DECISION
ON APPROVAL FOR MASTER PLAN FOR CONSTRUCTION OF REST AREAS ALONG NATIONAL HIGHWAYS TO THE YEAR 2020 AND ORIENTATION TOWARDS 2030
THE MINISTER OF TRANSPORT
Pursuant to the Government’s Decree No.107/2012/ND-CP defining functions, rights, responsibilities and organizational structure of the Ministry of Transport;
Pursuant to the Decision No.356/2013/QD-TTg on approval for adjustments to road traffic development planning to the year 2020 and orientation towards 2030 dated February 25, 2013 by the Prime Minister;
Pursuant to the Circular No.48/2012/TT-BGTVT on introduction of national technical regulation on roadside stations (QCVN43:2012/BGTVT);
Pursuant to the Decision No.1531/QD-BGTVT dated June 29, 2012 by the Minister of Transport on preparation strategic plans for the last 06 months of 2012;
In consideration of the request of the Director of the Department of Transport Infrastructure and document No.3769/TCDBVN-VTPC dated August 23, 2013 by the Director General of the Directorate for Roads of Vietnam.
HREBY DECIDES:
Article 1. To approve the master plan for construction of rest areas along national highways to the year 2020 and orientation towards 2030 (hereinafter referred to as “rest area master plan”). The rest area master planning presents the following main contents:
1. Standpoints
1.1. Rest areas are considered as one of the transport infrastructures and shall be constructed along national highways or provincial roads to meet the need of road users, improve traffic safety and promote socio-economic development.
1.2. Rest areas shall be located in accordance with the road traffic master plan to the year 2020 and orientations towards 2030.
1.3. Restaurants and service facilities with the area of above 3,000 m2 located along national highways are prioritized to be upgraded into rest areas under the national technical regulation.
1.4.Rest areas shall be expected to be invested by various types of ownerships, especially under form of BOO projects; the national highway No.1 shall be renovated to have rest areas constructed along as agreed with BOT investor.
1.5. The State and local government shall introduce assistance policies such as concessional loans and preferential policies on land use, premises and other public utilities for rest areas located in mountainous areas or remote areas with low traffic density.
1.6. People’s Committees of provinces shall reserve land for construction of rest areas that adequately serve the current demand and may be expanded by 2030.
2. Purposes
2.1. Purposes to construct modern and convenient rest areas under the appropriate technical regulation with the aim of meeting the need of passengers, means of transport and drivers.
2.2. Objectives
a) 2013 - 2015:
+Have 07 rest areas recognized in accordance with the national technical regulation.
+Construct and renovate 70-80% of the total rest areas (accounting for approx. 30-40 rest areas) along the national highway No. 1 and 15 -20% (accounting for approx. 15-20 rest areas) of the total rest areas along other national highways.
b) 2016- 2020: construct and renovate all expected rest areas along the national highway No.1 to ensure that each province has at least one rest area by 2020, and complete 30-40% of total expected rest areas along other national highways (approx. 25-30 rest areas).
c) 2021 – 2030: Construct and renovate of at least 100- 120 rest areas along national highways to meet the road users’ demand and road traffic development requirements.
3. Rest area construction plan
3.1. Requirements for location of rest areas:
3.1.1. Area and scale
The minimum area of rest areas and their work items must conform to the Circular No.48/2012/TT-BGTVT dated November 15, 2012 by the Minister of Transport on introduction of national technical regulations on roadside stations.
3.1.2. Distance between rest areas
- The distance between rest areas is stipulated as follows:
+30 ÷ 50 km for rest areas located on dual carriageways with high traffic density of above 3,000 vehicles/day
+50 ÷ 70 km for rest areas located on routes with average traffic density of from 1,000 up to 3,000 vehicles/day
+70 ÷ ≥100 km for rest areas located on routes with low traffic density of less than 1,000 vehicles/day.
- The distance between rest area shall be determined to ensure that drivers are not on the wheel for exceeding 4 consecutive hours under the Law on road traffic.
3.1.3. Rest area location
- Rest areas should not be located in urban areas, residential areas or high frequency crash locations.
- For national highways with hard median strips, rest areas shall be located on both sides of such highways.
3.2. Rest areas planning to 2020 and orientation towards 2030
3.2.1. On national highway No.1
It is expected to construct up to 48 rest areas with the total area of 839,000 m2 (including 04 recognized rest areas with the total area of 98,000 m2), including 34 class -I rest areas; 10 class-II rest areas and 04 class-III rest areas (average distance shall be about 50 km). To be specific:
b) 2013 - 2015:
It is expected to construct up to 32 rest areas with the total area of 602,000 m2.
b) 2016 - 2020:
It is expected to construct up to 12 rest areas with the total area of 139,000 m2.
(Refer to the Annex for details)
3.2.2. On other national highways
It is expected to construct up to 104 rest areas on 59 national highways with the total area of 833,000 m2 (including 03 recognized rest areas with the total area of 52,700 m2), including 23 class -I rest areas; 33 class-II rest areas and 48 class-III rest areas (average distance of 50 km/rest area). To be specific:
a) 2013 - 2015:
It is expected to construct 16 rest areas with the total area of 326,300 m2
b) 2016 - 2020:
It is expected to construct 30 rest areas with the total area of 227,000 m2.
c) 2021 - 2025:
It is expected to construct 24 rest areas with the total area of 120,000 m2.
d) 2026 - 2030:
It is expected to construct 31 rest areas with the total area of 107,000 m2.

4. Investment attraction policies
The investment in construction and renovation of rest areas shall be mobilized under the following form and shape:
4.1. With respect to existing rest areas:
Encourage entities providing services in such rest areas to invest in renovating the rest area to be recognized ones under the national technical regulation.
4.2. Encourage the involvement of all types of ownerships; especially transport enterprises and traffic construction corporations, to wholly invest in construction and operation of rest areas along national high ways.
4.3. Public utilities such as parking lots and rest rooms shall be funded with the State capital. Other works items of rest areas on routes with low traffic density, mountainous areas or remote and isolated areas; or essential rest areas on national highways in which no investor are interested ; or those without investor after 02 year from the of announcement shall be invested by other types of ownerships.
4.4. With respect to rest areas from Ha Noi to Can Tho of the national highway No.1
a) Negotiate with BOT investors about rest area construction as the project for construction, expansion or renovation of the national highway No.1 is carried out.
b) Encourage the involvement of other types of ownerships; especially BOO investment projects for construction of rest areas along road routes funded with Government bonds
4.5. Assistance policies for rest areas construction
a) With respect to land reserve
- Under the Law on road traffic , rest areas is considered as transport infrastructures; therefore; rest area investors shall be consider exempting from land use taxes;
- Local governments shall introduce assistance policies on site clearance and relocation for rest area construction.
b) Fee/tax relief for rest area investors:
- Enterprise income tax relief shall be consider granting to rest area investors within a certain period of time
- A relief of import duties on rest area equipment shall be considered
4.6. Management and operation of rest areas
a) Rest area investors have the power to decide methods of rest area operation.
b) Incentive policies shall be introduced to encourage transport enterprises to effectively use recognized rest areas. Fixed route transport should be prioritized.
c) Transport enterprises and cooperatives shall be entitled to get passengers onboard or off at recognized rest areas.
5. Implementation organizations
5.1. Responsibilities of regulatory authorities
5.1.1. The Directorate for Roads of Vietnam shall:
- Take charge of and cooperate with Departments of Transport of province to execute the rest area construction planning.
- Take charge of and cooperate with the PPP management boards, Departments of planning and Investment and relevant agencies to submit rest area construction assistance policies and mechanism for privatization of investment and construction of rest areas to the Ministry of Transport within the second quarter of 2014, and submit them to the Prime Minister within the third quarter of 2014.
- Make the rest area construction planning (model rest area design) publicly available on meetings and means of mass media.
- Take charge of and cooperate with Department of Transports to detail, prepare and execute the annual detailed planning; inspect the planning implementation, aggregate and submit proposals, adjustments or amendments to the planning to the Minister of Transport.
5.1.2. The Department of Transport Infrastructure shall:
- Cooperate with the Directorate for Roads of Vietnam and relevant agencies to position rest areas locations.
- Supervise and expedite the implementation of this planning; annually submit the achievement report to the Ministry of Transport.
5.1.3. Every PPP management board shall:
- Take charge of and cooperate with the Departments of Finance and Departments of planning and Investment to submit the Prime Minister’s draft on rest area construction assistance policies and mechanism for privatization of investment and construction of rest areas to the Prime Minister within the third quarter of 2014.
- Negotiate with BOT investors about construction of rest areas as the projects for construction and renovation of national highway No.1 is carried out.
5.1.4. The Department of Finance and Department of Planning and Investment shall:
Cooperate with PPP management boards to submit the Prime Minister’s draft on rest area construction assistance policies and mechanism for privatization of investment and construction of rest areas to the Prime Minister within the third quarter of 2014.
5.1.5. Every transportation authority shall:
- Adjust or amend regulations on utilization of recognized rest areas during the transportation of passengers or cargoes.
- Supplement regulations on getting passengers onboard or off at recognized rest areas.
5.1.6. Every People’s Committee of province shall:
- Reserve land for constructing rest areas along national highways prescribed in the approved planning.
- Invest in constructing and renovating infrastructures, introduce investment attraction policies according to the reality.
- Introduce assistance policies on site clearance for rest area construction.
5.1.7. Every Department of Transport of provinces shall:
- Cooperate with the Directorate for Roads of Vietnam to make the rest area construction planning and investment attraction policies publicly available.
- Cooperate with the Directorate for Roads of Vietnam to position the location of each rest area along national highways, develop the detailed annual plan for rest area construction; cooperate and provide investors with instructions on the implementation of the planning; and inspect the execution and propose planning measures.
- Disseminate the benefits of rest areas to transport enterprises, road users and locals.
5.2. Sources of finance
The planning execution shall be funded with the State capital and other sources of finance such as enterprise’s charter capital, loans from credit institutes or international financial aids. The investment under the forms of PPP, BOT and BOO is prioritized.
Article 2. This Decision enters into force from the date on which it is signed.
Article 3. The Chief of Office, Chief Inspector Directors of relevant Departments, Director –Chief of the PPP Management Board; Director General of the Directorate for Roads of Vietnam, Director General of the Ho Chi Minh Street Project Management Board; Directors of Centers for Information and Technology, Heads of Departments of Transports of provinces and centrally-affiliated cities, and heads of relevant agencies shall be responsible for the implementation of this Decision. /.
