CIRCULAR

REGULATING STATISTICAL REPORT APPLICABLE TO AFFILIATES OF THE STATE BANK, CREDIT INSTITUTIONS, AND BRANCHES OF FOREIGN BANKS

Pursuant to the Law on the State bank of Vietnam No. 46/2010/QH12 dated June 16, 2010;

Pursuant to the Law on credit institutions No. 47/2010/QH12 dated June 16, 2010;

Pursuant to the Law on Statistics No. 04/2003 / QH11 dated June 17, 2003;

Pursuant to the Government's Decree No. 96/2008/NĐ-CP dated August 26, 2008 defining functions, tasks, entitlements, and organizational structure of the State bank of Vietnam;

At the request of the Director of Monetary Forecast and Statistics Department;

the Governor of the State bank of Vietnam promulgates the Circular regulating statistical reports applicable to affiliates of the State bank, credit institutions, and branches of foreign banks,

Chapter 1.

GENERAL PROVISIONS

Article 1. Governing scope

Statistical reports applicable to affiliates of the State bank, credit institutions, and branches of foreign banks (hereinafter referred to as statistical reports) defined in this Circular are under the basic statistical reporting regulations as stipulated in Law on statistics No. 04/2003/QH11 dated June 17, 2003.

Statistical report provided for in this Circular is a way of collecting statistical information from the reporting units to meet the performance of functions of state management on monetary, banking operation and Central banking functions of the State Bank.

For other reports which are not within the governing scope of this Circular, reporting units comply with current regulations of the Governor of State Bank and competent State management agencies.

Article 2. Reporting units

1. The units under organizational structure of the State Bank (hereinafter referred to as affiliates of the State bank).

2. Credit institutions (excluding micro-finance institutions), branches of foreign banks which are established and are operating within Vietnam’s territory under the Law on Credit Institutions (hereinafter referred to as credit institutions).

Article 3. Recipients of report

The recipients of reports are affiliates of the State bank.

Article 4. Reporting items and statistical report forms (hereinafter referred to as reporting items and forms)

1. The reporting items are divided into small groups. Each item group has different sub-groups

2. For periodical reporting items and forms: schedule for preparing report, time limit for sending report, reporting unit, content, and guidance on reporting of periodic reporting items and forms are specified in Article 11 of this Circular and Annexes 1, 2, 3, 4a, 4b enclosed with this Circular.

3. In case where it is necessary to serve the management, direction, the Governor of State Bank or the Directors of branches of the State Bank in central-affiliated cities and provinces shall request for the reports according to reporting items and forms which are not stipulated in this Circular; reporting units must satisfy fully and promptly such request.

Article 5. Statistics codes and guidance on division into small group, classification

1. The specific provisions of statistic codes applied in the banking statistics are specified in Appendix 5 enclosed with this Circular.

2. Guidance on classification of organizations and individuals, division of economy according to three economic sectors into small group, division of residents and non-residents in Vietnam into small group is specified respectively in Annexes 6, 7 and 8 enclosed with this Circular.

Article 6. Reporting methods

1. Electronic report is expressed under a file of electronic data which is transmitted through a computer network or through the information carrier. Electronic report must have full electronic signatures of the head or competent person of the reporting unit and must be in accordance with signs, communication codes, and file structures prescribed by the State Bank.

Electronic report is compulsorily applied to reporting items specified in Appendix 1 and report forms prescribing electronic report in Appendices 4a, 4b enclosed with this Circular.

2. Written report is under paper form and must comply with the prescribed form with full of stamp and signature of the competent person of the reporting unit and signature, full name of the report compiler and controller.

Article 7. Network connection and electronic reporting process

1. The head office of credit institutions (excluding people's credit fund and branch of foreign bank which is not focus branch of the branches of the same operation system in Vietnam) connects information transmission network to the Information Technology Administration in order to send reports to the State Bank as stipulated in Annex 2 and Annex 4b enclosed with this Circular.

2. branches of the State Bank in central-affiliated cities and provinces(hereinafter referred to as branches of the State Bank in provinces and cities) connect information transmission network to the Information Technology Administration in order to send reports to the State Bank as prescribed in Annex 2, Annex 4a enclosed with this Circular and in order to extract the report of credit institutions in the area from the common data warehouse at the State Bank under the guidance of the Information Technology Administration.

3. people's credit fund connects information transmission network to branches of the State Bank in provinces and cities where its head office is located in order to send reports to the State Bank as stipulated in Annex 2 and Annex 4b enclosed with this Circular.

In case where the People's Credit Fund is not eligible to connect information transmission network to branches of the State Bank in provinces and cities, the report files shall be sent through the information carrier, or sent in a written form to branches of the State Bank in provinces and cities where its head office is located. Branches of the State Bank in provinces and cities shall have to update the report data of each people's credit fund to database at branches of the State Bank in provinces and cities in order to send it to the State Bank.

4. In case where the data transmission system has breakdown, the reporting unit must send the report file saved on the information carrier to the State Bank as the following regulations:

The head office of credit institution (excluding people's credit fund and branch of foreign bank which is not focus branch of the branches of the same operation system in Vietnam) sends it to Information Technology Administration.

b) people's credit fund sends it to Information Technology Administration through branches of the State Bank in provinces and cities where its head office is located.

Article 8. Submission of written reports

The submitting of written report applies to report forms defined in Clause 3, Article 4 and to report forms provided in Appendix 4b enclosed with this Circular if the people's credit Fund is not eligible to connect information transmission network to branches of the State Bank in provinces and cities.

Article 9. Report Information security

The data on statistical reports and other relevant documents under the secret list of State must be managed, used and transmitted in accordance with the legislation on State secret protection

Article 10. Quality of statistical report data

The statistical report data must be full, timely, honest, objective and accurate. When there are any modifications to the data that has been reported or the data in the reporting period changes unusually, reporting unit must send a note to the report in writing to the recipients of the report.

Article 11. Reporting period and time-limit for sending report

1. Reporting period

a) Daily reporting period is determined according to working day.

b) Monthly, quarterly, every-6-month, yearly reporting period is determined according to calendar.

c) Every-10-day reporting period (or 3 periods/ month): the first period is from the 1st to the 10th of the reporting month; the second period is from the 11th to the 20th of the reporting month and the third period is from the 21st to the last date of the reporting month.

d) Every-15-day reporting period (or 2 periods/ month): the first period is from the 1st to the 15th of the reporting month; the second period is from the 16th to the last date of the reporting month.

2. Time-limit for sending report applicable to reporting items

a) Daily report: reporting units send their reports at the latest at 2.p.m of the working day after the reporting day.

b) Every-10-day report (3 periods/ month), every-15-day report (2 periods/ month): reporting units send their reports within 02 working days after the last day of the reporting period.

c) Monthly report: reporting units send their reports at the latest on 12th of the month after the reporting month.

d) Quarterly report: reporting units send their reports at the latest on 20th of the first month of the quarter after the reporting quarter.

dd) Yearly report: reporting units send their report at the latest on 20th of the first month of the year after the reporting year.

e) The reports of each People's Credit Fund, branch of the State Bank in provinces and cities shall be sent to the State Bank within the time-limit as follows:

- Every-10-day report (3 periods/ month), every-15-day report (2 periods/ month): the reports are sent within 03 working days after the last day of the reporting period.

- Monthly report: the reports are sent at the latest on 15th of the month after the reporting month.

- Quarterly report: the reports are sent at the latest on 25th of the month after the reporting quarter.

- Yearly report: the reports are sent at the latest on 25th of the first month of the year after the reporting year.

g) In case where the time-limit for sending report is different from that in the above provisions, it shall be specified in Annex 3 enclosed with this Circular.

3. The time-limit for sending report applicable to report forms is specified in the report forms in Appendices 4a, 4b enclosed with this Circular.

4. If the last specified date of the reporting time-limit coincides with holidays, Tet holidays, or weekends, the date of sending report shall be the next working day after such holidays, Tet holidays or weekends.

In case where a written report is sent, the actual day for sending such report is the date on the postmark of the place where the report is sent to. In case a report is sent through electronic report channel, the day for sending such report is the day when the report file is transmitted successfully to the Information Technology Administration

In emergency or extraordinary cases, the unit must send the written report by fax. After sending the report by fax, the reporting unit shall send the written official report as prescribed in paragraph 2, Article 6 and Article 8 of this Circular. The actual day of sending such report is the day on which the report is faxed.

Article 12. Inspection process for electronic report items and forms

1. Information Technology Administration:

a) As soon as receiving the report within the time-limit for sending report specified in Paragraphs 2 and 3 Article 11 of this Circular, the Information Technology Administration shall inspect the adequacy of the electronic reporting items and forms transmitted through informatics network by branches of the State Bank in provinces and cities and head offices of credit institutions.

In case of detecting that branches of the State Bank in provinces and cities, head offices of credit institutions do not transmit or transmit insufficiently electronic report items and forms, reports of the branches of credit institutions in the system, the Information Technology Administration must notify the branches of the State Bank in provinces and cities, the head offices of credit institutions through the informatics network for sending full reports to the State Bank.

b) As soon as receiving the results of inspection of affiliates of the State bank, the Information Technology Administration must promptly notify branches of the State Bank in provinces and cities, head offices of credit institutions through informatics network for processing, transmitting the right data to the Information Technology Administration.

c) As soon as receiving the electronic report items and forms transmitted to the Information Technology Administration by the branches of the State Bank in provinces, cities, and credit institutions, the Information Technology Administration shall notify the recipients of the report through informatics network for timely update of the data.

2. Bank Supervision and Inspection Agencies, Departments:

Within 04 working days from the deadline for sending report specified at Points c, d, dd, e, g, Paragraphs 2 and 3 Article 11 of this Circular, Bank Supervision and Inspection Agencies, Departments shall inspect the reasonableness of data summarized from the electronic report items and forms under the responsibility for monitoring, summary specified at Article 16 of this Circular; If errors are detected, Bank Supervision and Inspection Agencies, Departments shall send the results of data inspection through informatics network to the Information Technology Administration in order to notify the reporting units for re-transmitting correct data.

3. Branches of the State Bank in provinces, cities:

a) Within 03 working days from the deadline for sending reports specified at Points c, d, dd, g, , Clauses 2 and 3, Article 11 of this Circular, branches of the State Bank in provinces and cities shall inspect the adequacy and reasonableness of data summarized from the electronic reporting items and forms for each operation center, branch of credit institutions, credit institution without branches in the area; If errors are detected, branches of the State Bank in provinces and cities shall send the results of data inspection through informatics networks to the Information Technology Administration in order to notify the reporting unit of transmitting correct data.

b) Within 01 working day after receiving notice of electronic inspection of the Information Technology Administration, branches of the State Bank in provinces, cities must transmit fully and accurately the reporting data to the Information Technology Administration so that Bank Supervision and Inspection Agencies, Departments can use.

4. Credit institutions:

Within 03 working day after receiving notification of electronic inspection of the Information Technology Administration, the head offices of credit institutions must transmit fully and accurately the reporting data to the Information Technology Administration so that the affiliates of the State bank can use.

Article 13. Inspection process for written report forms

1. Bank Supervision and Inspection Agencies, Departments:

a) Within 02 working days from the deadline for sending report specified in the written report forms, Bank Supervision and Inspection Agencies, Departments shall inspect the adequacy and reasonableness of the data summarized from the written report forms; In case of detecting that the reporting unit did not send the reporting data or the reporting data is incorrect, Bank Supervision and Inspection Agencies, Departments shall notify the reporting unit by phone or fax for sending the sufficient reporting data or resending the correct data.

b) Within 01 working day after receiving the notification of inspection by phone or fax from Bank Supervision and Inspection Agencies, Departments, the reporting unit must send the sufficient reporting data or resend correct data to Bank Supervision and Inspection Agencies, Departments.

2. Branches of the State Bank in provinces, cities:

a) Within 02 working days from the deadline for sending report specified in the report forms applicable to the people's credit Fund, branches of the State Bank in provinces and cities shall inspect the adequacy and reasonableness of the data summarized from the written report forms of the people's credit fund in the area; In case of detecting that the people's credit fund did not send the reporting data or the reporting data is incorrect, branches of the State Bank in provinces and cities shall notify the people's credit fund by phone or fax for sending the sufficient data or resending the correct data.

b) As soon as receiving the written notification re-sent by the people's credit fund in the area, branches of the State Bank in provinces and cities must summarize fully and accurately the reporting data and transmit it through informatics network to the Information Technology Administration so that the affiliates of the state bank can use.

3. people's credit fund:

Within 02 working days after receiving the notification of inspection by phone or fax of branches of the State Bank in provinces and cities, the people's credit fund must send the full data or re-send the correct data to branches of the State Bank in provinces and cities.

Article 14. Reporting items and forms not arising

In case reporting items and forms specified in Appendix 1, Appendix 4a and 4b do not arise, reporting units shall comply with the guidelines of the Information Technology Administration.

Chapter 2.

RESPONSIBILITIES OF AFFILIATES OF THE STATE BANK AND CREDIT INSTITUTIONS IN IMPLEMENTATION OF STATISTICS REPORTS

Article 15. Responsibilities of Bank Supervision and Inspection Agencies, Departments according to assigned functions, tasks

1. Formulate reporting items and forms relating to performing the functions, tasks of their units.

2. Formulate reporting items and forms required for amendment, supplementation, or newly issuance, agree with the Monetary Statistics and Forecast Department on such reporting items and forms which are sent to the Governor of State Bank by the Monetary Statistics and Forecast Department for issuance when receiving request for amendment, supplement or new issuance of reporting items and forms relating to the performance of functions and tasks of their units.

2. Cooperate with the Monetary Forecast and Statistics Department to organize training courses on statistical reports, to provide guidance on setting up reporting items and forms formulated by their own units.

3. Cooperate with the Monetary Forecast and Statistics Department to provide guidance and make timely reply to reporting units on problems relating to their responsibilities in implementing this Circular. In case of being assigned to provide guidance or make reply to reporting units by the Governor of the State Bank for the matter within their professional, management scope, they must copy their guiding documents or written reply to the Monetary Forecast and Statistics Department.

4. Monitor and expedite reporting units to submit fully and promptly reporting items and forms as prescribed in Article 16 of this Circular; promptly request reporting units to rectify and resend the correct data when detecting errors in reporting items; cooperate with the Information Technology Administration to inspect the sending of electronic report of reporting units through informatics networks.

5. Process, censor reporting items and forms undertaken by their units, transmit data that has been censored through informatics network to the Information Technology Administration for update to general data warehouse of the State Bank within 10 working days from the deadline for sending reports specified at Points c, d, dd, e, g, paragraphs 2 and 3, Article 11 of this Circular.

6. Quarterly, make comment and assess the implementation of statistical report of reporting units for reporting items and forms undertaken by their units and send to The Monetary Statistics and Forecast Department at the latest on the last working day of the first month of following quarter for summary and general notification.

7. Retain and manage written statistical reports that their units directly receive from the reporting units under the current regulations on management and retention of documents in the banking sector.

8. Cooperate with Bank Supervision and Inspection Agency and internal Audit Department to inspect organizations and units involved in the implementation of this Circular.

9. Formulate and send the reporting items and forms to recipients of report under the provisions of this Circular.

Article 16. Responsibilities of Bank Supervision and Inspection Agencies, Departments in formulation, monitoring, speeding up, inspection and summary of reporting items and forms

1. The Monetary Forecast and Statistics Department: 1A.1, 1B.1, 1D, 1G, 2A, 2B, 5A.7, 7C, 7D, 7E.

2. The Financial policy department: 1C, 3A, 7B.

3. The Credit Department:1A.2, 1A.3, 1B.2, 1B.3, 1E, 7A.3, 7A.4, 8E.

4. The Foreign Exchange Management Department: 5A.1,5A.2, 5A.3, 5A.4, 5A.5, 5A.6, 5B.

5. The Billing Department: 4A, 4B.

6. The Issue and Vault Department: 4C.

7. The Bank Supervision and Inspection Agency: 6A, 6B, 6C, 8A, 8B, 8C, 8D, 8G, 8H, 81, 8K, 8L, 8M, 8N, 8O, 8P, 8Q, 8R, 8S, 8T.

8. The operation center: 7A.1, 7A. 2.

9. The recipients of report that are specified in the reporting forms in Appendices 4a, 4b enclosed with this Circular shall be responsible for monitoring, expediting, inspecting and summarizing reporting items and forms that they received.

Article 17. Responsibilities of the Monetary Forecast and Statistics Department

In addition to responsibilities specified in Article 15 and Article 16 of this Circular, the Monetary Statistics and Forecast Department shall:

1. Be the focal unit in the State Bank to receive written petitions on the implementation of this Circular, and cooperate with related units to make reply to the units that sent such petitions; monitor the process for petitions of the relevant units.

2. Update and notify of the focal departments of statistics in affiliates of the State bank on the website of the State Bank for the credit institutions to contact or exchange information in case any problems arise.

3. Summarize and request the Governor of State Bank for approval of use, supplementation, change of the right to extract the censored reporting items and forms for affiliates of the State Bank.

4. Cooperate with relevant units to provide guidance and inspect the implementation of this Circular; quarterly, summarize comments, assessments the implementation of the provisions on statistical reports in this Circular and on behalf of the State Bank, send to relevant units for implementation.

5. Take charge and cooperate with relevant units to periodically formulate, retain, provide and publicize the general statistical data in accordance with law and direction of the Governor of State Bank.

Article 18. Responsibilities of Information Technology Administration

1. Be the focal unit in receiving reporting items and forms under the form of data files, inspect name and structure of the file, code of report item transmitted through network or sent through the information carrier by units. In case where the report’s name, file structure, or item code is wrong, request the reporting unit to correct and re-send the report as prescribed; response promptly to the condition of the data file for reporting units. In case where data transmission line of the State Bank has breakdown, promptly notify the reporting units and immediately take measures in order to remedy the problem.

2. Set up and manage statistical report data warehouse of the State Bank; ensure the use of statistical data for affiliates of the State Bank.

3. Connect and maintain information transmission networks for affiliates of the State bank.

4. Provide, set up, install and guide the operation of informatics program on statistical report for affiliates of the State bank in order to transmit, receive, monitor, summarize, use, inspect reporting items and forms through computer networks and in order to record, back up the journal of reporting items and forms that have been sent.

5. Take charge and cooperate with the Monetary Statistics and Forecast Department to conduct research, develop informatics programs applicable to statistical report, to implement the process of transmission and receipt, inspection of electronic reports through Informatics networks and to guide the implementation of this Circular in accordance with provisions of the Governor of State Bank.

6. Take charge and cooperate with affiliates of the State bank, head offices of credit institutions to handle problems during the process of inspection of electronic reports.

7. Provide guidance on the allocation and management of codes, electronic signature program used for statistical report for the reporting units directly connecting information transmission network to the Information Technology Administration.

8. Take charge and cooperate with the Monetary Statistics and Forecast Department and other relevant units to formulate and issue codes of statistical report items. Provide guidance on regulations on the names, data file structure of electronic reports and guide units in formulating, sending reporting items and forms which do not arise for the implementation of this Circular.

9. Formulate and provide guidance on the process of sending electronic report file applicable to affiliates of the State Bank if the data transmission system of the State Bank has breakdown.

10. Inspect and verify the transmission of report data file of the reporting unit and notify the recipients of report of the result for timely handling cooperation after receiving the report of units if the reporting unit notifies that it has transmitted a report data file, but the recipient of report has not received the reporting items through the network.

11. Promptly update reporting items and forms corrected at the request of the inspection of the State Bank by the reporting units.

12. Record and back up a journal of receiving reporting items and forms sent by the reporting units. Quarterly, no later than the last day of the first month of following quarter, send the notification of receiving & inspection reporting items and forms in the previous quarter to affiliates of the State bank through the informatics network to assess, comment and report on the implementation and observance of the provisions in this Circular of the reporting units.

13. Summarize, notify through informatics networks of results of processing, censoring reporting items and forms in the preceding month of Bank Supervision and Inspection Agencies, Departments and sent to Monetary Forecast and Statistics Department for general monitoring every month, no later than the 30th of next month.

Article 19. Responsibilities of Bank Supervision and Inspection Agency

In addition to the responsibilities specified in Article 15 and Article 16 of this Circular, Bank Supervision and Inspection Agency shall:

1. Inspect organizations, units and individuals involved in compliance with this Circular and handle violations as prescribed by law.

2. Handle violations as prescribed by law for organizations, units and individuals that commit violations against this Circular based on comment and assessment of the implementation of the provisions on quarterly statistical reports of the State Bank.

Article 20. Responsibilities of the Internal Audit Department

The Internal Audit Department is responsible for inspecting the observance of this Circular of affiliates of the State bank through audits.

Article 21. Responsibilities of branches of the State Bank in provinces, cities

1. Expedite the people's credit Fund in the area to send fully and promptly reporting items and forms; inspect the reasonableness of the reports; summarize reports and then send to the State Bank as prescribed in this Circular.

2. Comply with the provisions in Article 14 of this Circular in case activities relating to content of the item or forms of reporting prescribed in this Circular have not arisen or do not arise in the provinces, cities.

3. Quarterly comment, assess and notify the implementation of this Circular of the people's credit funds in the area, and report to the State Bank (Monetary Forecast and Statistics Department ) no later than the last working day of the first month of following quarter for summary and general notification.

4. Formulate and send the reporting items and forms to reporting units under the provisions of this Circular. Inspect, correct promptly, and send the report to the Information Technology Administration after receiving the requirement of electronic report inspection of the Information Technology Administration.

5. directly contact with affiliates of the State bank which are responsible for monitoring, summarizing reporting items and forms as prescribed in Article 16 of this Circular or report in writing to the State Bank ( Monetary Forecast and Statistics Department) when problems arise during the implementation.

6. inspect the observance of the provisions of this Circular for the organizations, units and individuals in the area under their management competence.

Article 22. Responsibilities of credit institutions

1. Comply with the provisions on statistical reports of the Governor of State Bank in this Circular. During the process of implementation, if any problems arise, promptly report to the State Bank as follows:

a) the head office of the credit institution (excluding people's credit fund and branch of foreign bank which is not the focal branch of the branches of the same operation system in Vietnam) directly contacts with affiliates of the State Bank which are responsible for monitoring and summarizing reporting items and forms as prescribed in Article 16 of this Circular or reports in writing to the State Bank (Monetary Forecast and Statistics Department).

b) The people's credit Fund contacts directly or reports in writing to branches of the State Bank in provinces and cities where its head office is located.

2. Be a focal unit sending report and bearing full responsibility before the law and the Governor of State Bank for the adequacy, timeliness and accuracy of the general data in whole system, detailed data of each transaction office, branch of credit institutions in the system sent to the State Bank under the guidance in Appendix 2. (The head office of the credit institution)

3. promptly correct the report, resend the right report to the State Bank, and explain the errors to the recipient of the report upon receiving notification of electronic report inspection of the Information Technology Administration or detecting errors in the report sent to the State Bank (the headquarter of credit institution)

4. comply with Article 14 of this Circular if activities relating to the content of each group of reporting items or reporting forms prescribed in this Circular have not arisen or do not arise in the credit institutions.

Article 23. Development of reporting items and forms

1. The affiliates of the State bank are allowed to develop reporting items and forms which their units are responsible for formulation, monitoring, urging and inspection and summarizing as provided for in Article 16 of this Circular.

2. If affiliates of the State bank wish to develop reporting items and forms censored by other units under the State Bank, they must register in writing with the Monetary Forecast and Statistics Department to summarize and request the Governor of the State Bank for approval.

3. The units, individuals that are permitted to develop reporting items and forms shall be responsible for management and use of information and statistical data for proper purposes and complying with the legislation on information security.

Chapter 3.

IMPLEMENTATION

Article 24. Emulation and commendation 

 If organizations, units, and individuals implement effectively the provisions of this Circular, it shall be one of the conditions for the State Bank to consider giving the emulation titles and commendation forms as prescribed by the current legislation.

Article 24. Actions against violations

Organizations, units, and individuals committing violation against the provisions of this Circular, depending on the nature and seriousness of the violation shall be handled in accordance with the current law.

Article 25. Effect

1. This Circular takes effect from December 1, 2014.

2. This Circular replaces the Governor of the State Bank’s Circular No. 21/2010/TT-NHNN dated October 8, 2010 regulating statistical reports applicable to affiliates of the State bank and credit institutions, branches of foreign banks.

3. The Chief officers, the Director of Monetary Forecast and Statistics Department, the Heads of relevant units under the State Bank, the President of the Board of Directors, the President of the Member assembly and the General Directors ( Directors) of credit institutions shall be responsible for the implementation of this Circular.
