AMENDING AND SUPPLEMENTING A NUMBER OF PROVISIONS OF CIRCULAR NO. 13/2008/TT-BTTTT OF DECEMBER 31, 2008, GUIDING THE ESTABLISHMENT AND OPERATION OF REPRESENTATIVE OFFICES AND LOCALLY BASED PERMANENT CORRESPONDENTS OF PRESS AGENCIES, AND THE MINISTER OF CULTURE AND INFORMATION'S DECISION NO. 28/2002/QD-BVHTT OF NOVEMBER 21, 2002, PROMULGATING THE REGULATION ON PUBLICATION OF BULLETINS, DOCUMENTS, LEAFLETS; ISSUANCE OF PRESS RELEASES; PUBLICATION AND TRANSMISSION OF NEWS BULLETINS IN ELECTRONIC SCREENS BY FOREIGN AGENCIES AND ORGANIZATIONS AS WELL AS LEGAL PERSONS INVOLVING FOREIGN ELEMENTS IN VIETNAM

Pursuant to the December 28, 1989 Press Law and the June 12, 1999 law Amending and Supplementing a Number of Articles of the Press Law;

Pursuant to the Government's Decree No. 51/2002/ND-CP of April 26, 2002, detailing the Press Law and the Law Amending and Supplementing a Number of Articles of the Press Law;

Pursuant to the Government's Decree No. 187/2007/ND-CP of December 25, 2007, defining the functions, tasks, powers and organizational structure of the Ministry of Information and Communications;

In furtherance of the Government's Resolution No. 71/NQ-CP of December 27, 2010, on the simplification of administrative procedures under the Information and Communications Ministry's management, the Minister of Information and Communications amends and supplements a number of provisions of Circular No. 13/2008/TT-BTTTT and Decision No. 28/2002/QD-BTTTT as follows;

Article 1. To amend and supplement a number of provisions of Circular No. 13/2008/TT-BTTTT

1. To amend Points b. f. Clause 3. Section II, as follows:

"b/ Certificate of press operation's copy certified by the press agency.

f/ Head of representative office and permanent correspondent's press cards' copies certified by the press agency."

2. To amend and supplement Clause 3.

Section II on procedures for handling applica­tions for permission for setting up representative offices of press agencies as follows:

"Within 5 working days after receiving a dossier, the provincial-level Department of Information and Communications shall examine the dossier's validity and guide the press agency in completing the dossier.

Within 30 working days after receiving a complete dossier as required, the provincial-level Department of Information and Communications shall consider and permit the press agency to set up and organize activities of its local representative office. In case of refusal, it shall issue a written reply, clearly stating the reason."

Article 2. To amend and supplement a number of provisions of Decision No. 28/2002/QD-BVHTT

1. To amend and supplement Article 10 as follows:

"Agencies and organizations wishing to publish bulletins, documents and leaflets; to issue press releases; or to publish or transmit electronic news bulletins must carry out procedures for applying for a license of the Ministry of Information and Communications. Dossiers shall be submitted to the Authority of Press of the Ministry of Information and Communications".

"2. To amend two (2) forms promulgated together with Decision No. 28/2002/QD-BVHTT into two new ones promulgated together with this Circular, specifically:

a/ Form 1 - The declaration for application for bulletin publication license to be amended into the declaration for request for bulletin publication license

b/ Form 2 - The application for license for publication of bulletins, documents, leaflets publication or issuance of press releases to he amended into the request for license for license for application of bulletins, documents, leaflets publication or issuance of press releases."

Article 3. Effect

1. This Circular takes effect on September 1, 2011.

2. Related organizations, agencies and individuals shall implement this Circular.-
