CIRCULAR

AMENDING AND SUPPLEMENTING A NUMBER OF ARTICLES OF CIRCULAR NO. 88/2008/TT-BVHTTDL CIRCULAR NO. 17/2010/TT-BVHTTDL CIRCULAR NO. 03/2013/TT-BVHTTDL

Pursuant to the Law on Promulgation of legislative documents dated June 3, 2008;

Pursuant to the Law on Inland Waterway Navigation dated June 15, 2004;

Pursuant to the Government’s Decree No. 79/2007 / ND-CP dated May 18, 2007 on issuance of copies of master registers, authentication of copies from originals and authentication of signatures;

Pursuant to the Government’s Decree No. 79/2014/NĐ-CP dated July 31, 2014 detailing the implementation of a number of articles of the Law on fire prevention and fighting and Law on amendments to the Law on fire prevention and fighting;

Pursuant to the Government’s Decree No. 76/2013/NĐ-CP dated July 16, 2013 defining the functions, tasks, entitlements and organizational structure of the Ministry of Culture, Sports and Tourism;

At the request of the Director of Legal Department,

the Minister of Culture, Sports and Tourism promulgates the Circular amending and supplementing a number of articles of Circular No. 88/2008/TT-BVHTTDL Circular No. 17/2010/TT-BVHTTDL Circular No. 03/2013/TT-BVHTTDL.

Article 1. Amendments to the Minister of Culture, Sports and Tourism’s Circular No. 88/2008 / TT-BVHTTDL dated December 30, 2008 providing guidance on the implementation of the Government’s Decree No. 92/2007 / ND-CP dated June 1, 2007 detailing the implementation of a number of articles on tourist accommodation establishments of the Law on Tourism

1. Point d, Clause 1.1, Section 1, Part III is amended as follows:

“d) Valid copies of:

- The Certificate of business registration of tourist accommodation establishment, Establishment Decision of enterprises (if any);

- Manager’s professional diplomas and training certificates and the duration of working in the tourism sector;

- Certificate of eligibility for security and order;

- Documents of inspection, acceptance of fire prevention and fighting of police agencies for hotels, motels with height of 05 stories or more or volume of 5,000 m3 or more when they are built, renovated or changed their utility;

- Certificate of eligibility for food safety (for tourist accommodation establishments providing food and beverage services);

2. Clause 2.1, Section 2, Part III is amended as follows:

“2.1.Within three months after the operation, tourist accommodation establishments shall submit one set of application for registration of their class to the Service of Culture, Sports and Tourism for appraisal and classification or requesting competent agencies for appraisal and classification according to current regulations.”

3. Clause 25.2, Section 5 of Part VI is amended as follows:

“5.2 At least three months before the expiration of the time limit stated in the decision on issuance of signboard of meeting tourist service standards, business establishments must submit the registration application to the Services of Culture, Sports and Tourism for appraisal and reissuance of signboard. The application and procedures for appraisal and reissuance of signboard shall comply with the provisions of appraisal and issuance of signboard”

Article 2. Amendments to the Minister of Culture, Sports and Tourism's Circular No. 17/2010/TT-BVHTTDL dated December 31, 2010 prescribing conditions of operation of sports facilities organizing ​​water motor activity on sea

Clause 1 and Clause 2, Article 8 is amended as follows:

"1. The engine of water motors must have a capacity (measured in supernatural force) suitable for engineering design of the vehicles, make no noise affecting the resort areas, research institutes, schools, residential areas during the operation.

2. Water motors being put into operation must have certificates of technical safety and environmental safety issued by the competent authorities. ".

Article 3. Amendment to the Minister of Culture, Sports and Tourism’s Circular No. 03/2013/TT-BVHTTDL dated January 28, 2013 detailing the implementation of a number of articles of the Government’s Decree No. 79/2012/NĐ-CP dated October 5, 2012 stipulating art or fashion shows; beauty and model contests; circulation and sale of audio and video recordings of art performances.

1. Points b and c, Clause 1, Article 2 is amended and supplemented as follows:

"b) A valid copy of License for organizing art or fashion show or Decision on organizing beauty contests and model contests or Decision allowing foreigners and overseas Vietnamese to participate in art or fashion shows in Vietnam.

c) A valid copy of enterprise establishment Decision or Certificate of business registration. ".

2. Clause 2, Article 2 is amended as follows:

"2. Within 04 working days from the day on which the satisfactory application is received, the Service of Culture, Sports and Tourism which receive the notification shall make a written reply. the Services of Culture, Sports and Tourism has the right to disagree with the organization in case of national mourning, natural disasters, epidemics, security, politics seriously affect the spirit, life, living, safe local society. ".

3. Points dd, Clause 1, Article 12 is amended and supplemented as follows:

"dd) Form 05: Decision to allow foreign organizations and individuals; oversea Vietnamese to participate in art or fashion shows in Vietnam. ".

4. Form 05 is amended in the Appendix enclosed with this Circular

Article 4. Effect

1. This Circular takes effect from February 10, 2015.

2. Any problem arising during the implementation shall be reported to the Ministry of Culture, Sports and Tourism for amendment and supplementation./.

Pursuant to the Government’s Decree No. 79/2012/NĐ-CP dated October 5, 2012 stipulating art or fashion shows; beauty contests and model contests; circulation and sale of audio and video recordings of art performances.

Pursuant to the Minister of Culture, Sports and Tourism’s Circular No. 03/2013/TT-BVHTTDL dated January 28, 2013 detailing the implementation of a number of articles of the Government’s Decree No. 79/2012/NĐ-CP dated October 5, 2012 regulating art or fashion show; beauty contests and model contests; circulation and sale of audio and video recordings of art performances; the Minister of Culture, Sports and Tourism’s Circular No. 19/2014/TT-BVHTTDL dated December 8, 2014 amending, supplementing a number of articles of Circular No. 88/2008/TT-BVHTTDL Circular No. 17/2010/TT-BVHTTDL Circular No. 03/2013/TT-BVHTTDL;

HEREBY DECIDES:

Article 1. Permit (organizations and individuals) to participate art or fashion shows in Vietnam.

- Place:……………………………..Article 2. ...... (Name of organization, individual requesting for licensing) shall follow procedures for granting the License for organizing art or fashion shows in the Department of Performing arts (or the Services of Culture, Sports and Tourism).

Article 3. Organizational units, organizations, and individuals participating in programs shall comply with the provisions of the Government’s Decree No. 79/2012 / ND-CP dated October 5, 2012 regulating art or fashion shows; beauty contests and model contests; circulation and sale of audio and video recordings of art performances; the Minister of Culture, Sports and Tourism’s Circular No. 03/2013 / TT-BVHTTDL dated January 28, 2013 detailing the implementation of a number of articles of the Government’s Decree No. 79/2012 / ND-CP dated October 5, 2012 regulating art or fashion shows; beauty contests and model contests; circulation and sales of audio and video recordings of art performances; the Minister of Culture, Sports and Tourism’s Circular No. 19/2014 / TT-BVHTTDL dated December 8, 2014 amending and supplementing a number of articles of Circular No. 88/2008 / TT-BVHTTDL, Circular No. 17/2010 / TT-BVHTTDL, Circular No.03 / 2013 / TT-BVHTTDL and relevant law provisions.

Article 4. The Director of the Department of Performing arts/ the Director of the Services of Culture, Sports and Tourism/ the Head of …organizational units, organizations, and individuals specified in Article 1 shall be responsible for the implementation of this Decision. /.
