DECISION
issuance of revised land price schedules for a period of 5 years (2015 - 2019) in Tra Vinh Province
PEOPLE’S COMMITTEE OF TRA VINH PROVINCE
Pursuant to Law on Local Government Organization dated June 19, 2015;
Pursuant to the Law on promulgation of legislative documents dated June 22, 2015;
Pursuant to Law on Land dated November 29, 2013;
Pursuant to Decree No. 43/2014/ND-CP dated May 15, 2014 of Government on elaborating to a number of articles of Law on Land;
Pursuant to Decree 44/2014/ND-CP dated May 15, 2014 of Gorvernment on land price;
Pursuant to Decree 104/2014/ND-CP dated November 14, 2014 of Gorvernment on land price;
Pursuant to Decree No. 01/2017/ND-CP dated January 06, 2017 of Government on amendments to a number of Decrees elaborating Law on Land;
Pursuant to Circular No. 36/2014/TT-BTNMT dated June 30, 2014 of Minister of Natural Resources and Environment on elaborating land price evaluating methods; development and revision of land price schedule; specific land price evaluation and consultation on land price determination;
Pursuant to Resolution No. 15/2014/NQ-HDND dated December 05, 2014 of provincial People's Council on approval of Land price schedule for a period of 5 years (2015 - 2019) in Tra Vinh Province;
Pursuant to Resolution No. 31/2017/NQ-HDND dated July 13, 2017 of provincial People's Council on amendments to a number of Articles of the Land price schedule for a period of 5 years (2015 – 2019) in Tra Vinh Province attached to Resolution No. 15/2014/NQ-HDND dated December 05, 2014 of provincial People's Council;
At request of the Director of Department of Natural Resources and Environment,
HEREBY DECIDES:
Article 1: Attached to this Decision are Land price schedules for a period of 5 years (2015 - 2019) in Tra Vinh Province.
Article 2. This Decision comes into force from August 10, 2017 and supersedes Decision No. 40/2014/QD-UBND dated December 19, 2014 of People’s Committee of Tra Vinh Province.
With respect to valid documents determining financial obligations of land users accepted and replied by reception before the effective date hereof, apply land price listed in the Land price schedule for a period of 5 years (2015 – 2019) in Tra Vinh Province attached to Decision No. 40/2014/QD-UBND dated December 19, 2014 of provincial People’s Committee to determine financial obligations.
Article 3. Chief of Office of provincial People’s Committee, Director of Department of Natural Resources and Environment, heads of provincial departments, Chairpersons of People’s Committee of districts, communes, cities; relevant oragnizations, households and persons shall implement this Decision./.

REVISED LAND PRICE SCHEDULES FOR A PERIOD OF 5 YEARS (2015 - 2019) IN TRA VINH PROVINCE
(Attached to Decision No. 15/2017/QD-UBND dated July 31, 2017 of People's Committee of Tra Vinh Province)
Chapter I
GENERAL PROVISIONS
Article 1. Scope
Revised Land price schedules for a period of 5 years (2015 - 2019) in Tra Vinh Province shall be used to:
1. Calculate land use levy when the State recognizes residential land use rights of households and individuals with respect to area portion within limit; allow shift from land use purpose from agricultural land, non-agricultural land for purposes other than residential to residential with respect to area portion within limit of land allocated to households and individuals.
2. Calculate land use tax.
3. Calculate fines for administrative land-related offences.
4. Calculate administrative fines relating to land.
5. Calculate compensation paid to the State upon damage during land management and use.
6. Calculate land use value repaid to persons voluntarily return land to the State provided the returned land is levied land allocated by the State, levied land recognized for use rights, l eased land with full one-off rental payment for the entire lease period.
7. Determine specific land price using land pricing coefficient method as specified in Article 18 of Decree No. 44/2014/ND-CP dated may 15, 2014 of Government on land price.
Article 2. Price schedule of different land types
1. Agricultural land:
- Price schedule of lands for cultivation of annual crops such as paddy land and land for other annual crops; price schedule of lands for fishery.
- Price schedule of lands for cultivation of perennial plants
- Price schedule of lands for production forest.
- Price schedule of lands used as salt farms.
- Price schedule of lands for protection forests.
- Price schedule of other agricultural lands.
2. Non-agricultural land:
- Price schedule of residential lands.
- Price schedule of lands for business operation.
- Price schedule of lands for non-agricultural manufacturing and trade other than for business operation.
- Price schedule of lands for construction of non-business facilities.
- Price schedule of lands for religious establishments; price schedule of lands for folk religious establishments; price schedule of land for cemetaries, graveyards, funeral parlours and cremation centers.
- Price schedule of lands for public purposes.
- Price schedule of lands in rivers, canals, streams, springs and special use water surface.
Article 3. Classification of traffic roads
General traffic roads include: National highways, Provincial roads, district roads, chip seal roads, dirt roads, dirt roads paved with concrete or cement (hereinafer rereferred to as “paved roads”). And there are arterial roads, collector streets, tertiary streets.
1. Arterial roads are traffic roads in urban areas (routes listed under Land price schedule attached to this price schedule, except for traffic roads in communes).
2. Collector roads are roads that directly lead to the traffic roads.
3. Tertiary streets are streets that connect collector roads and tertiary roads with each other.
Article 4. Methods of determining benchmarks for calculation of position of land types
With respect to calculation of position of both agricultural and non-agricultural lands, benchmarks can be determined as follows:
- From road perimeters or construction boundary line with respect to roads required by the law to have traffic perimeters.
- From bridge and culvert perimeters with respect to bridges and culverts required by the law to have bridge and culvert perimeters.
- From borders or boundaries where the State has compensated or cleared with respect to sea, rivers, canals, springs.
- From borders of land plots on cadastral map with respect to:
+ Land plots ajoining roads not required to have traffic perimeters.
+ Land plots adjoining sea, rivers, canals, springs without borders or boundaries where the State has compensated or cleared.
Article 5. Classification of position of agricultural land
1. Lands for annual crop, lands for perennial plants, lands for fishery, other agricultural lands
Consisting of 3 positions: position 1, position 2 and position 3 (remaining position)
a) With respect to Tra Vinh City, wards of Duyen Hai Town and townlets:
- Position 1: 60 meters in from benchmark of road perimeters.
- Position 2:
+ Next 60 meters from position 1.
+ 60 meters in from benchmark of rivers, canals, springs whose width exceeds 5 meters.
- Position 3 (remaining position): other than positions mentioned above.
b) With respect to other communes:
- Position 1:
60 meters in from benchmark of National highways, Provincial roads, district roads and traffic roads whose width equals or exceeds 3.5 meters.
- Position 2:
+ Next 60 meters from position 1.
+ 60 meters in from benchmark of other roads.
+ 60 meters in from benchmark of rivers, canals, springs whose width exceeds 5 meters.
+ 60 meters in from benchmark of sea.
- Position 3 (remaining position): other than positions mentioned above.
2. Lands for salt farms, lands for production forest, lands for protection forests
Consisting of 2 positions: position 1 and position 2.
a) Position 1: 60 meters in from benchmark of roads, seas, rivers, canals and springs.
b) Position 2: remaining land positions.
Article 6. Classification of position of non-agricultural land
Consisting of 5 positions: position 1, position 2, position 3, position 4 and position 5 (remaining position)
1. With respect to land plot directly adjoining roads specified in Annex attached to this Price schedule
- Position 1: 30 meters in from benchmark.
- Position 2: next 30 meters from position 1.
- Position 3: next 30 meters from position 2.
- Position 4: next 30 meters from position 3.
- Position 5 (remaining position): exceeding 120 meters.
2. With respect to land plot directly adjoining collector and tertiary roads (except those specified in Annex attached to this Price schedule)
- Collector roads whose width equals or exceeds 4 meters.
+ Position 2: 30 meters in from benchmark.
+ Position 3: next 30 meters from position 2.
+ Position 4: next 30 meters from position 3.
+ Position 5 (remaining position): other than positions mentioned above.
- Collector roads whose width ranges from 2.0 meters to less than 4.0 meters; tertiary roads whose width equals or exceeds 2.5 meters.
+ Position 3: 30 meters in from benchmark.
+ Position 4: next 30 meters from position 3.
+ Position 5 (remaining position): other than positions mentioned above.
- Collector roads whose width ranges from 1.0 meters to less than 2.0 meters; tertiary roads whose width ranges from 1.0 meters to less than 2.5 meters.
+ Position 4: 30 meters in from benchmark.
+ Position 5 (remaining position): other than positions mentioned above.
Note: Position 2 and position 3 of collector and tertiary roads only apply within 150 meters perpendicular to center of roads specified in Annexto this Price schedule. Any position beyond the 150-meter range shall be considered as position 4. If the 150-meter mark does not cover the land plot, the whole land plot shall be determined as position 4.
3. With respect to a land plot that lies beyond a land plot of other owner directly adjoining roads but does not adjoin collector, tertiary or traffic roads of communes connecting roads and routes specified in Annex of this Price schedule
- Position 2: 30 meters in from benchmark.
- Position 3: next 30 meters from position 2.
- Position 4: next 30 meters from position 3.
- Position 5 (remaining position): exceeding 90 meters.
4. With respect to a land plot that does not directly adjoin a road due to canal or spring
- Position 3: 30 meters in from benchmark.
- Position 4: next 30 meters from position 3.
- Position 5 (remaining position): exceeding 60 meters.
5. With respect to a land plot that adjoins traffic roads of communes connecting roads and routes specified in Annex of this Price schedule
- Traffic roads whose width equals or exceeds 4 meters:
+ Position 2: 30 meters in from benchmark within 200 meters perpendicular to center of roads specified in Annex of this Price schedule.
+ Position 3: 30 meters in from benchmark from 200 meters to less than 400 meters perpendicular to center of roads specified in Annex of this Price schedule.
+ Position 4: 30 meters in from benchmark and exceeds 400 meters perpendicular to center of roads specified in Annex of this Price schedule.
+ Position 5 (remaining position): other than positions mentioned above.
- Traffic roads whose width is less than 4 meters:
+ Position 3: 30 meters in from benchmark within 200 meters perpendicular to center of roads specified in Annex of this Price schedule.
+ Position 4: 30 meters in from benchmark from 200 meters to less than 400 meters perpendicular to center of roads specified in Annex of this Price schedule.
+ Position 5 (remaining position): other than positions mentioned above.
6. Land positions other than those specified in Clauses 1, 2, 3, 4 and 5 of this Article shall be at position 5.
7. When shifting from agricultural land to non-agricultural land and price of non-agricultural land is lower than that of agricultural land before the shift in land use purposes when determining land position as per the law, the land shall be determined to be equal to the price of agricultural land.
Article 7. Solution to discrepancies between position and price of land within same area
1. Price of lands within traffic perimeters shall equal that of adjacent land at the highest position.
2. In case price of lands at position 2, 3 or 4 of non-agricultural land is lower than that of lands at position 5 of respective land type, may adopt price of land at position 5.
3. In case a land plot directly adjoins at least 2 roads, land price shall be determined based on whichever road has the highest price.
4. In case a land plot adjoining a collector or tertiary roads that are not specified in annex hereto for land price or traffic roads that are not specified in annex hereto for land price directly links to 2 routes having different land price, land price thereof shall be determined based on whichever route is nearer to the land plot.
5. With respect to a non-agricultural land plot which is situated from benchmark to 30 meters without directly adjoining roads, does not share the same owner with any land plot directly adjoining roads specified in annex hereto and adjoins a collector or tertiary road, land price shall be determined based on regulated price of the respective collector or tertiary road.
6. With regard to 2 road segments on the same horizontal alignment, if difference between non-agricultural land prices of those road segments exceeds 30%, price of 100 meters of land where the road with lower price is constructed adjoining the other road shall be determined as follows:
- Land plots included within the first 50 meters from the contact point and belonging to the road with the lower price shall be added with 70% of the difference in price between the two roads.
- Land plots stretching from exceeding 50 meters up to 100 meters and belonging to the road with the lower price shall be added with 40% of the difference in price between the two roads.
- In case a land plot is not concluded at 50-meter mark, price of that land plot which is supposed to have 2 price levels shall be added with 55% of the difference in price between the two roads.
- In case a land plot is not concluded at 100-meter mark, price of that land plot which is supposed to have 2 price levels shall be added with 20% of the difference in price between the two roads.
Examples:
Price of land at position 1 of segment of Phu Hoa Road from Pham Ngu Lao Road to Vanh Dai Road is VND 2,500,000/m2 and price of land at position 1 of segment of Phu Hoa Road from Vanh Dai Road to the boundary of Ward 1 is VND 1,300,000/m2.
- Difference = 2,500,000 - 1,300,000 = VND 1,200,000.
- Percentage = x 100% = 48% (>30%)
- Price of land plots within the first 50 meters shall be determined:
Price = 1,300,000 + 1,200,000 x 70% = VND 2,140,000/m2.
- Price of land plots stretching from exceeding 50 meters up to 100 meters shall be determined:
Price = 1,300,000 + 1,200,000 x 40% = VND 1,780,000/m2.
- In case a land plot is not concluded at 50-meter mark, price thereof shall be determined:
Price = 1,300,000 + 1,200,000 x 55% = VND 1,960,000/m2.
- In case a land plot is not concluded at 100-meter mark, price thereof shall be determined:
Price = 1,300,000 + 1,200,000 x 20% = VND 1,540,000/m2.
7. If differece between prices of agricultural lands at adjoining areas between communes, wards and townlets equals or exceeds 20%, price of land with lower price within 120 meters from administrative division line of the adjoining areas shall equal that of land with higher price (depending on position 1, position 2 or position 3 and use purpose).
8. Determination of width of collector roads, tertiary roads or traffic roads
The width of collector roads, tertiary roads or traffic roads shall be determined based on the width of the entrace thereto.
Chapter II
PRICE OF AGRICULTURAL LANDS
Section 1. Lands for annual crop, fishery and perennial plants

Article 12. Price of lands for protection forests
Price of lands for protection forest shall be determined similar to that for production forest in each area with each position.
Article 13. Other agricultural lands
Price of other agricultural lands shall be determined similar to that of lands for perennial plants in each area with each position.
Chapter III
PRICE OF RESIDENTIAL LANDS AND NON-AGRICULTURAL LANDS
Section 1. residential lands
Article 14. Price of residential lands
1. Price of lands situated at position 1 is specified in Annexes (from Annex 1 to Annex 9) to this Price schedule.
2. Price of lands situated at position 2, position 3 and position 4 is determined:
+ Position 2: 60% of price of position 1.
+ Position 3: 40% of price of position 1.
+ Position 4: 30% of price of position 1.
3. Price of lands of collector roads, tertiary roads and traffic roads of communes under Clause 5 Article 6 adopt following multiplier:
+ Roads paved with asphalt, concrete or cemet: 1.0
+ Roads paved with chip seal: 0.7
+ Dirt roads: 0.5
4. Price of lands at position 5 (remaining position)

Article 15. Price of lands for business operation.

2. Price of lands for non-agricultural manufacturing and trade other than for business operation situated at position 5 (remaining position).

Article 17. Price of lands for construction of non-business facilities
Price of lands for construction of non-business facilities such as base of non-business organizations, culture center, social service facilities, medical facilities, education institutes, sports facilities, science and technology facilities, foreign affairs establishments and other non-business constructions shall equal that of lands for non-agricultural manufacturing and trade other than for business operation depending on each division and position.
Article 18. Price of lands for religious establishments, folk religious establishments, cemetaries, graveyards, funeral parlours and cremation centers.
Price of lands for religious establishments, folk religious establishments, cemetaries, graveyards, funeral parlours and cremation centers shall equal that of lands for non-agricultural manufacturing and trade other than for business operation depending on each divison and position.
Article 19. Price of lands for public purposes
Price of lands for public purposes including lands for traffic, hydroelectric facilities, historic – cultural heritage, scenery, community center, public playgrounds, recreational parks, energy facilities, telecommunication constructions, markets, waste piles, waste treatment facilities and other public constructions shall equal that of lands for non-agricultural manufacturing and trade other than for business operation depending on each division and position.
Article 20. Price of lands in rivers, canals, streams, springs and special use water surface
Price of lands in rivers, canals, streams, springs and special use water surface used for fishery shall equal that of lands for fishery farming within the same division and position.
In case lands in rivers, canals, streams, springs and special use water surface are used for non-agricultural purposes, price thereof shall equal used non-agricultural lands specified in price schedule of lands within the same divison and position.
