting principles and financial autonomy are the revenues which do not belong to the state budget. The amount of fee collected is the turnover of organizations and individuals collecting fees. These organizations and individuals have the obligation to pay tax in accordance with the current regulation of the state of the result of fee collection.
Article 4: Implementation organization
1. This Circular takes effect on December 16, 2013. Annulling Decision No. 80/2005/QD-BTC dated November 17, 2005 of the Minister of Finance regulating the rate of collection, remittance, management and use fees and charges of quality management of food hygiene and safety and Decision No. 57/2006/QD-BTC dated October 19, 2006 on modification of rate of collection, remittance, management and use fees and charges of quality management of food hygiene and safety in Decision No. 80/2005/QD-BTC dated November 17, 2005 of the Minister of Finance;
2. Other contents related to the collection, remittance, management, use and publicity of regulation on collection of fees and charges not specified in this Circular shall comply with the guidance in Circular No. 63/2002/TT-BTC dated July 24, 2002 and Circular No. 45/2006/TT-BTC dated May 25, 2006 amending and supplementing Circular No. 63/2002/TT-BTC dated July 24, 2002 of the Ministry of Finance guiding the implementation of legal regulations on fees and charges; Circular No. 28/2011/TT-BTC dated February 28, 2011 of the Ministry of Finance guiding the implementation of a number of articles of the Law on Tax Management, guiding the implementation of Decree No. 85/2007/ND-CP dated May 25, 2007 and Decree No.106/2010/ND-CP dated October 28, 2010 of the Government detailing the implementation of animal quarantine authority number of articles of the Law on Tax Management; Circular No. 153/2012/TT-BTC dated September 17, 2012 of the Ministry of Finance guiding the issuance and use of receipts of fees and charges under the state budget; Circular No. 64/2013/TT-BTC dated May 15, 2013 of the Ministry of Finance guiding the implementation of Decree No. 51/2010/ND-CP dated May 14, 2010 of the Government regulating the invoice of goods sale, service supply and amended and supplemented documents;
3. Organizations and individuals subject to payment of fees and charges and agencies concerned are liable to execute this Circular. Any problem arising during the implementation should be promptly reported to the Ministry of Finance for consideration and guidance./.
