DECISION

ON PROCEDURES FOR OPERATING INTER-RESERVOIRS IN VU GIA - THU BON RIVER BASIN

THE PRIME MINISTER

Pursuant to the Law on Government Organization dated December 25, 2001;

Pursuant to the Law on Water Resources dated June 21, 2012;

Pursuant to the Law on Natural Disaster Prevention and Control dated June 19, 2013;

Pursuant to the Government’s Decree No. 112/2008/ND-CP dated October 20, 2008 on integrated management, protection and extraction of resources and hydroelectric and irrigation reservoir environment;

At the request of the Minister of Natural Resources and Environment,

DECIDES:

Article 1. The procedures for operating inter-reservoirs in Vu Gia - Thu Bon river basin, including A Vuong, Dak Mi 4, Song Tranh 2, Song Bung 4 r, Song Bung 4A and Song Bung 5 are promulgated together with this Decision.

Article 2. Implementation clause

1. This Decision comes into force from the day on which it is signed.

2. The Decision No. 909/QD-TTg dated June 16, 2014 of the Prime Minister on the procedures for operating inter-reservoirs in Vu Gia - Thu Bon river basin during annual flood season.

3. When Song Tranh 2 reservoir is allowed to store water until it reaches retention water level by a competent authority, it shall be operated in accordance with regulations of this document.

4. The reservoir operation procedures issued before the effective date of this Decision shall be amended to conform to this Decision.

Article 3. The Minister of Natural Resources and Environment, Minister of Agriculture and Rural Development, Minister of Industry and Trade, Minister of Construction, head of the Central Steering Committee for Natural Disaster Prevention and Control, President of the People’s Committee of Quang Nam province, President of the People’s Committee of Da Nang city, heads of the Steering Committee for Natural Disaster Prevention and Control, Search and Rescue of Quang Nam province, and Steering Committee for Natural Disaster Prevention and Control, Search and Rescue of Da Nang city, Director General of the National Centre for Hydro - Meteorological Forecasting, heads of entities in charge of management and operation of reservoirs (hereinafter referred to as “managing entities”) and relevant authorities are responsible for the implementation of this Decision./.

PROCEDURES

FOR OPERATING INTER-RESERVOIRS IN VU GIA - THU BON RIVER BASIN
(Enclosed with the Decision No. 1537/QD-TTg dated September 07, 2015 of the Prime Minister)

Chapter I

GENERAL PROVISIONS

Article 1. Annually operating A Vuong, Dak Mi 4, Song Tranh 2, Song Bung 4 r, Song Bung 4A and Song Bung 5 reservoirs in the following order of priority:

1. During flood season:

a) Ensure safety of hydropower plants:

- Ensure absolute safety of A Vuong, Dak Mi 4, Song Tranh 2 and Song Bung 5 hydropower plants, prevent reservoir’s water level from exceeding the checked water level for all floods with a repeated cycle of less than or equal to 1,000 years;

- Ensure absolute safety of Song Bung 4 hydropower plant, prevent reservoir’s water level from exceeding the checked water level for all floods with a repeated cycle of less than or equal to 5,000 years;

- Ensure absolute safety of Song Bung 4A hydropower plant, prevent reservoir’s water level from exceeding the checked water level for all floods with a repeated cycle of less than or equal to 500 years;

b) Contribute to reduction of floods hitting lowlands;

c) Ensure efficiency in electricity generation.

2. During dry season:

a) Ensure safety of hydropower plants;

b) Ensure minimum river runoff and lowlands’ water demand;

c) Ensure efficiency in electricity generation.

Article 2. Interpretation of flood and dry seasons provided in this document:

1. The flood season lasts from September 01 to December 15.

2. The dry season lasts from December 16 to August 31 of the succeeding year.

Article 3. Operation of discharge works of reservoirs and spillways

1. Discharge works of reservoirs shall be operated according to the issued procedures for discharge work operation to ensure stability of central works.

2. While water supply is being provided during dry season, An Trach, Thanh Quyt, Bau Nit and Ha Thanh spillways must be closed unless little fullness flood occurs.

Chapter II

OPERATION OF A VUONG, DAK MI 4, SONG TRANH 2, SONG BUNG 4 R, SONG BUNG 4A AND SONG BUNG 5 RESERVOIRS DURING FLOOD SEASON

Article 5. Rules for operating reservoirs to reduce floods hitting lowlands

1. The storage capacity from retention water level to checked flood water level must not be used to regulate flood when valves of the discharge work are yet to be fully open unless otherwise stated in the decision of the Prime Minister or head of the Central Steering Committee for Natural Disaster Prevention and Control.

2. The operation of reservoirs to reduce floods hitting lowlands shall comply with procedures for closing and opening valves of the discharge work, which are issued by the competent authority and ensure no creation of artificial flood, which may threaten lives and assets of people living in riverside area in lower reservoirs.

3. During the flood season specified in Clause 1, Article 2 of this document, while reservoirs have not been operated, water level at such reservoirs shall not exceed the maximum water level before flood provided in Table 2, except for the case prescribed in Clause 1, Article 13 of this document.

4. During operation, it is required to regularly update information about weather, rain, floods and water level at hydrological stations, reservoir water level, reservoir inflow, and the next weather forecasts to operate and regulate reservoirs in a manner that suits actual conditions.

5. After the process of reducing floods hitting lowlands is completed, reservoir water level shall be gradually reduced to the water level before flood provided in Table 2, except for the case specified in Article 13 of this document.

Article 6. Water level maintained during operation of reservoirs during flood season

1. The water level corresponding to the river flood water warning level at hydrological stations is provided in Table 1.

2. The maximum water level before flood at reservoirs during flood season is provided in Table 2.

4. The water level at hydrological stations, which is the basis for operation of reservoirs for flood reduction, is provided in Table 4.

Article 7. Operating A Vuong, Dak Mi 4 and Song Bung 4 reservoirs to reduce floods hitting lowlands

1. The power to decide to issue a reservoir operation order during flood season:

a) Under normal weather conditions, the Director of the managing entity shall, on his/her own initiative, operate and regulate the reservoir in a manner that water does not exceed the level provided in Table 2, except for the case specified in Article 13 of this document;

b) If the weather conditions specified in Clause 2 of this Article prevail or rain and flooding events specified in Clauses 3, 4 and 5 of this Article occur, the head of the Steering Committee for Natural Disaster Prevention and Control, Search and Rescue of Quang Nam province shall decide to operate reservoirs.

2. Operating reservoirs to reduce flood prevention water level:

When the National Centre for Hydro - Meteorological Forecasting forecasts an emergency storm, inshore tropical depression or other weather conditions, which are likely to cause rain and flood, thereby directly affecting the areas in Vu Gia - Thu Bon river basin in the next 24-to-48 hours, reservoirs shall be operated as follows:

a) In the event the reservoir water exceeds the level provided in Table 3, the head of the Steering Committee for Natural Disaster Prevention and Control, Search and Rescue of Quang Nam province shall decide to operate reservoirs as follows:

- If water at Ai Nghia hydrological station is on warning level II and below the level provided in Table 4, reservoirs shall be operated and regulated in a manner that the total discharge equals the reservoir inflow to maintain current reservoir water level;

- If water at Ai Nghia hydrological station is below warning level II, reservoirs shall be operated and regulated in a manner that the total discharge is greater than the reservoir inflow to gradually reduce water level, but not below the level provided in Table 3. During operation, if water at Ai Nghia hydrological station exceeds warning level II and is below the level provided in Table 4, reservoirs shall be operated and regulated in a manner that the total discharge equals the reservoir inflow to maintain current reservoir water level.

b) If reservoir water is below the level provided in Table 3, the reservoir owners may operate and regulate reservoirs in a manner that water does not exceed the level provided in Table 3;

c) During the operation carried out as prescribed in Points a and b of this Clause, according to the weather forecast provided by the National Centre for Hydro - Meteorological Forecasting, if the weather conditions which may cause rain and flood are no longer likely to directly affect the areas in Vu Gia - Thu Bon river basin, the reservoir owners may operate and regulate reservoirs to gradually reduce water level to the level provided in Table 2.

3. After the process of operating and regulating reservoirs to reduce flood prevention water level as prescribed in Points a and b, Clause 2 of this Article is completed, but the conditions for operation of reservoirs to reduce floods hitting lowlands, which are specified in Clause 4 of this Article, are yet to prevail, reservoirs shall be operated in a manner that the total discharge equals the reservoir inflow to maintain current reservoir water level and shall be fully operational to reduce floods hitting lowlands when the order of the head of the Steering Committee for Natural Disaster Prevention and Control, Search and Rescue of Quang Nam province is issued.

4. Operating reservoirs to reduce floods hitting lowlands:

a) When water at Ai Nghia hydrological station exceeds the level provided in Table 4, the head of the Steering Committee for Natural Disaster Prevention and Control, Search and Rescue of Quang Nam province shall decide to operate reservoirs in a manner that the total discharge is below the reservoir inflow to reduce floods hitting lowlands, but the reservoir water level must not exceed the retention water level;

b) When the reservoir water reaches the retention water level, reservoirs shall be operated and regulated in a manner that the total discharge equals the reservoir inflow.

5. Operating reservoirs to reduce the water level to the maximum water level before flood:

a) When water at Ai Nghia hydrological station is below warning level I, the head of the Steering Committee for Natural Disaster Prevention and Control, Search and Rescue of Quang Nam province shall decide to operate and regulate reservoirs in manner that the total discharge is greater the reservoir inflow for from 24 to 72 hours to gradually reduce reservoir water level to the level provided in Table 2;

b) During operation, if water at Ai Nghia hydrological station is on warning level II, reservoirs shall be operated and regulated to maintain current reservoir water level.

6. In unusual circumstances, the President of the People’s Committee of Quang Nam province shall decide to operate A Vuong, Dak Mi 4 and Song Bung 4 reservoirs.

Article 8. Operating Song Tranh 2 reservoir to reduce floods hitting lowlands

1. The power to decide to issue a reservoir operation order during flood season:

a) Under normal weather conditions, the Director of the managing entity shall, on his/her own initiative, operate and regulate the reservoir in a manner that the reservoir water does not exceed the level provided in Table 2, except for the case specified in Article 13 of this document;

b) If the weather conditions specified in Clause 2 of this Article or rain and flooding events specified in Clauses 3, 4 and 5 of this Clause prevail, the head of the Steering Committee for Natural Disaster Prevention and Control, Search and Rescue of Quang Nam province shall decide to operate the reservoir.

2. Operating reservoir to reduce flood prevention water level:

When the National Centre for Hydro - Meteorological Forecasting forecasts an emergency storm, inshore tropical depression or other weather conditions, which are likely to cause rain and flood, thereby directly affecting the areas in Vu Gia - Thu Bon river basin in the next 24-to-48 hours, the reservoir shall be operated as follows:

a) In the event the reservoir water exceeds the level provided in Table 3, the head of the Steering Committee for Natural Disaster Prevention and Control, Search and Rescue of Quang Nam province shall decide to operate the reservoir as follows:

- If water at Cau Lau hydrological station is on warning level II and below the level provided in Table 4, the reservoir shall be operated and regulated in a manner that the total discharge equals the reservoir inflow to maintain current reservoir water level;

- If water at Cau Lau hydrological station is below warning level II, the reservoir shall be operated and regulated in a manner that the total discharge is greater than the reservoir inflow to gradually reduce water level, but not below the level provided in Table 3. During operation, if water at Cau Lau hydrological station exceeds warning level II and is below the level provided in Table 4, the reservoir shall be operated and regulated in a manner that the total discharge equals the reservoir inflow to maintain current reservoir water level.

b) If reservoir water is below the level provided in Table 3, the reservoir owner may operate the reservoir to regulate water in a manner that water does not exceed the level provided in Table 3;

c) During the operation carried out as prescribed in Points a and b of this Clause, according to the weather forecast provided by the National Centre for Hydro - Meteorological Forecasting, if the weather conditions which may cause rain and flood are no longer likely to directly affect the areas in Vu Gia - Thu Bon river basin, the reservoir owner may operate and regulate the reservoir to gradually reduce water level to the level provided in Table 2.

3. After the process of operating and regulating the reservoir to reduce flood prevention water level as prescribed in Points a and b, Clause 2 of this Article is completed, but the conditions for operation of reservoirs to reduce floods hitting lowlands, which are specified in Clause 4 of this Article, are yet to prevail, the reservoir shall be operated in a manner that the total discharge equals the reservoir inflow to maintain current reservoir water level and shall be fully operational to reduce floods hitting lowlands when the order of the head of the Steering Committee for Natural Disaster Prevention and Control, Search and Rescue of Quang Nam province is issued.

4. Operating the reservoir to reduce floods hitting lowlands:

a) When water at Cau Lau hydrological station exceeds the level provided in Table 4, the head of the Steering Committee for Natural Disaster Prevention and Control, Search and Rescue of Quang Nam province shall decide to operate reservoirs in manner that the total discharge is below the reservoir inflow to reduce floods hitting lowlands, but the reservoir water level must not exceed the retention water level;

b) When the reservoir water reaches the retention water level, the reservoir shall be operated and regulated in a manner that the total discharge equals the reservoir inflow.

5. Operating the reservoir to reduce the water level to the maximum water level before flood:

a) When water at Cau Lau hydrological station is below warning level I, the head of the Steering Committee for Natural Disaster Prevention and Control, Search and Rescue of Quang Nam province shall decide to operate and regulate the reservoir in manner that the total discharge is greater the reservoir inflow for from 24 to 72 hours to gradually reduce reservoir water level to the level provided in Table 2;

b) During operation, if water at Cau Lau hydrological station is on warning level II, the reservoir shall be operated and regulated to maintain current reservoir water level.

6. In unusual circumstances, the President of the People’s Committee of Quang Nam province shall decide to operate Song Tranh 2 reservoir.

Article 9. Simultaneously operating Song Bung 4A and Song Bung 5 reservoirs to reduce floods hitting lowlands

1. During operation of A Vuong and Song Bung 4 reservoirs to reduce flood prevention water level, Song Bung 4A and Song Bung 5 reservoirs shall be operated and regulated in a manner that the total discharge equals the reservoir inflow to maintain current reservoir water level. When A Vuong and Song Bung 4 reservoirs are operated to reduce floods hitting lowlands, Song Bung 4A and Song Bung 5 reservoirs shall be operated and regulated in a manner that the total discharge is below the reservoir inflow to reduce floods hitting lowlands. When the reservoir water reaches the retention water level, reservoirs shall be operated and regulated in a manner that the total discharge equals the reservoir inflow.

2. In unusual circumstances, the President of the People’s Committee of Quang Nam province shall decide to operate Song Bung 4A and Song Bung 5 reservoirs.

Article 10. Ensuring work safety during operation

When the reservoir water reaches the retention water level while the level of flood water flowing to reservoirs continues to rise, thereby affecting safety of works, reservoirs shall be operated in the manner that ensures safety of works according to the reservoir operation procedures issued by the competent authority.

Article 11.

If not involved in reduction of floods hitting lowlands, Dak Mi 4 reservoir shall continuously discharge water into the lower Vu Gia river at a flow rate of at least 3 m3/s. In case the People's Committee of Da Nang city requests a higher rate, Dak Mi 4 shall discharge water into the lower Vu Gia river upon request at a flow rate not exceeding 12.5 m3/s.

Article 12.

When the National Centre for Hydro - Meteorological Forecasting or its affiliates warn a great flood will occur or flood water flows to reservoirs but fail to make a forecast in addition to the period specified in Clause 1, Article 2 of this document, the head of the Steering Committee for Natural Disaster Prevention and Control, Search and Rescue of Quang Nam province shall decide to operate A Vuong, Dak Mi 4, Song Tranh 2 and Song Bung 4 reservoirs according to this document.

Article 13. Storage of water at the end of flood season

1. From November 15 to December 15, according to the judgements about trends in weather and hydrological conditions, which are delivered by the National Centre for Hydro - Meteorological Forecasting, if the weather conditions which may cause rain and flood in the basin do not prevail, the reservoir owners may, on their own initiative, store water to gradually reduce the water level to the retention water level.

2. During storage of water prescribed in Clause 1 of this Article, if the National Centre for Hydro - Meteorological Forecasting forecasts an emergency storm, inshore tropical depression or other weather conditions, which are likely to cause rain and flood, thereby directly affecting the areas in Vu Gia - Thu Bon river basin in the next 24-to-48 hours, the head of the Steering Committee for Natural Disaster Prevention and Control, Search and Rescue of Quang Nam province shall decide to operate reservoirs as follows:

a) Operate A Vuong, Dak Mi 4 and Song Bung 4 reservoirs to reduce the flood prevention water level as prescribed in Point a, Clause 2, Article 7 of this document but not exceeding the level provided in Table 2 and to reduce floods hitting lowlands as prescribed in Clauses 3 and 4, Article 7 of this document;

b) Operate Song Tranh 2 reservoir to reduce the flood prevention water level as prescribed in Point a, Clause 2, Article 8 of this document but not exceeding the level provided in Table 2 and to reduce floods hitting lowlands as prescribed in Clauses 3 and 4, Article 8 of this document;

c) During the operation carried out as prescribed in Points a and b of this Clause, according to the weather forecast provided by the National Centre for Hydro - Meteorological Forecasting, if the weather conditions which may cause rain and flood are no longer likely to directly affect the areas in Vu Gia - Thu Bon river basin, reservoirs shall be operated and regulated to gradually reduce water level to the retention water level.

3. After the process of reducing floods hitting lowlands is completed, if the National Centre for Hydro - Meteorological Forecasting does not issue the next warning as prescribed in Clause 2 of this Article, reservoirs are allowed to store water, but not exceeding the retention water level.

Chapter III

OPERATION OF A VUONG, DAK MI 4, SONG TRANH 2, SONG BUNG 4, SONG BUNG 4A AND SONG BUNG 5 RESERVOIRS DURING DRY SEASON

Article 14. Rules for operating reservoirs during dry season

1. Reservoirs are operated according to the period of increasing or normal water use and 10 day period.

2. Reservoirs are operated according to the water level at Ai Nghia and Giao Thuy hydrological stations.

3. During operation of reservoirs, according to the current reservoir water level and forecast about average reservoir inflow in the next 10 days, they are operated in a manner that the reservoir water level in the equivalent period are not below the level provided in the Appendix III.

Article 15. Periods over which reservoirs are operated during dry season

1. Period of increasing water use: from May 11 to June 10.

2. Period of normal water use: from December 16 to May 10 of the succeeding year and from June 11 to August 31.

Article 16. Operating reservoirs during period of increasing water use

1. Dak Mi 4 reservoir:

a) Operate the reservoir to discharge water to lower Vu Gia river:

On a daily basis, according to the water level measured at 07:00 at Ai Nghia hydrological station, the reservoir shall be operated as follows:

- In case the water level at Ai Nghia hydrological station is below 2.67 m, the reservoir shall be operated to discharge water continuously at a flow rate of 25.0 m3/s;

- In case the water level at Ai Nghia hydrological station is from about 2.67 m to 2.80 m, the reservoir shall be operated to discharge water continuously at a flow rate of at least 12.5 m3/s;

- In case the water level at Ai Nghia hydrological station is below 2.80 m, the servoir shall be operated to discharge water continuously at a flow rate of at least 5 m3/s.

b) Operate the reservoir to discharge water to lower Thu Bon river:

After carrying out operation as prescribed in Point a of this Clause, according to the current reservoir water level and forecast about average reservoir inflow in the next 10 days, the reservoir shall be operated to discharge water to lower Thu Bon river in an appropriate manner.

2. A Vuong reservoir:

On a daily basis, according to the water level measured at 07:00 am at Ai Nghia hydrological station, the reservoir shall be operated as follows:

a) In case the water level at Ai Nghia hydrological station is below 2.67 m, the reservoir shall be operated for at least 12 hours a day at an average daily flow rate of at least 30 m3/s;

b) In case the water level at Ai Nghia hydrological station is from about 2.67 m to 2.80 m, the reservoir shall be operated for at least 12 hours a day at an average daily flow rate of at least 25 m3/s;

c) In case the water level at Ai Nghia hydrological station is greater than 2.80 m, according to the current reservoir water level and forecast about average reservoir inflow in the next 10 days, the reservoir shall be operated in an appropriate manner.

3. Song Bung 4 reservoir:

On a daily basis, according to the water level measured at 07:00 am at Ai Nghia hydrological station, the reservoir shall be operated as follows:

a) In case the water level at Ai Nghia hydrological station is below 2.67 m, the reservoir shall be operated for at least 12 hours a day at an average daily flow rate of at least 55 m3/s;

b) In case the water level at Ai Nghia hydrological station is from about 2.67 m to 2.80 m, the reservoir shall be operated for at least 12 hours a day at an average daily flow rate of at least 43 m3/s;

c) In case the water level at Ai Nghia hydrological station is greater than 2.80 m, according to the current reservoir water level and forecast about average reservoir inflow in the next 10 days, the reservoir shall be operated in an appropriate manner.

4. Song Tranh 2 reservoir:

On a daily basis, according to the water level measured at 07:00 am at Giao Thuy hydrological station, the reservoir shall be operated as follows:

a) In case the water level at Giao Thuy hydrological station is below 1.02 m, the reservoir shall be operated for at least 12 hours a day at an average daily flow rate of at least 90 m3/s;

b) In case the water level at Giao Thuy hydrological station is from about 1.02 m to 1.16 m, the reservoir shall be operated for at least 12 hours a day at an average daily flow rate of at least 80 m3/s;

c) In case the water level at Giao Thuy hydrological station is greater than 1.16 m, according to the current reservoir water level and forecast about average reservoir inflow in the next 10 days, the reservoir shall be operated in an appropriate manner.

5. During the operation carried out as prescribed in Clauses 1, 2, 3 and 4 of this Article, the interval between the two continuous discharges of water must not exceed 08 hours.

Article 17. Operating reservoirs during period of normal water use

1. Dak Mi 4 reservoir:

a) Operate the reservoir to discharge water to lower Vu Gia river:

On a daily basis, according to the water level measured at 07:00 am at Ai Nghia hydrological station, the reservoir is operated as follows:

- In case the water level at Ai Nghia hydrological station is below 2.67 m, the reservoir shall be operated to discharge water continuously at a flow rate of at least 12.5 m3/s;

- In case the water level at Ai Nghia hydrological station is from 2.67 m to 2.80 m, the reservoir shall be operated to discharge water continuously at a flow rate of at least 8 m3/s;

- In case the water level at Ai Nghia hydrological station is greater 2.80 m, the reservoir shall be operated to discharge water continuously at a flow rate of at least 3 m3/s.

b) Operate the reservoir to discharge water to lower Thu Bon river:

After carrying out operation as prescribed in Point a of this Clause, according to the current reservoir water level and forecast about average reservoir inflow in the next 10 days, the reservoir shall be operated to discharge water to lower Thu Bon river in an appropriate manner.

2. A Vuong reservoir:

On a daily basis, according to the water level measured at 07:00 am at Ai Nghia hydrological station, the reservoir is operated as follows:

a) In case the water level at Ai Nghia hydrological station is below 2.67 m:

- The reservoir shall be operated to discharge water at an average daily flow rate of at least 22 m3/s over the period from December 16 to January 31;

- The reservoir shall be operated to discharge water for at least 12 hours a day at an average daily flow rate of at least 22 m3/s over the period from February 01 to April 10;

- The reservoir shall be operated to discharge water for at least 12 hours a day at an average daily flow rate of at least 18 m3/s over the period from April 11 to May 10;

- The reservoir shall be operated to discharge water for at least 12 hours a day at an average daily flow rate of at least 28 m3/s over the period from June 11 to August 31.

b) In case the water level at Ai Nghia hydrological station is from 2.67 m to 2.80 m:

- The reservoir shall be operated to discharge water at an average daily flow rate of at least 18 m3/s over the period from December 16 to January 31;

- The reservoir shall be operated to discharge water for at least 12 hours a day at an average daily flow rate of at least 18 m3/s over the period from February 01 to April 10;

- The reservoir shall be operated to discharge water for at least 12 hours a day at an average daily flow rate of at least 15 m3/s over the period from April 11 to May 10;

- The reservoir shall be operated to discharge water for at least 12 hours a day at an average daily flow rate of at least 24 m3/s over the period from June 11 to August 31.

c) In case the water level at Ai Nghia hydrological station is greater than 2.80 m, according to the current reservoir water level and forecast about average reservoir inflow in the next 10 days, the reservoir shall be operated in an appropriate manner.

3. Song Bung 4 reservoir:

On a daily basis, according to the water level measured at 07:00 am at Ai Nghia hydrological station, the reservoir is operated as follows:

a) In case the water level at Ai Nghia hydrological station is below 2.67 m:

- The reservoir shall be operated to discharge water at an average daily flow rate of at least 35 m3/s over the period from December 16 to January 31;

- The reservoir shall be operated to discharge water for at least 12 hours a day at an average daily flow rate of at least 40 m3/s over the period from February 01 to April 10;

- The reservoir shall be operated to discharge water for at least 12 hours a day at an average daily flow rate of at least 35 m3/s over the period from April 11 to May 10;

- The reservoir shall be operated to discharge water for at least 12 hours a day at an average daily flow rate of at least 40 m3/s over the period from June 11 to August 31.

b) In case the water level at Ai Nghia hydrological station is from 2.67 m to 2.80 m:

- The reservoir shall be operated to discharge water at an average daily flow rate of at least 30 m3/s over the period from December 16 to January 31;

- The reservoir shall be operated to discharge water for at least 12 hours a day at an average daily flow rate of at least 25 m3/s over the period from February 01 to April 10;

- The reservoir shall be operated to discharge water for at least 12 hours a day at an average daily flow rate of at least 23 m3/s over the period from April 11 to May 10;

- The reservoir shall be operated to discharge water for at least 12 hours a day at an average daily flow rate of at least 28 m3/s over the period from June 11 to August 31.

c) In case the water level at Ai Nghia hydrological station is greater than 2.80 m, according to the current reservoir water level and forecast about average reservoir inflow in the next 10 days, the reservoir shall be operated in an appropriate manner.

4. Song Tranh 2 reservoir:

On a daily basis, according to the water level measured at 07:00 am at Giao Thuy hydrological station, the reservoir is operated as follows:

a) In case the water level at Giao Thuy hydrological station is below 1.02 m:

- The reservoir shall be operated to discharge water at an average daily flow rate of at least 35 m3/s over the period from December 16 to January 31;

- The reservoir shall be operated to discharge water for at least 07 hours a day at an average daily flow rate of at least 35 m3/s over the period from February 01 to April 10;

- The reservoir shall be operated to discharge water for at least 06 hours a day at an average daily flow rate of at least 29 m3/s over the period from April 11 to May 10;

- The reservoir shall be operated to discharge water for at least 07 hours a day at an average daily flow rate of at least 32 m3/s over the period from June 11 to August 31.

b) In case the water level at Giao Thuy hydrological station is from about 1.02 m to 1.16 m, the reservoir shall be operated for at least 06 hours a day at an average daily flow rate of at least 29 m3/s;

c) In case the water level at Giao Thuy hydrological station is greater than 1.16 m, according to the current reservoir water level and forecast about average reservoir inflow in the next 10 days, the reservoir shall be operated in an appropriate manner.

5. During the operation carried out as prescribed in Clauses 1, 2, 3 and 4 of this Article, the interval between the two continuous discharges of water (except for the period from December 16 to January 31 of the succeeding year) must not exceed:

a) 08 hours, for A Vuong, Dak Mi 4 and Song Bung 4 reservoirs;

b) 09 hours, for Song Tranh 2 reservoir.

Article 18.  

When Song Bung 4 reservoir is operated to discharge water, Song Bung 4A reservoir shall be operated to discharge water at a flow rate not below the reservoir inflow.

When A Vuong, Song Bung 4 and Song Bung 4A reservoirs are operated to discharge water, Song Bung 5 reservoir shall be operated to discharge water at a flow rate not below the reservoir inflow.

Article 19. Operating reservoirs to maintain reservoir water level during dry season

1. During the operation carried out as prescribed in Articles 16 and 17 of this document, the reservoir water must not be below the level in the period provided in Appendix III of this document.

2. In case of failure to maintain the water level in the equivalent period provided in the Appendix III, according to the reservoir inflow in the next 10 days, the President of the People’s Committee of Quang Nam province shall decide to adjust flow rate and operation period to ensure that the reservoir water is not below the level in the next period.

3. In case the reservoir water fails to reach the level provided in the Appendix III in the early dry season, not later than February 0, the President of the People’s Committee of Quang Nam province shall decide to operate reservoirs to ensure that reservoir water reaches the level provided in the Appendix III.

Chapter IV

RESPONSIBILITY FOR OPERATION OF RESERVOIRS, PROVISION OF INFORMATION AND REPORTING

Article 20. Responsibilities of the heads of the Steering Committees for Natural Disaster Prevention and Control, Search and Rescue at all levels affiliated to Da Nang city and Quang Nam province during flood season

1. The head of the Steering Committee for Natural Disaster Prevention and Control, Search and Rescue of Quang Nam province shall:

a) Keep a permanent and close watch on rain and flooding developments, decide on reservoir regulation scheme, and issue the reservoir operation order as prescribed in Articles 7, 8, 12 and 13 of this document. The reservoir operation order as prescribed in Articles 7, 8 and 13 of this document must be issued at least 04 hours before the first discharge door is opened, except for emergency and unusual cases;

b) Inspect and supervise the execution of the reservoir operation order; direct the implementation of flood response plan and response to situations affecting safety of people in lowlands when reservoirs discharge water.

c) Upon issuance of the reservoir operation order, immediately notify the head of the Steering Committee for Natural Disaster Prevention and Control, Search and Rescue of Da Nang city and the head of the Steering Committee for Natural Disaster Prevention and Control, Search and Rescue of the district which may be flooded due to reservoir operation, and notify the Hydro - Meteorological Station for Mid-Central Vietnam, National Centre for Hydro - Meteorological Forecasting and Song Bung 4A and Song Bung 5 reservoir managing entities;

d) In case of incidents, notify the head of the Central Steering Committee for Natural Disaster Prevention and Control and President of the People’s Committee of Da Nang city.

2. The head of the Steering Committee for Natural Disaster Prevention and Control, Search and Rescue of Da Nang city shall:

a) Upon receipt of the reservoir operation order from the Steering Committee for Natural Disaster Prevention and Control, Search and Rescue of Quang Nam province, immediately notify the head of Committee for Natural Disaster Prevention and Control, Search and Rescue of the district which may be flooded due to reservoir operation;

b) Direct the implementation of flood response plan and response to situations affecting safety of people in lowlands of Vu Gia - Thu Bon river basin when reservoirs discharge water.

3. Upon receipt of the reservoir operation order from the Steering Committee for Natural Disaster Prevention and Control, Search and Rescue of the province, the head of the Steering Committee for Natural Disaster Prevention and Control, Search and Rescue of the district shall immediately notify the President of the People's Committee of the commune of the affected lowlands and direct the implementation of response plans to reduce losses caused by floods. The President of the People’s Committee of the commune shall notify the public for implementation of response plans.

4. The order, notification, direction, suggestions and discussions related to the regulation and issuance of the order to operate A Vuong, Dak Mi 4, Song Tranh 2 and Song Bung 4 between relevant authorities mentioned in Clauses 1, 2 and 3 of this Article must be made in writing and sent by fax or via Internet or by telephone. The original must be sent to the abovementioned authorities and entities.

Article 21. Responsibilities of the President of the People’s Committee of Quang Nam province

1. Organize the dissemination and provide public explanation for this document on mass media and local radio network in order for authorities and people to, on their own initiative, respond to floods, thereby reducing losses, and prepare production and water storage plan in conformity with reservoir operation procedures to use water resources in an effective manner.

2. Direct the inspection and supervision of execution of this document by managing entities.

3. Direct the formulation of flood preparedness plan and organize the implementation of flood development response plan within his/her area. Decide to operate A Vuong, Dak Mi 4, Song Tranh 2 and Song Bung 4 reservoirs in unusual circumstances as prescribed in Clause 6 Article 7, Clause 6 Article 8 and Clause 2 Article 9 of this document, and direct the implementation of measures for assurance of people's safety and loss reduction.

4. Decide to adjust flow rate and reservoir operation period as prescribed in Article 19 of this document.   Direct relevant local governments to formulate water use plan in accordance with regulations of this document. Direct the entities in charge of management and operation of water extraction works within his/her area to store water in conformity with the reservoir operation period specified in this document. In case of drought, water scarcity or unusual request for water use, take charge and cooperate with the People’s Committee of Da Nang city in formulating a plan, and submit it to the Ministry of Natural Resources and Environment for discharge of water to lowlands.

5. Direct Quang Nam Exploitation of Hydraulic Works One Partner Limited Company to close Thanh Quyt and Bau Nit spillways during dry season, except for little fullness flood.

Article 22. Responsibilities of the President of the People’s Committee of Da Nang city

1. Organize the dissemination and provide public explanation for this document on mass media and local radio network in order for authorities and people to, on their own initiative, respond to floods, thereby reducing losses, and prepare production and water storage plan in conformity with reservoir operation procedures to use water resources in an effective manner.

2. Direct the formulation of flood preparedness plan and organize the implementation of flood development response plan within his/her area. Direct the implementation of measures for assurance of people's safety and loss reduction in case of unusual floods.

3. Direct relevant local governments to formulate water use plan in accordance with regulations of this document. Direct the entities in charge of management and operation of water extraction works within his/her area to store water in conformity with the reservoir operation period specified in this document. In case of drought, water scarcity or unusual request for water use, cooperate with the People’s Committee of Quang Nam province in formulating a plan, and submit it to the Ministry of Natural Resources and Environment for discharge of water to regulate water in lowlands.

4. Direct Da Nang Irrigation Exploitation One Member Company Limited to close An Trach and Ha Thanh spillways, except for little fullness flood; direct Da Nang Water Supply Joint Stock Company to formulate a plan and collect water from An Trach spillway on its own initiative in case the water supplied to Cau Do Water Plant is salinized.

Article 23. Responsibilities of the head of the Central Steering Committee for Natural Disaster Prevention and Control during flood season

1. Decide to issue warning and direct the implementation of flood response plan and response to situations affecting safety of people in lowlands when reservoirs discharge water according to regulations.

2. Notify the Prime Minister for prompt remedial measures for emergency discharge by reservoirs for assurance of central work safety or incidents.

3. Decide to operate reservoirs in special cases as prescribed in Clause 1, Article 5 of this document. 

Article 24. Responsibilities of the Minister of Industry and Trade

1. Direct the Vietnam Electricity, National Load Dispatch Centre, A Vuong Hydropower Joint Stock Company, Song Tranh Hydropower Joint Stock Company, Song Bung Hydropower Joint Stock Company, Vietnam Urban and Industrial Zone Development Investment Corporation, Phu Thanh My Joint Stock Company and Power Engineering Consulting Joint Stock Company I to carry out safe operation of A Vuong, Dak Mi 4, Song Tranh 2, Song Bung 4, Song Bung 4A and Song Bung 5 reservoirs.

2. Direct the entities in charge of management and operation of hydroelectric reservoirs to operate such reservoirs to reduce floods and regulate water in lowlands as prescribed in this document; carry out monitoring, forecast and provide data and information for the authorities and entities prescribed in Articles 30, 31 and 32 of this document; install information and alarm system in lowlands in order for people to recognize signals indicating discharge by hydroelectric reservoirs.

3. Direct the Vietnam Electricity and National Load Dispatch Centre to mobilize their maximum capacity while A Vuong, Dak Mi 4, Song Tranh 2 and Song Bung 4 hydropower plants reduce floods hitting lowlands; formulate and adjust the capacity mobilization plan in conformity with reservoir operation period during dry season according to this document.

4. Notify the Prime Minister and the head of the Central Steering Committee for Natural Disaster Prevention and Control to provide direction for prevention of flood in lowlands before reservoirs are discharged in an emergency to ensure safety of central works.

5. Direct the Vietnam Electricity and reservoir owners to install cameras to monitor water discharge and transmit signal and images to the People's Committee of Quang Nam province, People’s Committee of Da Nang city, Steering Committee for Natural Disaster Prevention and Control, Search and Rescue of Quang Nam province, Steering Committee for Natural Disaster Prevention and Control, Search and Rescue of Da Nang city, Central Steering Committee for Natural Disaster Prevention and Control, Ministry of Natural Resources and Environment, Ministry of Industry and Trade, Vietnam Electricity, Department of Water Resources Management and Electricity Regulatory Authority; formulate a plan for design and installation of automatic and online reservoir water discharge supervision system according to regulations.

Article 25. Responsibilities of the Minister of Agriculture and Rural Development

1. During flood season:

a) Direct assurance of safety of relevant irrigation works;

b) Decide to take remedial measures for accidents involving irrigation works in Vu Gia - Thu Bon river basin, report them to the Prime Minister and head of the Central Steering Committee for Natural Disaster Prevention and Control.

2. During dry season:

a) Direct entities in charge of management and operation of irrigation works in Quang Nam province and Da Nang city to review, inspect and get ready for collection of water when reservoirs discharge water, ensuring no water wastage;

b) Direct relevant local governments to adjust the agricultural water use plan in accordance with regulations of this document.

Article 26. Responsibilities of the Minister of Natural Resources and Environment

1. Issue and provide guidance on implementation of this document. Direct the Department of Water Resources Management and competent authorities to inspect the operation of reservoirs according to this document.

2. Direct the National Centre for Hydro - Meteorological Forecasting to carry out monitoring, issue forecast and warning, and provide information and data as prescribed in Articles 30, 31 and 32 of this document.

3. Take charge and cooperate with the People’s Committee of Quang Nam province and the People’s Committee of Da Nang city in reaching an agreement on the plan for regulating water in lowlands in case drought occurs while reservoirs fail to be operated as prescribed in this document.

4. Submit the inter-reservoir operation procedures to the Prime Minister when necessary.

Article 27. Responsibilities of relevant Ministers

Within their competence, relevant Ministers shall:

1. Direct work safety assurance and water extraction under their management.

2. Direct their affiliates and relevant authorities to take remedial measures for flood incidents and formulate a water use plan in accordance with this document.

Article 28. Responsibilities of the Directors of A Vuong, Dak Mi 4, Song Tranh 2, Song Bung 4, Song Bung 4a And Song Bung 5 reservoir managing entities

1. Operate reservoirs as prescribed by this document. 

2. Consider meteorological and hydrological situations; carry out monitoring, issue forecast and provide information and data information as prescribed in Articles 30, 31 and 32 of this document.

3. Install cameras to monitor water discharge and transmit signal and images to the People's Committee of Quang Nam province, People’s Committee of Da Nang city, Steering Committee for Natural Disaster Prevention and Control, Search and Rescue of Quang Nam province, Steering Committee for Natural Disaster Prevention and Control, Search and Rescue of Da Nang city, Central Steering Committee for Natural Disaster Prevention and Control, Ministry of Natural Resources and Environment, Ministry of Industry and Trade, Vietnam Electricity, Department of Water Resources Management and Electricity Regulatory Authority; formulate a plan for design and installation of automatic and online reservoir water discharge supervision system according to regulations.

4. During flood season:

a) Responsibility for execution of the reservoir operation order is as follows:

- The Directors of A Vuong, Dak Mi 4, Song Tranh 2, Song Bung 4, Song Bung 4a And Song Bung 5 reservoir managing entities shall execute the reservoir operation order issued by the head of the Steering Committee for Natural Disaster Prevention and Control, Search and Rescue of Quang Nam province;

- In unusual circumstances where the operation order fails to be executed, the Director of the managing entity must immediately inform the issuer;

- In case of communication failure or failure to receive the operation order issued by a competent person and other unusual circumstances, the Director of the managing entity shall decide to operate the reservoir in accordance with regulations of this document and immediately take response measures.

b) Upon execution of the order to operate discharge doors, the Director of the managing entity must immediately inform the following authorities and entities:

- The heads of the Steering Committee for Natural Disaster Prevention and Control, Search and Rescue of Quang Nam province, and Steering Committee for Natural Disaster Prevention and Control, Search and Rescue of Da Nang city, National Centre for Hydro - Meteorological Forecasting and Hydro - Meteorological Station for Mid-Central Vietnam;

- The Director of Song Bung 4A managing entity, in respect of operation order execution by Song Bung 4 reservoir;

- The Director of Song Bung 5 managing entity, in respect of operation order execution by Song Bung 4 and A Vuong reservoirs.

c) Work safety during operation shall be ensured as prescribed in Article 10 of this document. Upon assurance of work safety during operation, immediately notify the Central Steering Committee for Natural Disaster Prevention and Control, Ministry of Industry and Trade, heads of the Steering Committee for Natural Disaster Prevention and Control, Search and Rescue of Quang Nam province, and Steering Committee for Natural Disaster Prevention and Control, Search and Rescue of Da Nang city;

d) Notification shall be sent to the authorities and entities specified in Points a, b and c of this Clause by fax or via Internet or by telephone. The original shall be sent to such authorities and entities.

5. During dry season:

In case incident or drought occurs while reservoirs fail to be operated as prescribed in this document, the Directors of the managing entities must immediately inform the People’s Committee of Quang Nam province and People’s Committee of Da Nang city to direct use of water in lowlands in an appropriate manner and inform the Ministry of Natural Resources and Environment;

Article 29. Responsibility for work safety

1. If the order to operate A Vuong, Dak Mi 4, Song Tranh 2 and Song Bung 4 reservoirs is issued against the regulations specified in this document, thereby threatening safety of central works, irrigation and traffic work systems and people in lowlands, the issuer must be responsible to law.

2. If the operation order is executed against regulations of this document, thereby threatening safety of central works, irrigation and traffic work systems and people in lowlands, the Director of the relevant managing entity must be responsible to law.

3. If threats to central works are found during operation, thereby requiring remedial measures, Directors of Song Tranh 2, A Vuong and Song Bung 4, Dak Mi 4, Song Bung 4A, and Song Bung 5 reservoir managing entities shall inform and propose remedial measures to the Ministry of Industry and Trade, Vietnam Electricity and Power Generation Corporation 1, Power Generation Corporation 2, Vietnam Urban and Industrial Zone Development Investment Corporation, Phu Thanh My Joint Stock Company, and Power Engineering Consulting Joint Stock Company I respectively; and inform the Central Steering Committee for Natural Disaster Prevention and Control, People’s Committee of Quang Nam province, People's Committee of Da Nang city, Steering Committee for Natural Disaster Prevention and Control, Search and Rescue of Quang Nam province, and Steering Committee for Natural Disaster Prevention and Control, Search and Rescue of Da Nang city.

4. If any incident involving irrigation works in lowlands is found, the People’s Committee of the province or city where the incident occurs shall inform and propose remedial measures to the Ministry of Agriculture and Rural Development, and inform the Central Steering Committee for Natural Disaster Prevention and Control.

5. Annual general inspection shall be carried out before flood season according to regulations. Directors of managing entities shall inspect equipment and work items, and carry out repair to operate reservoirs according to this document, and inform the Ministry of Industry and Trade, Ministry of Agriculture and Rural Development, Central Steering Committee for Natural Disaster Prevention and Control, Vietnam Electricity and heads of the Steering Committee for Natural Disaster Prevention and Control, Search and Rescue of Da Nang city, and Steering Committee for Natural Disaster Prevention and Control, Search and Rescue of Quang Nam province.

6. In case works or equipment breakdowns occur and have yet to be completely repaired before August 31, the Directors of managing entities must immediately inform the authorities specified in Clause 5 of this Article.

Article 30. Regulations on monitoring and forecast during flood season

1. Under normal weather conditions, if weather conditions that may cause flood and rain as prescribed in Clause 2 of this Article are yet to prevail, authorities and entities must comply with the following regulations on monitoring and forecast:

a) Every day, the National Centre for Hydro - Meteorological Forecasting shall provide a forecast made at Ai Nghia and Cau Lau hydrological stations at 11:00;

b) Every day, the Hydro - Meteorological Station for Mid-Central Vietnam shall provide a forecast made at Ai Nghia and Cau Lau hydrological stations at 11:00;

c) Every day, A Vuong Hydropower Joint Stock Company, Song Tranh Hydropower Joint Stock Company, Song Bung Hydropower Joint Stock Company and Vietnam Urban and Industrial Zone Development Investment Corporation shall carry out monitoring and forecast as follows:

- Carry out monitoring and calculation of reservoir water level, reservoir inflow, and weir and plant overflow rate at least 04 times at 01:00, 07:00, 13:00 and 19:00;

- Make the forecast once before 10:00. The forecast must include reservoir inflow, water level measured at the nearest monitoring time and at 06:00, 12:00, 18:00 and in the next 24 hours; expected total discharge at 06:00, 12:00, 18:00 and in the next 24 hours.

2. If there is an emergency storm, inshore tropical depression or other weather conditions which are likely to cause rain and flood, thereby affecting the areas in Vu Gia - Thu Bon river basin, authorities and entities must carry out monitoring and forecast until the flooding event ends. To be specific:

a) The National Centre for Hydro - Meteorological Forecasting shall:

- issue forecasts and warnings. Forecasting and warning frequency are specified in the Decision No. 46/2014/QD-TTg dated August 15, 2014 of the Prime Minister on natural disaster forecasting, warning and communication (hereinafter referred to as “Decision No. 46”);

- collect rain and water level monitoring data at hydro-meteorological stations included in Vu Gia - Thu Bon river system according to regulations;

- make flood and emergency flood forecasts at Ai Nghia and Cau Lau hydrological stations. Forecasting frequency is specified in the Decision No. 46.

b) The Hydro - Meteorological Station for Mid-Central Vietnam shall:

- make flood forecasts at Ai Nghia and Cau Lau hydrological stations. Forecasting frequency is specified in the Decision No. 46;

- collect rain and water level data at hydro - meteorological monitoring stations in Vu Gia - Thu Bon river system under its management;

- make water level, flood and emergency flood forecasts at Ai Nghia and Cau Lau hydrological stations. Forecasting frequency is specified in the Decision No. 46;

- monitor, forecast and discover the period over which water at Ai Nghia and Cau Lau hydrological stations reaches the level provided in Tables 1 and 4.

c) A Vuong Hydropower Joint Stock Company, Song Tranh Hydropower Joint Stock Company, Song Bung Hydropower Joint Stock Company and Vietnam Urban and Industrial Zone Development Investment Corporation shall carry out monitoring and forecast as follows:

- Carry out monitoring and calculation of reservoir water level, reservoir inflow, and weir and plant overflow rate at least 15 minutes at a time;

- Make the forecast about reservoirs 03 hours at a time. The forecast must include, water level, reservoir inflow measured at the current time and at 06:00, 12:00, 18:00 and in the next 24 hours; rising limb; expected total discharge at 06:00, 12:00, 18:00 and in the next 24 hours.

3. Before November 15, the National Centre for Hydro - Meteorological Forecasting must make a forecast about the trends in weather and hydrological conditions and probability of flood occurrence from November 15 to December 15 to serve reservoir operation prescribed in Article 13 of this document.

Article 31. Responsibilty for information provision and reporting during flood season

1. Under normal weather conditions, if weather conditions that may cause flood and rain are yet to prevail, authorities and entities must provide data and information as follows:

a) The National Centre for Hydro - Meteorological Forecasting shall provide a forecast prescribed in Point a, Clause 1, Article 30 of this document for the Central Steering Committee for Natural Disaster Prevention and Control before 12:00 every day;

b) The National Centre for Hydro - Meteorological Forecasting shall provide a forecast prescribed in Point b, Clause 1, Article 30 of this document for the Steering Committee for Natural Disaster Prevention and Control, Search and Rescue of Da Nang city, Steering Committee for Natural Disaster Prevention and Control, Search and Rescue of Quang Nam province, A Vuong Hydropower Joint Stock Company, Song Tranh Hydropower Joint Stock Company, Song Bung Hydropower Joint Stock Company and Vietnam Urban and Industrial Zone Development Investment Corporation before 12:00 every day;

c) A Vuong Hydropower Joint Stock Company, Song Tranh Hydropower Joint Stock Company, Song Bung Hydropower Joint Stock Company and Vietnam Urban and Industrial Zone Development Investment Corporation shall provide forecasts, monitoring data and calculation results as prescribed in Point c, Clause 1, Article 30 of this document for the Steering Committee for Natural Disaster Prevention and Control, Search and Rescue of Da Nang city, Steering Committee for Natural Disaster Prevention and Control, Search and Rescue of Quang Nam province, National Load Dispatch Centre, National Centre for Hydro - Meteorological Forecasting and Hydro - Meteorological Station for Mid-Central Vietnam before 10:00 every day.

2. If there is an emergency storm, inshore tropical depression or other weather conditions which are likely to cause rain and flood, thereby affecting the areas in Vu Gia - Thu Bon river basin, authorities and entities must provide data and information as follows:

a) The National Centre for Hydro - Meteorological Forecasting shall immediately and continuously provide data, forecasts and warnings prescribed in Point a, Clause 2, Article 30 of this document for the Central Steering Committee for Natural Disaster Prevention and Control, Ministry of Industry and Trade and Vietnam Electricity;

b) The Hydro - Meteorological Station for Mid-Central Vietnam shall immediately and continuously provide data, forecasts and warnings prescribed in Point b, Clause 2, Article 30 of this document for the Steering Committee for Natural Disaster Prevention and Control, Search and Rescue of Da Nang city, Steering Committee for Natural Disaster Prevention and Control, Search and Rescue of Quang Nam province, A Vuong Hydropower Joint Stock Company, Song Tranh Hydropower Joint Stock Company, Song Bung Hydropower Joint Stock Company and Vietnam Urban and Industrial Zone Development Investment Corporation.

When water at Ai Nghia and Cau Lau hydrological stations reaches the level provided in Tables 1 and 4, immediately inform the Steering Committee for Natural Disaster Prevention and Control, Search and Rescue of Da Nang city, Steering Committee for Natural Disaster Prevention and Control, Search and Rescue of Quang Nam province, A Vuong Hydropower Joint Stock Company, Song Tranh Hydropower Joint Stock Company, Song Bung Hydropower Joint Stock Company and Vietnam Urban and Industrial Zone Development Investment Corporation;

c) A Vuong Hydropower Joint Stock Company, Song Tranh Hydropower Joint Stock Company, Song Bung Hydropower Joint Stock Company and Vietnam Urban and Industrial Zone Development Investment Corporation shall immediately provide warnings including monitoring data and calculation results prescribed in Point c, Clause 2, Article 30 of this document for the Steering Committee for Natural Disaster Prevention and Control, Search and Rescue of Da Nang city, Steering Committee for Natural Disaster Prevention and Control, Search and Rescue of Quang Nam province, National Load Dispatch Centre, National Centre for Hydro - Meteorological Forecasting and Hydro - Meteorological Station for Mid-Central Vietnam.

3. Responsibility for reporting

A Vuong Hydropower Joint Stock Company, Song Tranh Hydropower Joint Stock Company, Song Bung Hydropower Joint Stock Company and Vietnam Urban and Industrial Zone Development Investment Corporation shall report results of reservoir operation for flood reduction and operating condition of works as follows:

a) Within 02 days after the flood event ends, managing entities shall report results of reservoir operation for flood reduction, operating condition of reservoirs after the flood event and relevant information to the Central Committee for Natural Disaster Prevention and Control, Ministry of Industry and Trade, Steering Committee for Natural Disaster Prevention and Control, Search and Rescue of Quang Nam province, Steering Committee for Natural Disaster Prevention and Control, Search and Rescue of Da Nang city, Vietnam Electricity, National Load Dispatch Centre and Department of Water Resources Management;

b) Before December 31 every year, managing entities shall report results of reservoir operation and operating condition of reservoirs during flood season, proposals and relevant information to the Central Committee for Natural Disaster Prevention and Control, Ministry of Industry and Trade, Steering Committee for Natural Disaster Prevention and Control, Search and Rescue of Quang Nam province, Steering Committee for Natural Disaster Prevention and Control, Search and Rescue of Da Nang city, Vietnam Electricity, National Load Dispatch Centre and Department of Water Resources Management.

4. Before November 15 every year, the National Centre for Hydro - Meteorological Forecasting shall provide forecasts and judgements about trends in weather and hydrological conditions in Vu Gia - Thu Bon river basin for A Vuong Hydropower Joint Stock Company, Song Tranh Hydropower Joint Stock Company, Song Bung Hydropower Joint Stock Company and Vietnam Urban and Industrial Zone Development Investment Corporation to serve water storage at the end of the dry season as prescribed in Clause 1, Article 13 of this document.

5. Methods of providing information and data are as follows:

Information and data shall be provided for the authorities and entities prescribed in Clauses 1, 2 and 3 of this Article in one of the following forms:

a) By fax;

b) Provision of newscast through communication;

c) Provision of newscasts over the Internet;

d) By telephone.

Article 32. Regulations on monitoring and forecasting and responsibility for information provision and reporting during dry season

1. Responsibility for carrying out monitoring and forecasting:

a) The National Centre for Hydro - Meteorological Forecasting shall direct and assign its affiliates to:

- carry out measurement and monitoring of hydro-meteorological values, including rainfall and water level of the entire monitoring network in Vu Gia - Thu Bon river system;

- deliver judgments on trends in weather and hydrological conditions prevailing in Vu Gia - Thu Bon river basin on the first of every month.

b) A Vuong Hydropower Joint Stock Company, Song Tranh Hydropower Joint Stock Company, Song Bung Hydropower Joint Stock Company and Vietnam Urban and Industrial Zone Development Investment Corporation shall:

- carry out monitoring and calculation of reservoir inflow, weir and plant overflow rate, and upper and lower reservoir water level at least twice a day at 07:00 and 19:00;

- forecast reservoir inflow and water level in the next 10 days on the first, eleventh and twenty-first of every month.

2. Responsibility for provision of information and data:

a) Before 16:00 of the first, eleventh and twenty first of every month, the National Centre for Hydro - Meteorological Forecasting shall direct and assign its affiliates to provide the data prescribed in Point a, Clause 1 of this Article in the past 10 days for the People's Committee of Da Nang city, People’s Committee of Quang Nam province, National Load Dispatch Centre, A Vuong Hydropower Joint Stock Company, Song Tranh Hydropower Joint Stock Company, Song Bung Hydropower Joint Stock Company and Vietnam Urban and Industrial Zone Development Investment Corporation.

b) Before 08:00 every day, the Hydro - Meteorological Station for Mid-Central Vietnam shall provide the water level measured at 07:00 for:

- The People’s Committee of Quang Nam province, National Load Dispatch Centre, Song Tranh Hydropower Joint Stock Company and Vietnam Urban and Industrial Zone Development Investment Corporation of Giao Thuy hydrological station;

- The People’s Committee of Quang Nam province, People’s Committee of Da Nang city, National Load Dispatch Centre,  A Vuong Hydropower Joint Stock Company, Vietnam Urban and Industrial Zone Development Investment Corporation and Song Bung Hydropower Joint Stock Company of Ai Nghia hydrological station;

c) A Vuong Hydropower Joint Stock Company, Song Tranh Hydropower Joint Stock Company, Song Bung Hydropower Joint Stock Company and Vietnam Urban and Industrial Zone Development Investment Corporation shall immediately provide the information and data prescribed in Point d of this Clause for National Load Dispatch Centre, National Centre for Hydro - Meteorological Forecasting, Hydro - Meteorological Station for Mid-Central Vietnam and relevant authorities and entities as follows:

- Provided for the People’s Committee of Quang Nam province and People’s Committee of Da Nang city by A Vuong Hydropower Joint Stock Company, Vietnam Urban and Industrial Zone Development Investment Corporation and Song Bung Hydropower Joint Stock Company;

- Provided for the People’s Committee of Quang Nam province by Song Tranh Hydropower Joint Stock Company.

d) Provided information and data include:

- Upper and lower reservoir water level, reservoir inflow, expected discharge of water to lowlands in the past day before 11:00 every day;

- Reservoir inflow and expected discharge of water to lowlands in the next 10 days before 11:00 on the first, eleventh and twenty-first of every month.

3. Methods of providing information and data:

Information and data shall be provided for the authorities and entities prescribed in Clauses 1 and 2 of this Article in one of the following forms:

a) By fax;

b) Provision of newscast through communication;

c) Provision of newscasts over the Internet;

d) By telephone.

Article 33. The amendments that arise during the completion of the procedures for operating inter-reservoirs in Vu Gia - Thu Bon river basin shall be included in a written request submitted to The Ministry of Natural Resources and Environment for assessment and the Prime Minister for decision./.
