CIRCULAR
DEFINING LEVELS AND COLLECTION, PAYMENT, MANAGEMENT AND USE OF FEES, CHARGES FOR QUALITY MANAGEMENT OF AQUACULTURE
Pursuant to the Ordinance on Fees and Charges No. 38/2001/PL-UBTVQH10 dated August 28, 2001 of the Standing committee of the National Assembly of the Socialist Republic of Vietnam;
Pursuant to the Ordinance on Livestock breed No. 16/2004/PL-UBTVQH11 dated March 24, 2004 of the Standing committee of the National Assembly of the Socialist Republic of Vietnam;
Pursuant to the Government’s Decree No. 57/2002 / ND-CP dated June 3, 2002 detailing the implementation of the Ordinance on Fees and Charges; the Government's Decree No. 24/2006 / ND-CP dated March 6, 2006 on amendment and supplementation of a number of articles of Decree No. 57/2002 / ND-CP dated June 3, 2002;
Pursuant to the Government's Decree No. 118/2008 / ND-CP dated November 27, 2008 defining the functions, tasks, entitlements and organizational structure of the Ministry of Finance;
At the request of the Director of the Tax Policy Department,
The Minister of Finance promulgates the Circular defining levels and collection, payment, management and use of fees, charges for quality management of aquaculture, as follows:
Article 1. Regulated entities
1. Organizations and individuals producing and trading in the field of aquaculture in Vietnam when submitting applications to competent agencies and units for quality management in aquaculture prescribed by law must pay charges and fees as prescribed in this Circular.
2. Fee-collecting agencies shall be agencies and units testing and verifying aquaculture including:
a) Centre for Testing and Verifying aquaculture: Central Office, Mekong Delta Centre, South-Eastern Centre, Central and Highland Centre, Northern Center;
b) Aquaculture management authorities of central-affiliated cities and provinces.
Article 2. Charge and fee levels
Charge and fee level in quality management of aquaculture shall comply with the Table of charge and fees enclosed herewith this Circular.
Article 3. Management and use of charges and fees
Charges and fees for quality management in aquaculture shall be government revenues, managed and used as follows:
1. For fees: Collecting agencies shall keep 90% of the total collected amount before submitting into the State budget to cover the expenses as stipulated in the Government's Decree No. 24/2006 / ND-CP dated March 6, 2006 and guiding documents. The remaining amount (10%) shall be paid into the state budget according to the chapters and sections of the state budget Appendix.
2. For charges: Collecting agencies shall submit 100% to the state budget under the chapters and sections of the state budget Appendix.
3. For the collecting agencies specified in Point a, Paragraph 2 of Article 1 of this Circular:
a) At the end of each quarter, collecting units shall base on the fee amount retained for use as prescribed (90%) and expense estimates approved by competent authorities (annual estimates divided by quarter), if the retained fee amount is greater than the approved expense estimates, the difference must be paid to the account of Centre for Testing and Verifying aquaculture to offset other collecting units (defined in Point a, Paragraph 2 of Article 1 of this Circular) that have insufficient revenues as prescribed in this Circular.
b) Center for Testing and Verifying aquaculture shall open a deposit account in State Treasuries at the place of transactions to regulate the charges in testing, inspection and verification of aquaculture under regulations among collecting agencies specified in Point a, Paragraph 2 of Article 1 of this Circular.
c) Fee amount shall be retained for collecting agencies as prescribed, in the year if revenue decreases, the expenditures shall also reduce accordingly; at the end of the year, the left fee amount shall be transferred to the subsequent year for further expense according to regulations.
d) Center for Testing and Verifying aquaculture shall make estimate for annual revenue and expenditure and report to superior competent agencies for approval. At the same time, open a separate accounting book and annually must make settlement with superior bodies.
4. Other matters related to the collection, payment, management, use, declaration and payment of charges, fees and public disclosure of collection regulations of charges and fees that are not guided in this Circular shall comply with guidelines the Ministry of Finance’s Circular No. 63/2002 / TT-BTC dated July 24, 2002 providing guidance on the implementation of legal regulations on fees and charges, Circular No.45 / 2006 / TT-BTC dated May 25, 2006 amending and supplementing Circular No.63 / 2002 / TT-BTC dated July 24, 2002, Circular No. 156/2013 / TT-BTC dated June 11, 2013 of the Ministry of Finance providing guidance on the implementation of a number of articles of the Law on Tax Administration; Law amending and supplementing a number of articles of the Law on Tax Administration and the Government’s Decree No. 83/2013 / ND-CP dated July 22, 2013 and the Circular No. 153/2012 / TT-BTC dated September 17, 2012 of the Ministry of Finance providing guidance on printing, issuance, management and use of receipts of charges and fees in the state budget and the amending and supplementing documents (if any).
Article 4. Implementation
1. This Circular takes effect from February 10, 2014.
2. Appendix 2 and Appendix 4 enclosed herewith the Ministry of Finance’s Circular No. 107/2012 / TT-BTC dated June 28, 2012 providing guidance on collection, payment, management and use of charges and fees of management of quality and safety of seafood shall be annulled.
3. In the course of implementation, if any problems arise, organizations and individuals should promptly report to the Finance Ministry for study, guidance, amendment and supplementation.
